Judge overrules ATF, restores gun license

When a post about a security guard shining his flashlight into someone's face is immediately followed by:-15 people calling for the abolition of the ATF -5 people saying the police are worthless and no knock warrants are unconstitutional -3 people calling for a full blown revolution and the overthrow of our government, you're on The High Road.

When I see this I have to ask myself? Why is this person on probably the best Gun Guys site on the INTERNET?

And only been a member for a very short while.

And of course not on Email?

I have shot with ATF members, good guys, shot well too, not too many people warmed to them though.
 
For those that wonder about the BATFE and where it came from I'd suggest they get hold of a copy of Unintended Consequences by John Ross. It is just a little bit of an eye opener about a good many things that have gone on in this country.
Far from an eye opener, it's more like putting blinders on since there are many things about the ATF in that book that are outright false. Number one example is Ross' false description of the events surrounding the Kenyon Ballew warrant. Another great one is his repeated claim that merely talking about a federal crime is enough to sustain a conspiracy charge. The truth, which Ross ignores, is that a criminal conspiracy charge requires an overt act in furtherance of the conspiracy.
 
One recent event you forgot to talk about in detail Maelstrom was the topic of this thread.

ATF recommended FFL's be revoked for bookkeeping errors that the Court held were (1) unintentional and (2) were reasonably trying to be procedurally corrected by the FFL's.

That tells us that sometimes the ATF gets overzealous in their mission.

Overzealousness can occur anytime, it has nothing to do with past specific documented governmental abuses that you cited in your examples (i.e., in an attempt to discount and riducule members' concerns).

It is this overzealousness that has many people worried about the ATF IMHO.

I've personnally have had no problems with the ATF because I'm not an FFL holder, etc., but there are many stories out there where they do appear to be overzealous on too many occasions IMHO.

True, but the charged defendant doesn't have to be the one who makes the overt act. A co-conspirator can make the overt act unknown to the charged defendant. A person can leave the conspiracy before the overt act but those are murky waters in which to be swimming.
