It's possible the guy was actually a decent shot, and didn't intend to hit anyone. Were the two hits direct, or ricochets?
If he was trying "suicide by cop" why didn't the cops oblige him? Did he run out of ammo? Bad ammo management? Very slow cops?
If "assault" is the charge, I'd guess it's because the DA can't charge him with more.
I'd bet he comes up with a "mental" defense.

Yes, in fact I believe at least one person hit was hit with splatter, leaving multiple tiny holes in him. I think it came off the wall he was standing near.

If you live in NY, I would stock up on cheap Walmart ammo, and enjoy the gun shows there in the next year or so. The statists will take care of both of those soon enough.

A more direct analogy would be closing down the bar where said drunk got soused. And bars have been sued, and successfully at that.

Even with no more ammo left, all suicide by cop would take is to aim at them. So it couldn't have been that. Who knows?
