DOJ Delayed on new handgun

I live in California. So had to wait ten days to pick up my new bought and paid for Sig p220 ST. My Ten day wait was up today. When I went to pick up my gun today all I got was a piece of paper. Stating Delay Delivery. Do Not Release The Firearm Until Further Notice From DOJ. There is a phone number there to call. Has any one else had this happen? What are some of the reasons this could happen? I can't call the number till Monday.
I may have committed a misdemeanor when I was 18. I 'm 42 now. But sure no felony's that I can think of. I called the police a couple of times lately. Because of problems with a neighbor. Also my name is about the most common name possible. Maybe they are having problems with my name being so common. Any ideas what the problem could be? And how long something like this could take to clear up? Thanks for the help. Dave

Probably since you have a common name.

Did you put your Social Security number on the forms? I hear that will help speed things up. Some others were saying they have trouble since they had security clearances in the military. And their background just says investigated by the FBI.

I would look deeper.

Do you have a restraining order out on you? Did you answer 'yes' to any of the questions on the questionaire you filled out when you started the dros? Have you purchased a handgun before? Make the call and they'll give you the details as to why the delay.

This is a "hold". I saw it a number of times during my gun store days. It can happen for many reasons. An unpaid traffic ticket, a legal problem that has not yet gone to court or otherwise been resolved, etc., etc.

The only way to know for sure is to call the phone number. The dealer is given no information as it is considered the buyer's personal info.

If you had answered any of the questions on the forms incorrectly, it would be a flat "no sale".

Make the call, it could be something that is easily resolved. However the dealer must hear officially from the DOJ before the gun is released to you. This is usually done by a letter in the mail.

I never got this problem, nor do I put SSN on that form. if you've got common name, it might help if you put it there.

It's probably a name issue. It happens with common and not so common names though. Every FFL place I've asked said that names are the number one delay.

Don't worry, I am sure that one or more of our fellow THR'ers will be along in a minute to tell you that this delay and the 10 day California waiting period are not an infringement of your rights, and are necessary in order to keep guns out of the hands of criminals. :banghead:

I was delayed once. Common name I share with a felon... Nice to know I have to drive 50 miles home after being delayed and having to go back on a Monday (another 50 miles plus lost time)... I haven't bought a firearm since that last delay, I wonder if it will happen again next time?

Did you also have a common DL#, SSN#, or other identification that you used to purchase the weapon?? It's bunk. States like California and New York use restrictive gun control laws to take guns away from good folks and make criminals out of people that aren't, yet these laws do nothing to actually help the people that are hurt by the scumbags that are out there victimizing people. They need to get with the program and look at the rest of the country and see how more guns and more permits are what saves lives. Not stiffer laws, more people in prison, and tighter govt. control.

Well today I got a hold of the lady at the DOJ that is doing my paper work. She said that I was arrested back in 1984 for Unlawful Assembly. And Failure To Disperse. And that they couldn't see what had ever happed with it. I guess they were wondering if it was something I didn't take care of. I told her that sure wasn't me. She quickly noticed that it was on the same day that I had gotten the one misdemeanor that is on my record. She thinks a clerk somewhere along the way typed in a wrong code. She said she is sure she can take care of it. She said just give her one or two days. She took down my number and said she would call me in a day or two. So that made me feel a lot better. I was getting ready to move out of California.
Also wanted to mention. The gun shop said the reason they didn't call was because they didn't want to cause any problems at home. Like maybe with the wife being upset about a hand gun purchase. I looked at the DOJ delay letter. It was dated the same day as the purchase. I left the shop at 4:45PM the DOJ closes at 4:00PM go figure. So the shop new for all ten days. They had taken my number down. For what they said. Just in case. I think they just screwed up and forgot to call me:banghead: Take care all. Dave

I used to live in CA. I have a very uncommon name. Riverside DA. Found a similar name at the IRS. They garnished my wages(there's a deadbeat dad out there). DA says you have to prove who you are. That was the first mistake. Then they hounded me for years. They are complete idiots, out there. :banghead:

I still love that in California a drivers license is not "proof of residence" but a satellite tv bill is. Last I knew you could take those dishes anywhere!

That's just sick. I hate the Santa Ana winds! When they blow I have to wipe a layer of dirt and dust off my entire desk, computer, etc. I work by the ontario airport and it really blows hard here.

The cold weather and added snow sucks. But I can go shooting in a heavy coat. And last I checked there wasn't a place on earth that didn't need a civil engineer from time to time

As soon as schools done I'll be gone! I'm leaning towards Az, Wa, or Fl at the moment. They all seam to have better (I mean fewer) gun laws!

