Apparently a young man in Speedway, Indiana (westside of Indianapolis, where the Indy500 is located) shot a shotgun-wielding robber who assaulted him in an apartment complex. The robber was allegedly accompained by an accomplice who was not shot.

The initial reports have it as blackletter self-defense. The robber must have recently relocated to Indianapolis as the westside of Indy is one of the most heavily armed places in the world.

Got to love the comments on self-defense! This is why they call it the "Whose Ear" State.

Washington's criminal history includes arrests for sexual battery, auto theft, criminal recklessness, battery with a deadly weapon and dealing cocaine.

Well looks like this time we won't be needing the courts.

As an aside, the surviving perp will be charged with felony murder. While he wasn't the gunman, he was a participant in a crime where a homicide occurred. Nice wrap up to his apprehension!

FWIW,

Interesting stuff, El-T! I had thought from the various stories foisted upon us by the news-twisters that this was already a done deal. If Brizzi is squishy on this, that's pretty disappointing....... :scrutiny:

Is this purely a matter of limited staff, or is something else going on? I would hate to think that he has some things in common with the Hamilton County prosecutor. From what I was told by an investigator that I know, when the Allemenos murders went down, she couldn't bring herself to handle the case, and turned it over to one of the deputy prosecutors in her office. None of the three responsible for those killings received a death sentence. :fire: I couldn't see someone like Steve Newman doing that.

Thanks,

emc, staffing? Good grief, no. They already have deputies on top of each other at the City County Building. My office at Tippecanoe County was palatial compared to their digs.:D

No staffing concerns, but concerns with the reality of the jury pool. Sometimes juries just don't like felony murder (or really small thefts, or death penalty or LWOP, inter alia). So, they do not always push it. Brizzi's call, we shall see what happens.

Robbery seems far more certain.

"At the end of the day, the law says if you have no other out and it appears you are about to get killed or seriously harmed, you don't have to send out a survey," said Scott Newman, the former Marion County prosecutor. "You can pull out a gun and defend yourself."
Nice contract to the quotes we often see. Glad we don't have pass a "global test" before defending ourselves.

Just last month, Indiana became the third state to make clear that people have the right to use deadly force when threatened without first trying to back away. Indiana did not previously require residents to retreat before using a gun or other deadly weapon, but the new law clarified that point.
Again, another clear, accurate and un-hyped statement. Didn't even call it the "Shoot First Law."

Brizzi won't contest this one. Young thug was wearing a mask and packing a shotgun.

Too bad a kid had to die as a result of his bad choices. Hopefully, the other kid can get his life straightened out, but the odds of that are not too good.

Givens, 21, died from a single gunshot to the chest. Washington, 19, who wasn't even carrying a gun, now faces the possibility of going to prison for his actions.
Actually, he is facing a felony murder conviction.
Givens told Washington that robbing Morrison was an "easy lick."
And now Givens is licking the other side of the grass.
