.... here we go, 1st Halloween question of the seasons

alright guys, I was just thinking about this scenario in my head so please don't flame/attempt to kill me. Theoretical scenario, albeit perhaps a stupid one, you throw a Halloween party and your costume involves a firearm (be it real, fake whatever). You feel real would look better and the party will be in yours or a friends residence and NOT a public event. You remove bolt and bolt carrier from your rifle and wrap some orange electrical tape to the flash hider. You also remove the barrel from your sidearm and replace it with a yellow training barrel. Where this scenario to be done, a side arm would be likely ziptied into a drop holster and the rifle tightly slung to ones bac, perhaps with a ziptie in the action somehow. What if any laws are being broken?
 
Depends on where you are.
I figure legally you'll be open carrying so if it's ok where you live, I figure it's ok.
 
Laws broken depend on where you are. You do get stupid points for this one though. If you must do this, go buy an airsoft rifle. They are cheap, and you won't care if something gets all over it. Overall bad idea.
 
on a side note, does anyone know if a surefire m900 would fit onto an airsoft gun? I honestly don't think I've ever bought one or really looked at one very closely.
 
If it is illegal to carry the gun where you are, it doesn't matter how many plugs, zip ties, orange cones, or baggies you put over it ... it's still a gun and it's still illegal.

If you are in a private residence, I'd say the prudent course of action is to ask them. Their house, their rules.

Kind of related: Last Halloween my Sgt. and I were on a "walk-thru" at a local bar for the big party going on and at least three people "grabbed" my sidarm (still in the holster) because they were so tanked that they didn't even realize we were 'really' the police. They thought we just had really kick-ass costumes!! It took some strong hilting of my hand on my sidearm (very crowded) and some very verbal responses on my part :D to get them to understand it was the real deal!!

Kind of an extreme example of what you are talking about but use your head!!
 
I carry real firearms at Halloween. It's perfectly legal where I am, and any high horse soapbax stander can go shove off if they don't like it.
 
it's going to be at a private residence, either mine or my siblings. There would be people drinking, though I will likely not be one of them (past a beer). I guess I'm still just curious as to whether it would or wouldn't be legal. I guess as it's a private residence there wouldn't be a problem right? It would be upon leaving said private residence that one would have to make sure they have the necessary cpl permit for the pistol (though drop holster seems like open carry to me) and a rifle is legal to sling in most places. I suppose I'm just asking partly because I really don't know.
 
You need to give the state and local, hate to say it but beer and guns don't mix, and not just you, but other party goers, as far as the private residence, once again depends on the state, if it ain't your private residence.
 
well, I hadn't partaken in any stupid online discussions in a while so I thought HEY! why not start one myself! ;-) My initial catalyst for even thinking about this involved the fact that all my friends are fellow pro RKBA and firearm enthusiasts. While thinking about a Halloween get together I thought about the fact that at least one of us would probably get the bright idea and I wondered about what kind of legal issues it would bring. Anyways, thanks for the input guys! I hope everyone has fun this.... holiday(?) season.

Whatever you do, DON"T do that. You're representing a REAL firearm as a TOY.

On a side note, I went as a cowboy to a private party a few years back with my Uberti Cattleman in a nice Galco western holster. No drinking (by me), no ammo. A few spinning tricks for some folks, and a good night had by all. It was a close group of likeminded people, no soccer-moms, etc.
 
A few years ago in NYC

a guy went to a big Halloween party dressed as a cop. Unknown to him a real cop is summoned. The guy sees him and draws, presumably to acknowledge their similaar costumes. The real cop also draws and kills him.
 
I worked as a state peace officer in NYC for 40 years, retiring 6 months ago.

I'd never heard of this event.

Can you document it?
