MN to NY state move, CCW questions

Hi everyone,

I'm about to make my move from Anoka County, Minnesota to Cayuga County, New York. I've just completed my concealed carry course here in MN and can/will submit my application and payment tomorrow. However, I'm moving to NY at the end of the month, so I have some questions you might be able to help with:

1. I know I have to inform Anoka County's Sherriff of my move. Will they then issue me a non-resident permit? Normally I suppose I'd apply using my NY address, but I'm not sure what that's going to be just yet. Also, I'll be going back to MN regularly (all of my family is here), so I figure I should have an MN permit.

2. New York requires a permit to own a pistol. Can I obtain this before moving so I don't have to ship my handguns through an FFL and/or wait forever to get them?

3. Do I need any certification (like we do in MN) to get my New York State concealed carry permit?

4. Anything else you can think of?

I lived in NYC for last 2.5 years, and am looking to move the hell out of NYC, NY State, and the entire northern east coast! Your freedoms and liberties will be raped here by comunists masking as progresiv liberal thinkers who *think* they know what's better for you and will enslave you *for your own good and protection*. It took being brought up in comunist Poland, and nine years (2 of them as US citizen) living in this country to trully understand what it means to be free. And let me tell you, NY ain't the place.

I agree with mvorbrodt...don't move.:eek: If you're willing to jump through the hoops then more power to you. Just one more year and I'm outta here...:)
 
Well I'm locked in for at least a year. I've heard from members on this forum that Cayuga county is reasonable with its firearms policy, though I could wind up in Tompkins county which is supposedly very unreasonable.

Those hoops do sound awful and awfully un-American. I hope my Minnesota permits to purchase and carry give me some advantage. I'm no criminal; I'm an educated, productive, law-abiding American citizen and went through the appropriate processes in my home state. Surely there must be some decency out in New York.
 
Going from a state that allows you to carry to one that won't is bad idea in my book. :banghead:

You can carry as many guns as you what here in Minnesota in more places than most states. Why move?
 
Pick Cayuga County

Get to Cayuga County if at all possible. Tompkins County will restrict your carry permit to target and hunting, Seneca County is also resonable. In Tompkins, to buy a handgun after all you go through to get your permit, you must purchase the gun and bring the recipt to the Sheriff's office, they will fill out a request for a purchace voucher, send it to the judge, judge signs off on it and sends back to the Sheriff, the Sheriff then can add it to your permit and give you the voucher to go pick up the gun. All this takes roughly two weeks and thats if everything goes right. I belive that Seneca and Cayuga still give out vouchers without all of the crap you go through in Tompkins. Hope this helps.

First and foremost, are you legally changing residence and becoming a resident of the State of New York?

I'm neither a lawyer nor an accountant, but I'm given to understand the issue of "legal residence" and one's domicile state does not necessarily reflect the state wherein one lays one's head upon a pillow each night. I've worked with folks over the years who maintained a legal residence in State X but were working in State Y. Some had an apartment or rental house in State Y and others stayed in a long term motel.

Once that's decided, I'd call the Anoka County Sheriff's Office, tell 'em your situation, and ask what your options are. Should you apply using your Minnesota address, because that is your correct address today, and notify them you have moved when you move? Or do they recommend you wait and apply using your New York address? Will they mail your license to you in New York? Will they mail it to your Minnesota address and with a USPS forwarding will it arrive in New York? Sometimes official gumint stuff is marked on the envelope "Do Not Forward".

Does not seem to be any big deal having a New York Driver's License with your New York address on it and a Minnesota CCW with your old Minnesota address on it. See question #29. However, as you stated you do have to notify them.

New York Permits

Upstate NY is not as bad as NYC so do not despair. Here are the basic rules-
1. You must be a NY resident for at least 2 years
2. You must have 4 references from the county of residence that have known
you at least 2 years, have them sign and have signatures notarized..
3. You must pay all fees - $100 to $120.00
4. You must be printed and photoed
5. You must state the reason for carrying.
6. You get to wait between 4 and 6 months.

The good news is that once you get it, the permit is good for life and you can carry concealed anywhere in the state except NYC and Nassau county. Getting the second gun is much easier.
1. Buy gun and get bill of sale
2, Take to County Sheriff's office and pay 5 to 10.
3. In a week to 10 days, your purchase coupon is mailed back to you.
4. Take purchase coupon to dealer and pick up gun.

