Moving from New Mexico to CA...need help

Hey all...My friend is moving back to CA from New Mexico in a few weeks, and was wondering what would happen if he purchased products that were legally sold in New Mexico (but not in CA) and brought them here for me? I remember reading somewhere that it is legal to buy certain things from private parties that would otherwise be illegal to purchase at a store...Are there any aspects worth considering here?
 
Assuming he did something foolish like buy a couple AR-15s and 30rd mags and brought them into CA and sold them to you... then you'd both be felons.

(a)(1) Any person who, within this state, manufactures or causes to be manufactured, distributes, transports, or imports into the state, keeps for sale, or offers or exposes for sale, or who gives or lends any assault weapon or any .50 BMG rifle, except as provided by this chapter, is guilty of a felony, and upon conviction shall be punished by imprisonment in the state prison for four, six, or eight years.
 
He and you may as well forget having anything fun as guns go in the Republik Of California. I moved out of there because the gun laws got too strict for me to do my business, and the only ones with guns with a cap of more than ten or a CCW in Kali are celebrities, or politicians. The same ones who ell you you have no right to keep and bear arms.
 
IMO it depends on what it is... it depends on whether it can be shown that his purchases were clearly made to circumvent CA law... it depends on whether either of you get caught...

if something is illegal in CA it is illegal to have it in CA regardless of where it was purchased... unless maybe it was purchased prior to the ban in CA...

if it is a black or white thing I wouldn't do it... but if it was a grey area maybe...
 
No no no.. you cannot bring banned AWs into this state. It doesnt matter if it's legal in your home state. Doesnt matter if you owned it prior to CA's ban. Non-resident Military members can get a permit, but that's about it.. even then, they have to remove the gun from the state as soon as they leave active duty.

Now.. your friend can import handguns that arent on the CA safe pistol roster. If I were you, I'd tell him to stock up on anything he wants before he gets here. Once he's a resident, he wont even be able to order them.

Once again, DO NOT import banned Assault Weapons, .50BMG rifles, or normal capacity magazines into CA.
 
It all depends on the item for correct explaination. As well as intent. If you are talking about any magazine over 10 rounds, any rifle under 30 inches, or anything that has CA defined 'assault features or is banned by name on the assault list then it is highly illegal.
If you are talking about pistols that are otherwise legal according to CA to possess, but are not on the CA approved pistol list then it is illegal based on intent. However if he were to buy pistols somewhere there and then move to CA and decide he no longer wanted them he could legaly sell them if they are of legal capacity and otherwise not some assault pistol or banned by name.
However him buying them with the intent to sell in CA is specificly against the law. So it really is about intent.
 
Oh i see...So pretty much, I shouldn't ask him to purchase anything at all then...I just remember seeing members asking other members if they wanted anything from another state because they will be coming to CA soon...It gave me the impression that there might be some benefit of having a friend drive home to CA from out of state..Thanks all!
 
Well, he can puchase some off-list handguns and bring them in, as long as they are not otherwise assault weapons.
 
Let's keep it simple and organized.

Do not bring in assault weapons or hicap magazines.

Remember, a semiauto centerfire rifle w/flash hider is an AW. A semiauto centerfire pistol with a threaded barrel is an AW. Make appropriate modifications to these before you bring them into CA - M1As and Mini14s can have muzzle brakes or bare muzzles instead; guns like HK USP Tacticals can have threaded barrels replaced.

Folks moving into CA with handguns are called 'personal handgun importers' and have 60 days to register their handguns with Calif. DOJ ($19 per gun). The form is available on the Calif. DOJ Firearms Division website and can be Googled.

Even though you can't bring in hicap magazines, you can bring in guns that take them - Glocks, Sigs, HKs, Berettas, etc. are all fine.

You can indeed bring in handguns that are not on Calif's "approved list" of "safe handguns". Should you decide to, you can even sell them later (once you get CA ID) to another Californian via "private party transfer" - but you cannot sell them to a gunshop for them to sell inside CA to another person, since that's a regular sale and not a private-party transfer ("PPT").

And my guess is that if anyone transferred an abnormally large number of handguns in this way, it would raise a flag at the DOJ. Somehow I think they would take a dim view of such "trafficking."
