I am amazed by all the people condoning unethical, immoral, and in some cases downright felonious activity. If you want it buy it. If you can't afford what she is asking why not ask if she is willing to play "Lets make a deal". How about you cut her grass for a summer, or do some home repairs. If you really want the rifle that bad why don't you do some of those things for your neighbors to scare up the grand?

***** "I am amazed by all the people condoning unethical, immoral, and in some cases downright felonious activity." ***** This coming from a guy who's handle is "CYANIDEGENOCIDE" now that's pretty humorous.

I think everything needs to be taken in context.

What I don't understand, and I think we need to hear from the OP again,is.. if the rifle was left to the OP, then why is his sister trying to charge $$$ for it" If it was left in a will it's pretty much black and white. if it's not documented anywhere then it's either a dead issue of a fairly long shot unless you have something to substantiate the claim that it was "left to you"

There's a lot of questions that need to be answered by the Original Poster SATX MAN

if you have the will to prove it go to look at it and call the cops when your there. explaine what is going on and you might just leave with it, ( she probly dosent want police asking a lot of questions )or you might have to wait while they process her violations but in the end you should be able to claim ownership. you waited this long so a little longer wont hurt and you get what grandpa wanted.

The rifle was left to me in the will my father has a copy locked it a safe box and will give me a copy of it. It's not my sister its my aunt and she is doing illegal drugs mothing medically wrong with her just another addic. So when I get will I just call police and show them that it's rightfully mine as decribed in the will?

I have to agree with all those that are saying just go over ask to inspect it and then walk out with it. Even if she calls the cops you simply say it is yours, it was willed to you and perhaps even tell them that you have always had possession of it and that she is just now claiming to own it b/c she is an addict and needs money. You will have possession of it and she will have no proof that she ever had possession of it. It is in fact rightly yours according to the will anyways.

If you have proof that the firearm is yours (has been left specifically to you in the will) then all you need to do is go to the police, inform them that you are the legal owner and are legally able to own firearms in your state, and inform them that your aunt IS NOT legally able to own firearms (due to illegal drugs). Then go to your aunts house, BEFORE the police arrive, inform her that you will now take possession of YOUR firearms unless she wishes to wait around for the police to arrive and determine she is illegally in posession of them and haul her off to jail.

I'm sure she would be more than willing to simply give them to you instead of selling them.....
....unless, of course, she's perfectly willing to wait around a little bit.

Ho hum......where ARE those cops?

I'm sure they'll be here in just a second.

Well?

so , your grand pa left you all these guns when he passed except for the garrand inwhich he left to your aunt - is that the case ??
if he left you ALL the guns including said garand that your aunt is making you pay for what should; by way of will ;rightfully be yours ?

Man oh man.

Some of the advice you are getting here is worth exactly what you are paying for it.

I don't need any money, (exactly what my advice is worth) just the assurance that you'll religiously follow any and all advice you have asked for.

After all, what's the point of asking, "What should I do?" if you're not going to do it?

I say we vote for the kookiest idea and that's what SATX man has to do.

the other guns listed in first post she sold for drugs after my grandfather passed away I thought the Garand was one of them but I have been asking her who she sold them to so I could buy them back but she refused to tell me but last week she told me she still had the Garand and if I still wanted it I couls have it for $1,000.00.

pay me in rubber bands - ammo is getting scarce so im making a rubber band gun ?!?!

since you mentioned it is in the will
here's what you should do
1)get the will
2)go to her house
3)demand your property
4)if she refuses tell her you will call the cops to come help sort this out
5)get your property, either by her giving in and not wanting the cops to be involved or the cops get involved and see that you legally own the property via the will
6)shoot your new property and tell us about how fun it was

there is my free advice.

If it's in the will- get police and lawyers involved.

If it's not in the will, trade her your gun(s) for the Garand. Don't get/give any kind of written receipt, and report them stolen. Wait a few weeks and have a friend report her as a prohibited person in possession. You get your guns back, she gets to pick up trash on the roadside.

I would sell the cheesy, oversized, overpriced, overrated HK45. The result will be positive in two manners, you won't own a "you suck and we hate you" product anymore, and you will get a Garand!

Or, go to her house, ask to see the gun, when it's in your hands wait till she turns around, throw it out the window to a second individual, and just say "voila!", the amazing disappearing gun! Then exit as if nothing happened.

Theres no reason to sell a gun to buy the Garand when you have the will stating that it belongs to you. Especially if that money is just going to further a junkies addiction. Nor should you just walk in and steal it, thats not very highroad. Show her the will and tell her that you will call the cops on her if she refuses to give it to you. A drug addict most likely will not want the cops to show up and hopefully she'll give it to you.

Nor should you just walk in and steal it, thats not very highroad.

While I will agree that stealing is not very Highroad. I have to disagree that him going and taking it would be stealing. If you rightfully own something how can you steal it?

If you cant prove it legally your -before confronting auntie
Id take 600-700$ cash and wave it in her face and tell her it all you could scrape up- If she likes drugs I'm betting she would start licking her chops over all the pharmaceuticals she could buy and what a good time tonight.
NOW It just might be worth $1000,00 If its an all original winchester [Maby even a WIN 13] If it totally OE and not a mis-match It will go up in value -I have 3 M!s that are worth over a thou...

take a careful look at the will, see if the guns are listed, and if there is any identification marks such as serial number spelled out in the will.

Possession is 9/10ths of the law. She could easily claim that you did get your grandpa's gun, and this here is one she got from her ex-husband Jimbo, and you are just trying to get hers because you hocked yours for some NASCAR tickets a few years ago.

Note to add:

This serves as a reminder to all gunnies to have a list that includes at least partial serial numbers of your firearms if you are willing them to a specific person or persons.

If the will says 'give guns X, Y, and Z to George' and George doesn't get them, he can go after the estate and get them or equvalent monies. In this case, the aunt's share of cash from the final estate settlement would be reduced by the amount of the guns.

If you have a will that says 'George gets my guns' then if all George gets is a beat up old 22LR bolt gun and a single shot 410 he can't do anything about it

First response: Get a lawyer, esp. if granny's being a **** about her husband's last wishes.

Second response: Sell the HK. Handguns are like gold these days, even moreso than EBRs, it seems.

Picture this..... you go in and take the gun as suggested.... you get in your car just as she calls the police (because she isn't afraid of the police like you were gambling, or shes stupid from drugs, or just stupid).... the police pull you over and find the 'stolen' weapon and you go to prison for 15 years on gun and home invasion charges... or, spend $15,000 on lawyers fees to beat a 'lame rap'....

I might threaten to call the police after she sees the will and you have the gun in your hand.... but it would not be my first tactic... it would be a bluff that I would play as it rolls... I doubt the police will just take your word for it that she's an addict and remove her property from her, and aside from that they will call it a 'civil matter' as noted, and she will be able to do whatever she wants with said gun (like sell it as soon as possible to try to avoid the problem)

Get the cops in on a 'stolen gun' incident (or addict with a gun) and that gun may never see another target....