I am a Cayuga County resident, also in the City of Auburn.

NYS is not as bad as NYC, but it is true that things are not very easy. If you move into the city limits of Auburn, you will need to apply with the Auburn PD, otherwise you can apply with the County Sheriff. Some things that will be stumbling blocks for you as a new resident of the state:
  • Minimum residency time: Some people have quoted two years? I am not sure about that, I don't remember it being listed on my application, but it wouldn't surprise me.
  • You will need 4 references who:
    • are residents of cayuga county
    • are not related to you
    • are not related to each other
    • don't live in the same household as you or each other
    • have known you for "a reasonable amount of time" (I quote because those are the exact words, it's tricky because "reasonable" is up for interpretation).
    I have lived in this county for 15 years and even I had trouble with this (I am related to two LEOs, and good friends with a police chief and a fire chief who both live in Onondaga County), I went with 4 co-workers.
    If you apply with APD, they WILL mail questionaires to all of your references, which must be filled out and returned. The questionaires include the question "how long have you known the applicant", this is where the "reasonable" interpretation comes in. It may be that every jurisdiction in the state does this, but APD is my only personal experience.
  • Waiting: I am one week shy of 3 months waiting on the happy-gram to come in the mail. I'm not getting my hopes up yet.

I think you are going to love Cayuga County coming from Minnesota. I lived in Eagan for a summer and liked it very much, not too different from home. We are a touch more rural though. Then again, Eagan is basically a suburb of St. Paul. We have great hunting and fishing around here. We can hook up and go shooting sometime too if you want.

Your efforts in MN have no bearing in NYS. They recognise no other CCW, I have been told by LEO in NYS that my GA CCW permit was just a peice of paper.

Surely there must be some decency out in New York.

I pity you for the circumstances that force you to move to that god forsaken hell hole.

BTW, remember to leave your AK, AR, and any other "assault weapon" that the good folks of NYS have determined that you shouldn't own.

Any state that, when I call the State Attorneys General office and declare my intentions of visiting their state armed, says "come on down, rangermonroe, Glad to have you and your pistol!", is someplace I wouldn't mind living.

Florida is one of those places.

Orlando is an OK place, I have a ranger buddy that lives about 45 min from there.

He is a member of a hunt club that has its own shooting range on site. They hunt hogs there. Funniest thing I did recently, eating wild oranges while hunting.
 
I moved from Bel Air/Abingdon, MD to Cayuga County, NY and now reside in Cortland County, NY.

I'd be happy to answer any questions as I went through the process about three years ago. The Judges in Cayuga County will take out of County (but not out of State) references if you write them a letter and request a hearing to discuss the matter with them. I know because I did it. Two of my references were NY LEOs so that helped.

Of the counties around the Metro Syracuse area, Cayuga, Cortland, and Oswego are the only ones that issue non-restricted permits. If you go to Tompkins or Onondaga expect to only get a premises or range/hunting permit.

I agree that NY is just California Jr.

But honestly I have had very positive experiences with gun ownership in this state. My permit was a process:rolleyes: I live in Ontario county and work in Seneca....so getting references was a pain...the investigation was very "complete" but the investigating officer was very PRO 2A and even gave me pointers for proper self defense with a firearm. This was in Ontario County.

Price of admission is high but once you have a NYS permit it is a fairly liberal CCW state. No carry in courts, schools or federal bldgs but thats about it for restrictions. We don't have stores with no CCW signs or any of that crap.

Concealed is concealed, I have been pulled over while carrying and it has never been an issue. I think because the LEO's know that the permit process is tough they seem to understand that a CCW'er is very likely a "good guy"

It's all about the county judge that reviews the application. I'm sure if your in a PRO CCW county (Cayuga, Seneca, Ontario even Monroe) you can get it done.

Everyone must remember, NYS and NYC are polar opposites when it comes to pretty much everything. If you looked at JUST upstate NY you would see a state almost as Red as Texas, it's just that an equal number of people live in NYC which is as BLUE as it can get.

