    This accusation only makes us look stupid, unless we know for a fact that Kerry physically transported the gun himself out of the state.

    Kerry was free to take the gun, use it (ie. wave it about at a photo op) while he was in the state if he wanted to (as a loaner), and then have it mailed to an FFL in any state where he was a legal resident, where he could then pick it up.

    That is true, but all we have from either the Republicans or the Democrats in this election has been accusations about the other side.

    The issues have quietly been forgotten, and it has boiled down to who made a bigger ass out of themselves during Viet Nam, and who has broken the most petty laws since then.

    Agreed wholeheartedly !(Tamara once again you are a calm voice of reason.)

    However this did seem to bring up another issue that I believe is actually more interesting. While reading on this I found a reference to a magazine interview in which Kerry states that he owns a "Chinese assult weapon" since his home state has registration and an AWB (IIRC) this quote and a check with public records would show exactly what the situation is legally and in so far as believeability, or rather lack thereof.

    Don't forget that like most in his income bracket, Kerry quite possibly satisfies the residence requirements of more than one state. I think we have muckrakers workin' this angle even as we speak, though. ;)

    I can't escape the notion that firearms expert Korwin is speaking a bit sarcastically. I agree that Kerry should be treated with the same leniency any of us can expect from the BATFE ... which means he should already have been arrested, chanrged, and undergone a preliminary hearing to set bail. Being an international figure with sufficient resources to go anywhere, his passport should have been surrendered.

    That's what would happen to any "ordinary" citizen.

    Exactly how many people has the BATFE popped for something this petty? Do you think an agent is going to waste their time on this? The answer is no, call one up and ask.

    For all the berating that befalls the BATFE, few individuals who are otherwise law-abiding get themselves arrested. It is always some friend's second cousin who knew a guy whose sister..........

    First, Kerry never physically transports anything. He has people who carry his luggage, papers, bicycles, etc. So someone else would transport the gun.

    Second, this sure doesn't seem like any kind of crime. This means that if my brother visits from out-of-state, and I give him a "legal-everywhere" rifle, like a M1 Garand or Remington 40-X .22 bolt gun, he can't legally toss it in the trunk and drive home with it? We would have to visit a FFL and he'd have to fill out the yellow fed form? That's pretty stupid.

    And if Winchester presented president GWB (or GHWB, or even Clinton) an engraved model 1895, they'd have to first fill out a form and run a NICS check on his background?

    I didn't know federal laws were that strict on long guns.

    So Tamara, I don't think this makes us look stupid. But it shows that many of us are uninformed or unaware of the fine points of firearms transfers.

    in 1935, 'few' people were prosecuted for illegal machinegun ownership too...

    We need FACTS on this people, not more conjecture.

    So, what, he should be convicted of the same felony I would? Hypothetical nonsence UNTILL we see some evidence. OF course, should evidence be presented, this could turn into a real ????-storm.

    I predict we will see a press release claiming that Kerry was 'loaned' the shotgun, and that it was subsequently returned to it's lawfully owner, all on the up-and-up...

    (except that whole part about misleading the public...)

    What you want to bet the whole thing is burried untill after Nov?

    You'd better belive it's exactly as serious as indicated, a FELONY. Not just a crime mind you. We're talking losing your right to vote, to ever own any guns, and a jail sentence.
