Hello Group,
I have a NYS Pistol Permit which allows me to carry concealed anywhere in NYS where permissible by law.....except for New York City. So here is my question, since I have been issued a concealed and carry pistol permit by the licensing officer in my county, the process is based totally on New York State Penal Law, which is good throughout the state can I carry in a mall that has a policy that reads:

"No Weapons Allowed
The possession of any weapon, unless authorized by local, state, or federal statute, is prohibited."

I would assume I can carry in this particular mall because I am authorized by a state statute.

Thoughts?????

Thanks,

Delta

Yes, because you are authorized by state law (your unrestricted pistol permit) to carry a pistol in NYS. You can carry in the mall.

I agree with PY. You are obviously authorized under state law.
The wording of that policy almost feels like a *wink* *wink* to CCW holders.

IANAL, but since you have a lawful permit, it sounds like you'd be good to go!

Why the heck can't EVERY place "post" like that, if they just HAVE to "post?"

Your license is your authorization, as long as you aren't violating state law, here in FL it's a city state, or federal building, school, sporting event, and an establishment in which the part that you are bieng served is not primarily the Bar area, also banks.Stores malls and the like are ok. When we put a sign on our Gym years ago, we were told that it was unenforcable, so we removed it, I had a partner who didn't like guns, which was stupid since half the guys in there were with the Sherriffs office, da. Win Dixie also had a no firearms sign, on thier stores, which they had to remove.

That's one thing I like about NY, if you can get a permit, they are good everywhere except schools and courthouses. Plus the permit is good for life. Schools are actually okay if you can get permission from the school administrator, by law. Also, no permission is needed if you are dropping off or picking up a student.

Courthouses are totally off-limits, although I had a knife with me once entering a courthouse and they just held it for me while I was inside. I don't know what they would do if I walked up to the metal detector packing. . . I have no plans to find out though.

"...unless authorized by local, state, or federal statute, is prohibited..." That should cover you.
"...except schools and courthouses..." And anywhere else prohibited by Federal or State law. This having to comply with two levels of law must make ya'll crazy. Up here, there's one law for the whole country. Mind you, the twits that enacted it allowed the application to be different by Province.

Does NY not have something in the law stating that a property owner can prohibit firearms on their property? That's how Alabama gets around this issue

Grizz,

I have just sent a letter to the atty. general of NYS asking that same question, I will report back if I get an answer.
