How is it that we cannot buy guns from other states?

I understand that the anti gun states would have no hope of controllig guns if people were allowed to simply go to another state to buy a gun. That is a very pragmatic reason for not allowing people to buy guns in (not from) another state.

But how is this justified on a Federal level? I can buy a car, clothing, OTC medicine, ammo and investments in a state I do not live in.

I have to wonder that this is not a pretty vulnerable law that could possibly be attacked.

Was this part of the GCA of 1968?

It's this little thing called "interstate commerce" that congress is allowed to regulate. Interstate commerce in many items are not regulated at all. Commercial Trucking and gun purchases are examples of "regulated" areas of IC.

Yep, it's part of the CGA of '68. Following the assassination of JFK in 1963 and the back to back assassination of Robert Kennedy and MLK in '68, the government decided to crack down on guns. Prior to that, you could order guns from a catalog and have them shipped to your house.

The state restriction part falls under HOW the government regulated guns. Since the could no fight the 2nd Amendment, they used their interstate commerce laws. To keep track, they decided only licensed dealers could transfer firearms across state lines. The non-licensee could no longer buy them and transport them into their state of residence.

The feds say it is legal to buy a long gun in any state, as long as it is legal for you to own one in both states. Handguns are home state only.

I predict that there will be an awful lot of private gun sales in the states surrounding those that forbid the sale of most weapons to their citizens. These sales may be illegal under Federal law, but since they're not registered anywhere, who's to say who sold what, with which, to whom? Also, who's to say how many "middlemen" were between the gun's first (registered) owner and the person who ended up with it? Impossible to monitor, difficult in the extreme to prosecute...
