Good arguments why CC people need OC rights.

In the current issue of Combat Handguns ( Feb 2011, Volume 32 #1 ( why it came out now in the first week of November 2010 I don't know )) there is a good article by Mas Ayoob about people getting into trouble because although they were legally carry concealed they accidentally let their CCW handgun be seen. Page 8.

Also, in that same issue there are three stories of people preventing crimes by showing or allowing their CCW handgun to be seen. Page 6.

Sometimes it is good to OC and others it is better to CC. Living in Alabama I can OC if I want to but CC all the time. But knowing that I can lawfully OC means I could do the same as those in the It Happened to Me article. In sates where OC is illegal I and you could get into legal trouble if we did the same and could not prove to the authorities that it was necessary.

We need legal OC in all fifty states and DC, Puerto Rica, Virginia Islands and all those other little places as well as CC.

Take care ya'll

other two merely exposed their weapon.
Technically brandishing, rather than OC. But I agree with your main point... you shouldn't be in violation just because the wind blows your jacket open while CC.

zoom6zoom....Have you read the stories yet? That was not brandishing in the two instances where the good guy simply exposed his weapon. He did not do so in a threatening manner. That means it was not brandishing.

Edit: Look people, I am not trying to sell magazines but if you want to really know what I am talking about you need to get a copy of that magazine and read the IT Happened To Me section and the article by Mas Ayoob.

Is that a pre-requisite for posting in this thread?

We need a National Carry bill QUICKLY.

We have one already, it is called The Bill of Rights and it makes no distinction for bearing arms either openly or concealed, only that the people retain that right.

Even though I almost never OC, I am very supportive of the active OC community in Michigan for the very reasons stated in the original post. OC protects my CC.

The State of Tennessee did away with the "concealed weapon being glimpsed" issue by making it the Tennessee Handgun Carry Permit: concealed preferred but if the jacket flaps open and the gun/holster is briefly exposed, no foul.

We need concealed carry because your shirt tail might accidentally cover your holstered gun. We need open carry because your jacket might swing open accidentally and exposed your concealed gun.

What would be bad about a Federal law enforcing the Constitution?

It depends upon what type of Federal law we are talking about. If we are talking about a national permit to carry, there is no way that law would enforce the Constitution. The current Federal firearms laws that we have now don't enforce the Constitution, what makes anyone think a new law would?

But, it would also depend on the law too. Maybe a national carry permit that was optional for the gun owner... like FOPA is now. A law that would simply add a permit that every state was forced to recognize would be OK.

But if the law REPLACED state permits and required a national permit to carry - no way. Arizona, Alaska and Vermont would lose their freedoms. State's like mine, WA, would probably lose unlicensed open carry and lose our license that we can obtain on a shall issue basis with only a background check and $55.25.

If we did get an optional national permit, like FOPA is, you can guarantee that some states would not recognize it anyway and would at minimum harrass, up to arrest, anybody carrying on the national permit.

Would you oppose the Thuen Amendment, if it were offered again?

(The Thuen Amendment, which failed in the Senate by one vote, would have required states to respect the Full Faith and Credit clause of the Constitution in the matter of CCW -- you would be able to carry in other states on your state CCW, just as you can drive in other states on your state license.)
