The "New Jersey Self-Defense Law." (A134)

--------------------------------------------------------------------------------

This proposed bill seems to be right up our alley.

Quote:
This bill, the "New Jersey Self-Defense Law," authorizes a person to use force, including deadly force, against an intruder or attacker in a dwelling, residence or occupied vehicle in those instances where the actor reasonably fears imminent peril of death or serious bodily harm.

The bill sets forth the circumstances under which a person is presumed to have a reasonable fear of imminent period of death or serious bodily harm. Those circumstance include instances where a person: (1) is in the process of unlawfully and forcefully entering a dwelling, residence or occupied vehicle; (2) has unlawfully and forcibly entered a dwelling, residence or occupied vehicle; or (3) has removed, or is attempting to remove, another against that person's will from a dwelling, residence or occupied vehicle; or (4) when the actor knows or reasonably believes that an unlawful and forcible entry is occurring or has occurred; or (5) when the actor knows or reasonably believes that an unlawful and forcible act is occurring or has occurred.

The bill clarifies that a person has no duty to retreat before justifiably using force in instances where that person is attacked, reasonably fears imminent peril of death or serious bodily harm to himself or to prevent death or serious bodily harm to another.

Finally, the bill provides immunity, both criminal and civil, for any person who is justified in using force. Under the bill, the court is authorized to award reasonable attorney's fees, court costs, compensation for loss of income and all expenses incurred by a defendant who is wrongly subject to a civil action.

I'd be interested to hear as well (even tho it looks like I'll be leaving in a month after doing my time here - 18 years!). Would always support RKBA efforts in NJ, no matter how futile (should I change my THR name to Don Quiote? ;) )

I grew up in Outer Trenton Suburbs... I hated it there...

when I was a kid, we would go shooting right in my backyard...actually to look back on it, im surprised we got away with it...we lived in a development, but we had undeveloped woods right behind us...

All we shot was .22 rifles, so they were pretty quiet...but the neighbors didnt ever call the fuzz on me..and I was 10 years old when we started...my mother started fights will every neighbor we had, so im surprised we never had trouble...I had to have shot 20 bricks of .22 LR back then in my backyard,lol...it would never happen these days.

I now live in the free state of Florida..been here going on 15 years, and carrying a gun for 14 years...

Although I do see the positives if everyone stood up for NJ rights, I have my own things to work on here where I live, and thats my main concentration...and honestly, that state is lost...

When I was about 15, Pennsylvania put up signs at the border of I95 heading to Philly.. it says "America Starts Here"..lol.. and so true it is... (Although Philly is another story, lol)

Interesting to see this thread pop up again!

Not a mouthpiece...only a member.

The FL registration events are NJCSD ideas that have been great successes so far! NJCSD pretty much does the organizing, provides the volunteers and figures out the logistics, while the ANJRPC provides the facilities, so its a great partnership.

Check out the website to read or even sign up if you're interested. :)
