A U.S. Marine 05 commanding an U.S Army battalion? I guess it could happen if it was some kind of combined action force but doubtful. After he claimed he was the victim of 9 assassination attempts, again possible I guess but highly doubtful, I stopped reading knowing this guy was full of it.

The rebuttal from the retired FBI agent was spot on and also a good read.

Sigh, no, it is not hearsay. Hearsay is rumor or something you did not hear or witness first hand.

A subject matter expert, what they are called by the courts, is someone brought in by either the defense or prosecution for their opinion on a matter. To become a subject matter expert, at least in my judicial district, one must demonstrate a higher than average knowledge of the subject than the average person. That being said, it is not a very difficult standard to meet. I am a court recognized SME in gang tattoos. Nothing special about that, I have just studied them more than the average person. That does not make my opinion on a tattoo hearsay, it makes it my opinion. The other side is welcome to call their own SME to refute my testimony.

NEVER is 26 years as an officer hear an "opinion" admitted in any court.

City,county or federal

Opinions are EXACTLY like buttholes = we all have at least one.

That is not "legal jargon" for anything a judge will allow.

And never have I heard of met a " subject matter expert".

You are either an authority [ and can PROVE THAT ] or your an "expert" and can prove that.

Schooling in ballistics and working in that field is generally what makes you an expert in that field.

And not in the field of "opinion".

Well today is a day of firsts for you, Hi, I'm a subject matter expert on gangs ang gang tattoos recognized by the Colorado 4th Judicial District. I can be called upon to give my expert opinion, the DA's words not mine, on matters relating to gangs and gang members. None of which is hearsay, which was the issue you brought up. Do I think it's an opinion? Nope, I know what they mean and I see it as fact, but the court uses what language it so chooses and I go on with my day. And other Judicial Districts may do as they please and call it what they please, my only experience is with the 4th.

This thread is well off topic for the forum.

There are other places on the internet if this kind of discussion is of interest to you...it certainly doesn't belong here
