Colt 6920 AR Upper--CA Legal?

Hello. I have a Colt 6920 AR upper currently for sale. For those unfamiliar, it's a flat-top, removeable carry handle AR upper with threaded A2 flash suppressor, M203 cut barrel, and may even accept a bayonet. I heard it was illegal in CA (as are many things) so I posted "no sales to CA" to be safe. Of course now I have potential buyers who claim it is legal. Anyone know for sure? Did a search, but only found some info regarding registering lowers. Thanks guys.
 
The upper is legal as long as it doesn't actually come with a grenade launcher.

California law requires it to be used with a lower that complies with our laws, but that's the buyer's problem to deal with. If you want to, include a written statement to that effect.

Our laws are not like the old Federal law. Here, an AR with no flashhider and a fixed stock is sill illegal to sell because it has a detachable mag and a pistol grip. A fixed-magazine lower (several are now available, or there are ways to build them from parts), though, can have all the evil features and still be legal.

Bottom line, in CA you can have any non-Class III upper you want, but you have to use it with a CA lower (or an old lower registered before 2000).

Flash-hiders are "Evil features" in Cali, but comps and brakes are good-to-go. I believe it is not an illegal upper until it is mated to an det-mag lower.

Plus guys who have their lower registered as an AW can legally buy your upper, IIRC.

But I ain't a lawyer.
 
Thanks guys, really appreciate the info. I would have posted this on "the forum specific to this rifle", but can't stand that place. Overrun by mall ninjas, internet commandos and the like. While on the subject, what makes a LOWER pre-ban or post-ban and what difference does it make now that the AWB has sunsetted?

Flash hiders are only an "evil feature" on a gun with a detachable magazine.

An Assault Weapon by CA law is a semiauto...

centerfire with detachable magazine + any ONE or more of the following:
pistol grip
flash suppressor
folding or collapsible stock

OR less than 30" long, no matter what features

OR with a fixed magazine larger than 10 rounds, no matter what features (.22 tube fed rifles exempted)

If you have a setup that can legally use a pistol grip, it can also use the flash hider.

A Mini-14, for example, is legal as long as it doesn't have a flash hider, a pistol grip or folding stock. Put any one of those things on it, and it's illegal. A "1994 Federal Ban Compliant" AR is still illegal because it has a pistol grip.

Anyway, the upper is okay. It's up to the buyer to assemble the gun in a legal manner. With a fixed magazine, or on a .22 rimfire, or on a bolt action, a flash hider is not an "evil feature." Flash hiders are, themselves, legal to sell. Again, they have to be used in compliance with the law.

You forgot bayonet lug, grenade/flare launcher attachment, tumbhole stock, and forward grip.

Appears your barreled upper is perfectly legal to sell anywhere in USA, including CA.

I assume this has a 16" barrel, or that its 14.5" barrel has a permanently attached (pinned/welded or silver soldered) flash hider that brings up the total bbl length to 16". Barrel length is measure from muzzle end to bolt face.

Many Californians would buy this barreled upper because they either have legally owned registered AWs in CA which can legally accept this upper, or have an "off-list" lower receiver with a 10 round nondetachable (fixed) magazine - which can also accept this upper legally, as it has not formed a PC 12276.1 assault weapon.

Let the people in various finicky states worry about what kind of lower it gets mounted on.

You're not selling a gun, you're just selling unrestricted 'gun parts'.

Just a reminder that a bayo lug (as long as it isn't also a grenade launcher a la FAL) is legal on any CA rifle. It WAS a Federal characteristic.