Santa Ana Winds

Devil Winds I often shoot in the Morongo pass, try doing that with hot dry "huricane force" winds.

The Santa Ana winds (or Santana winds) are warm, dry winds that characteristically appear in Southern California weather during autumn and early winter.

Meteorology

Santa Anas are a type of föhn wind, the result of air pressure buildup in the high-altitude Great Basin between the Sierra Nevada and the Rocky Mountains. This air mass spills out of the Great Basin and is pulled by gravity into the surrounding lowlands. The air circulates clockwise around the high pressure area bringing winds from the east and northeast to Southern California (the reverse of the westerly winds characteristic of the latitude).

It is often said that the air is heated and dried as it passes through the Mojave and Sonoran Deserts, but according to meteorologists this is a popular misconception. The Santa Ana winds usually form during autumn and early spring when the desert is relatively cold, although they may form at virtually any time of year. The air heats up due to adiabatic heating while being compressed during its descent. While the air has already been dried by orographic lift prior to reaching the Great Basin, the relative humidity of the air declines rapidly as it descends and warms in its final stages as it passes over the Transverse and Peninsular Ranges.

The air is then forced down the mountain slopes out towards the Pacific coast; the air mass is further heated by compression as it drops in altitude before reaching the Los Angeles Basin western San Diego County and Tijuana (Baja California) at typical speeds of 35 knots. The southern California coastal region gets its hottest weather of the year during autumn while Santa Ana winds are blowing. During Santa Ana conditions it is typically hotter along the coast than in the deserts and the humidity plummets to less than 15%.

As the Santa Ana winds are channeled through the mountain passes they can approach hurricane force. The combination of wind, heat, and dryness turns the chaparral into explosive fuel for the infamous wildfires the region is known for. Wildfires fanned by Santa Ana winds burned 721,791 acres (2,921 km²) in two weeks during October 2003.

Although the winds often have a destructive nature, they have some positive benefits as well. They cause cold water to rise from the bottom of the ocean to the top, bringing with it many nutrients that ultimately benefit local fisheries. As the winds blow over the ocean, sea surface temperatures drop about 4 °C (7 °F), indicating an upwelling of deep ocean water. Chlorophyll concentrations in the surface water go from negligible, in the absence of winds, to very active at more than 1.5 milligrams per cubic meter in the presence of the winds.

Normally in CA, you wait while they do the DROS computer search at time of sale so you know immediately whether you are approved or not. The 10-day wait has nothing to do with anything other than letting you "cool down" -no additional background check goes on during this time.

I had it happen to me once where I was "denied" because of an unpaid vehicle registration (not my car). I had to get this cleared up with DMV before I could go back and re-purchase the firearm (also had to repay the DROS fee). At least the shop held the gun in my name and didn't charge me a 30% restocking fee.

The only time where I didn't wait for the DROS to clear was when the computer was down, I didn't wait around for them to try again. Came back 11 days later and picked-up the pistola.

What I don't get is the need for the 10 day "cool off" wait once you already owna gun. SInce handguns are registered here, they know I already have one! Maybe they think guns are like disposible cameras-ome time use. You buy a gun for deer season, get a buck and throw the gun away because it's all used up!

Well called on Monday the lady handling my paper work was not there. Called Tuesday and she said it's just a type error and to give her one or two days. Called back Thursday and she was not in the office again. They said she will be back tomorrow I'll keep on them. It's been sixteen days since I payed for the gun.:banghead: Dave

The DOJ claimed that some clerk back in 1984 typed in a wrong code. So it looked like on the same day as my misdemeanor there was another misdemeanor. And you wont believe what it was for. It was for unlawful assembly and failure to disperse:banghead: And they were telling me it was never taken care of. I told the lady at the DOJ I have never done any protesting. As I was going on about how my family is full of Veterans. She realized Some clerk had just entered a wrong code. She did release the gun but said she did not have the fax she needed. So next week I will do a follow up so I don't get stuck next time I buy a firearm. Will it's Saturday and my Son and I are off to the range. Take care all. Thanks for the help. Dave

What could they be protesting in 1984 ? your (mistake identity) misdemeanor remind me of the pictures on the wall at Oakland MEP station while I was waiting to sign my paper and pick the MOS.The pictured depicted the battle during Vietnam war between Oakland PD, army recruitors and national guard against war protestors who tried to burn down the MEP station.
I am glad that you get the problem solved .May be next time you need to buy the pistol on consignment because you can buy multiple used pistol in the same time and only need to wait 10 days for all the purchase in the same time.