We upstaters would just as soon drop NYC into the Atlantic, but we don't want to pollute the ocean.

You can only have a couple a year or suffer heart failure but they are GOOD!
 
I am originally from Saratoga. Learned to Scuba dive in Lake George, and shot a lot of deer in Salem.

Oh, yeah, lest I forget...Got arrested in the Albany airport for "possession" of a handgun.

There are wonderful sites and activities in NYS.

As, I am sure, there are in China, North Korea, California, Russia, Yugoslavia, Iraq, Iran and whatever other hell hole you can think of.

NYS is as bad as any other socialist/totalitarian dictatorship.
 
Just Curious......how did someone discover you were carrying at the airport?

I am assuming that you were just driving someone too or from?

I've never carried at the airport.....not sure how that would be interpreted? It's not specifically banned by NYS law....some Federal thing?
 
Ok I checked on the list of national off limits and I check the NYS law....no mention of CCW being prohibited at the airport.

Obviously, once you try and pass security it's an issue. :what:

Do any NYSers carry on the non-secure side of the airport? I am often dropping off/ picking up friends and I am curious. I never carried because of the security issues since 9/11, just didn't seem like a good idea.

How about other states?
 
This is off-topic, but it's very possible to get mugged on your way into / out of an airport. I always carry when picking up or dropping off visitors at the airport in Houston, perfectly legal here.
 
Rangermonroe's dramatic generalizations aside, Upstate NY is indeed a beautiful place and far from the police state suggested. Obtaining a concealed carry permit is required and varies in difficulty depending on the county.

NY is a "may issue" state, which generally means that it's ultimately up to the judge to determine if you get a permit, and if you do, what restrictions he imposes. "hunting and target shooting only" are common ones. You will have to show "need" for an unrestricted permit. I'm not justifying that, it's just the way it is right now. "I routinely carry payroll" is good, "It's my God given right and you can't take it away" is generally unsuccessful.

Assuming that you haven't say, been arrested for illegal possession of a handgun, and have a clean arrest record. There should be no red flags. Fill out the forms, pay the money, give references and wait about 6 months. Mine took a total of 8 months in Niagara County. They didn't like the quality of the fingerprints.

On the plus side, now that I have it, there is no waiting for handguns. Buy it, take it with you, get it listed on your permit within 10 days and done.

I believe that you only have to be a resident for 6 months before you can get a permit. (We've have some discussion on whether this means 6 months before you can apply or 6 months before you can actually recieve it).

You can apply either in the county you will live it, or the county you will work in (which assumes you'll spend most of you time in that county). So if you'll work in one county and live in another, you might want to find out which one is more pro-gun.

While NYS passed state laws to match the Federal Gun Ban, and have some restrictions on "assault weapons", you can still own AKs and ARs etc.

Exact procedures, costs, and waiting times vary greatly between counties. I've seen people get their CCW in a matter of weeks, and in over a year. Some counties want you to have some training before get a pemit, most do not require it.

Most counties have websites so that you can find out what you need to do. I'd suggest that one way or another for find out for sure what that county requires from the sheriff's office. Each county seems to interpret state law different, so even if you "know" the law, you may find that they not follow it exactly.

I think you'll find that NYS isn't that bad, but I expect you will have some problems in the beginning, and that going back and forth between NY and MN will cause you some frustration.

Checked in bags at counter of airport. Declared firearms at counter as per FAA regs. TSA agent says wait right here while I get sherrif. Lets see your CCW permit...GA doen't count, need a NYS ccw.

Bye by pistol, $1500 in lawyer bills, DA drops misdemeanor illeagle possession charge to "disorderly conduct".

Now I have a record.

Did I mention that I hate Ny?

I think my pie-in-the-sky option would be to get a hearing with a judge and argue that my prior training in MN, permit to carry from MN, and the fact that I carry confidential corporate documents on my laptop are sufficient reason to grant me an unrestricted permit in New York state.

I was in Cayuga county last week and found it much more likeable than Tompkins county/Ithaca. It's very much like rural/semi-rural Minnesota and I should have little trouble getting along and enjoying my time there. Admittedly though, as a distant Minneapolis suburbanite I think not having the amenities of Minneapolis/St. Paul could get to be a bit grinding. :)
