1) STW can be used as evidence that in your own mind lethal force was not justified in the circumstance, and your state of mind is an important legal consideration in a defensive shooting.
2) STW requires better marksmanship than a COM shot, hence less chance to prevail under dire circumstances. More chance to miss also means more danger to innocent parties. Even if successful it is less likely to be a stopping shot.
3) STW doesn't mean the shootee won't die of being shot. A shot in the leg can easily rupture the femoral artery causing death by exanguination.
4) Any defensive shooting instructor will tell you that warning shots and STW are never an option.
5) If lethal force is justified, any consideration for the well being of the assailant indicates abominable judgement.
