Ther NFA is certainly concerned with tax money.
But the Manufacturers Annual Report where the manufacturer declares how many guns he has produced and pays the 11% tax on it is certainly tax money.
And Cav understated their liability by about 90%

And yes, should doesn't really enter into it.

Firearms Manufacturer and Its Owner Plead Guilty to Illegally Selling Firearms, Agree to Surrender License

PHOENIX, AZ – Cavalry Arms Corporation and its owner Shawn Michael Nealon, 38, of Mesa Arizona., pleaded guilty to the felony offense of Illegal Sale by a Federally Licensed Firearms Dealer to an Out-of-State Resident, in federal district court in Phoenix. Cavalry Arms Corporation and Nealon have also agreed to surrender their federal licenses to sell firearms.

"Selling to out-of-state residents has been illegal since 1968, we are enforcing federal firearms laws that have been on the books for over 40 years," said John A. Torres, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives, Los Angeles Field Division. "Selling firearms illegally to out of state residents, is something ATF and our state and local partners will aggressively pursue, and although there are very few dealers that engage in criminal transactions, their impact on individuals and communities can be devastating."

Nealon maintained a federal firearms license (FFL) in his name as well as one under Cavalry Arms Corporation and both operated in the state of Arizona. The investigation conducted by ATF agents and inspectors spanned from Arizona to California and began in January 2008.

The investigation uncovered that on March 2, 2007, Nealon used his personal FFL to sell four firearms to an out-of-state resident. Nealon knew that at the time of the sale, the buyer resided in California. Over a 24 month period beginning in September 2005, Cavalry Arms’ FFL was used to sell 36 firearms to that same individual including AR-15 and AK-47 rifles and a variety of shotguns and handguns.

"Mr. Nealon has finally taken responsibility for his crime of illegally selling firearms to someone he knew was an out-of-state resident," said Dennis Burke, U.S. Attorney for the District of Arizona. "When firearms are sold illegally, they often end up being used in crimes of violence in the United States and other countries. This criminal activity will not be tolerated in the District of Arizona."

Nealon is scheduled to be sentenced on April 26,2010. A conviction for Illegal Sale by a Federally Licensed Dealer to an Out-of-State Resident carries a maximum penalty of five years in prison, a $250,000 fine or both.

so was it an illegal sale because...

1. it was a non-CA compliant
or ...
2. it was out of state period
or ...
3. were these AR lowers registered as pistols?

I thought long gun sales to out of state residents were legal...

inquiring minds want to know????
 
Kali is a odd state on long guns and pistolas.
So many rules on how and why and who and when.
But its all about the mags, detachable, fixed etc.
I do not profess to know the kali rules, only glad that I do not live in that barren gun state. Way too many rules to follow, and me and rules sometimes loose site of each other.

It was illegal because some of the guns sold were handguns.
It was illegal because the buyer was not a AZ resident, despite stating on the 4473 that he was.
It was illegal because the dealer knew or should have known that the buyer was not an AZ resident
It was illegal because the buyer had fraudulently obtained an AZ driver's license.
It was illegal because the dealer did not file a report of multiple handgun sales when he should have.

I dont know about CA law. Typically ATF doesn't get involved in state law issues, in my experience.

Shotguns and rifles can be sold by an FFL to an out of state resident provided the gun is legal in both states.

The ones on the plea agreement (the 4) appear to be rifles.

Christopher Mathwig, 38, pleaded guilty Tuesday to making false statements to acquire 40 firearms from another state. Sentencing in November. I wonder what he'll get. He surendered his firearms.

The owner of Calvary Arms was sentenced in February to three years in prison, plus community service, plus a $10,000 fine. Better than 5 years and a $250,000 fine I suppose.

I read somewhere they had an issue with the way their serial numbers where integrated (metal piece) and exposed them to be easily spoofed. Probably something could be fixed easily, but I am not sure this is the only issue.
Anyway the ATF these days they should be nicer to the shooting enthusiats. They are there to stop the illegal firearms traficcing and they should help proactivively anyone trying to make a living of a good product made here in the USA.
Soon arms, lawyers and restless leg syndrome medication will be the only products made here.
