Why does the intrusivness of an action even factor into whether it is constitutional or not? I've read the decisions that have been posted but I, personally, don't see the link between how intrusive a search is and why it would be constitutional.

If you really wanna blow a fuse, go read the case from several years ago in which Supreme Court said you can pee-test high school athletes, then the follow-on case where they expanded it to say you can pee-test all high school students involved in extracurricular activities.

SCOTUS actually said that since athletes strip down and change clothes in front of each other, they've given up their privacy, so peeing in a cup isn't a privacy intrusion. I am not making this up!!!

I was trying to use care in not attacking weasel personally, but commenting on his words.

Hitler's men were "just following orders" but were not justified.

We all have to make ethical choices in our lives. LEO's are not excluded and there are other ways to make a living.

IMO, the War On People Using Certain Substances That Some Dogooders Have Determined To Be Less Than Beneficial (WOPUCSTSDHDTBLTB) should be stopped imediately. Then we wouldn't have these BS decisions tearing down the 4th Amendment. :mad:

I think it's mostly just a quirk of history that chocolate is legal and cocaine is banned (original Coca-Cola). "Four pounds of chocolate with a street value of ..." ;)

But my personal experience is that many drug users (like many alcoholics) tend to be unreliable people, though I think part of that is once someone acts outside the law in one area, they tend to do other things too. Another bad effect of the WOPUCSTSDHDTBLTB.

This doesn't include you or anyone else who can use something in moderation.

Even the old pothead artist down the road from me is harmless as far as I know - he just can't remember what you were talking about 30 seconds ago. ;)

it's that old "Theory of Mind" problem bubbling up from the intellectual cesspool yet again! The nice doggie smells all, and alerts upon

1. Things which are interesting to a nice doggie.

2. Things which the nice doggie has been trained to feel alert about.

3. Things about which the nice doggie's human has bad feelings, so the nice doggie, having a slave nature, immediately validates his master's opinion.

DOGS ARE NOT HUMANS!

DOGS ARE NOT COPS!

Uh, belay that, I think dogs are very like cops. Pack animals, and pick on the weak, and the weird, and all...
 
I figure if you can teach a dog to smell for certain things and alert when it does, it shouldn't be too hard to teach one to make the same alert whenever the handler wants.

Cop: "I'm sure this guy is dirty, I just can't come up with a good reason to search the car. Can you have the dog gimme a reason?"

Dog Handler: "Sure, location?"

Cop: "Uhh, how about the left quarterpanel this time."

Handler: "OK. Here boy. Sit. Infringe."
