Illinois: Constitutional Carry or Carry Restrictions per City?

I was under the belief that Constitutional Carry would become the law of the land in Illinois if the legislature doesn't come up with a plan by June 9th. However, this Senator is stating if they do not come up with a plan it will be carry with restrictions per city and some can be very limited.



What's the correct answer: Constitutional Carry or Carry with restrictions per city?




And this all may become moot if Madigan appeals to SCOTUS and carry in Illinois is stopped.

'Moral character' gone from Ill. Senate gun carry

Raoul's measure got Senate Executive Committee approval Thursday on a party-line vote but was buffeted by criticism because it required applicants to be of "good moral character" and show a "proper reason" for carrying. Raoul dropped the character test with an amendment Friday but the "reason" language remains.

But Raoul said if gun-rights supporters don't negotiate a compromise by June 9, the existing law will be invalidated and cities will start enacting their own - potentially more constricting - rules.

"While concessions have been made, I for my part will not concede anything that compromises public safety," Raoul said. "And if that means going to the end where there's a stalemate and it will be up to local municipalities to enact ordinances ... they'll see a far worse patchwork that they'll have to try to navigate than the compromise that was proposed in my bill."

We are a home rule state. If the deadline comes and there is no state law, any home rule city or county can freely pass whatever restrictions they want. These can each carry jail time up to a year for each violation, and those sentences can be cumulative. I know Chicago, dekalb, and other cities already have bans on carrying of firearms in addition to the soon to be defunct state law.

EACH OF THOSE STANDS UNTIL FOUGHT IN COURT. ANY NEW ORDINANCES RESTRICTING THE CONCEALED CARRY OF WEAPONS WILL STAND UNTIL FOUGHT IN COURT.

The only way those will be eliminated in one sweeping move is if we get a statewide shall issue law passed WITH PREEMPTION.

Otherwise, our northern brothers will be living behind an iron curtain while I could strap a loaded AK47 on my back and ride my motorcycle to work downstate.

So why were pro-gun legislatures saying that if the anti-gunners didn't compromise they would be in trouble? Don't be anti-gunners really have the advantage with home rule here?

Because, all of the restrictive home rule laws can be overturned easier. :)

One of the recent cases cost Chicago a few million bucks in damages and legal fees.
 
Also there are plenty of areas where anti's don't have quite the upper hand they'd like, and won't be able to get restrictions passed. They'd all rather have a super restrictive state wide may issue, without preemption so the individual jurisdictions can pass further restrictions.

Unfortunately for our side it is far easier to pass a non-preemption bill, than a one that does preempt home rule. The need a simple majority in both houses. We need a super majority.
 
I few years ago I told someone that we probably would not have concealed carry legalized in Illinois in my lifetime, and I'm not sure that this is still not the case. I would almost bet that even if we get a "shall issue" law with preemption, that some local municipalities would pass additional restrictions which would be enforced by their police force. A citizen lawfully carrying would face harassment, gun confiscation, and extensive and expensive legal costs to prevail. This all crossed my mind intently yesterday when my wife and I went for a long walk in a large forest preserve near the city we live in. We didn't have any problem, but it occurred to me several times during this 2 hour visit to the forest that should we encounter dangerous critters on 2 or 4 legs, what defense does this almost 70 year old, with compromised joints and heart disease really have? Sure, I carry a small pocket knife with me, and have done so since I was a boy, but that won't do much at all. My guess is that the recent Federal court decision that "almost" gave us concealed carry has raised expectations so much among many Illinois gun supporters that if we don't get it legally there will be more folks carrying anyway, legal or not.
 
Yeah, Trent is the man when it comes to having his finger on the pulse of our wacky Illinois politics regarding CCW. I follow the threads on an Illinois carry specific site. Sometimes I get overwhelmed by the insanity and have to take a break. It is DEFINITELY reminiscent of Lucy pulling the football from Charlie Brown...over, and over, and over......

I am sick of Chicago politics. I want to leave this state in my rear view mirror and I would if it weren't for family being here and my wife's career. I would be fine with municipalities making their own laws except for the fact that the ones wanting the most restrictions are the ones most inept at addressing their high crime rate. I don't visit Chicago much and when I do it's mainly for my daughter's traveling sports teams. She's a heck of an athlete with a promising future much like her mother so it's something we put the time and effort into in hopes that it translates into a college scholarship of her choice. The ONLY time I have feared for our safety was in the Chicago suburbs where a soccer match was going on at the same time as my daughter's volleyball tournament. There were several young men (won't racial profile) there being very belligerent. The police made many appearances but that didn't really make us feel any better because it was bad behavior as usual after the cops left. We kept our heads down, stayed near the exits hoping for the best and left promptly at the events end. I would hate to live up there and feel that way on a daily basis.

I hear you JF. I was actually IN Bloomington this weekend for a soccer tournament for MY daughter, who is on a travel team from the suburbs of Chicago. You gotta' look out for those soccer folks...they're a nutty bunch of people, don't you know? (we almost had a good old-fashioned soccer mom brawl at our last game yesterday) Haha! I'm with you on leaving this corrupt state in my rear-view mirror, as well. I'm here for pretty much the same reasons that you are. Job and family. It would definitely take a while to adjust to living in a free state......I feel that the longer one is HERE, the more "institutionalized" we become.

Countzero does a better job than I do, usually.

This stuff tends to happen while I'm neck deep in programming or network architecture jobs, and don't have time to stick my head up long enough to see if it's day or night-time.

Fortunately the last 2.5 months of 12-14 hour days is slowing down ... I'll be able to get back in the swing again.
