im sorry for your familys loss, i never could understand how any one could hurt a child! i have 4 daughters and 3 grandkids , all i can say is hell aint hot enough for this basterd!!! but he will burn there!!!!!!!!!!!!!!!!!!*csa*

I've recent seen ran across a story which is a product of the sad state of affairs that exists in Charlotte--of justice denied on a systematic basis. I'm taking the time out of my busy day to ask you to provide funding for the DA's office. To essentially abandon cases like these should be High Crime unto itself. I will remember this story always when I think of the city of Charlotte.

How any one of you can sleep at night, basking in the dim glow of a brand new NASCAR museum (isn't NASCAR privately owned??) is beyond me.

Again, please provide the needed funding to the DA's office to enable them to do their job. To not do so is a travesty and dereliction of justice.

I am Caleb's mommy. Waitone's daughter. I'd like to thank you all for your support. Your letters and emails are greatly appreciated. The "justice" system in Charlotte decided that they don't want to listen to me, but maybe they will listen to each of you. Thank you for each and every letter you may write.

Several people have made comments on how calm waitone is. Don't worry. Matthew Peter Cotton is mine.

As for this comment...
Love them all dearly but I think murder is too strong of a word considering they have no evidence. From what I read in your post all they may have is a scapegpoat and a coerced guilty plea.

There's all sorts of ways a kid can suffocate that are not due to the evil intent of others. Almost ended up that way a few times myself growing up.
Had you read the original thread carefully, you would know that the defense attorney came to the prosecutor with the plea bargain. In this county, ANY plea the defendant is willing to make is accepted. There is more than enough evidence to convict this man...they simply don't have the time or money to go to trial. Yes, unfortunately there are ways for small children to suffocate accidentally. The difference is that those ways do not include broken jaws and bruises head to toe. There is no scapegoat in this case...and there was no coercion. Matthew Cotton found an opportunity to get away with murder...and he took it.
 
What I would do I can't say here for various reasons, but he would see justice plea bargin or not.

Prison isn't friendly for those who kill children, at least the next two years of his life will be about as close to hell as one can in an American prison.

But this is sad, that America has gone this far in ass backwardness is sad as well. You get more time then that for not paying your taxes or getting caught with a joint. Judges need to remember that the terms of a plea bargin are a suggestion and they can choose to go by them or to throw them out and give the sentance deserved.
 
The sad truth of the matter is, given time served, he'll be out in a year and a half. He'll likely request and be granted PC which means that he'll survive. There is no justice except what we can mete out and whatever God there is delivers. These days, I don't have a whole lot of faith in God.

I didn't know what to say when I frist read this post this morning, and I still don't know what to say except I so very sorry for your loss and that I hope you find Peace and Justice in due time, and that you're in my prayers.
 
I could not post at the time I read this but a few hours have now passed.
Being a member of THR I should not post an emotional reaction but even
my intellect screams the same recourse. It is a true shame that the legal
system has nothing to do with justice.

Caleb's mommy, Waitone, I can't even imagine what such a horrific tragedy
must be doing to you both. I have no children of my own but 2 nephews
and a niece I adore and I know anything I can think of currently would pale
in comparison to the feelings if I or anyone here would experience such a loss
in such a manner.

You have my deepest and most sincere condolences. I hope you both can
someday find peace and relief from your grief. Don't let it consume you,
matthew cotton has already taken so much from you. In one form or another,
this world or the next, justice will be served.

Waitone, that one of the most vile, disgusting and purely evil examples of a complete violation of public trust.

Indeed it is. Waitone, and Caleb's mommy, I am truly sorry for your loss...even though I don't have kids, I do have two little nephews about Caleb's age, and I can't imagine what I'd do if anything like that ever happened to them...just speechless over here...

Likely untrue but -- even if it is -- it remains a "sound" decision if conviction is sketchy. (And is practice throughout the legal community.)

There is more than enough evidence to convict this man...they simply don't have the time or money to go to trial.

These two do not necessarily follow. Even if they do, convict this man of what? "Manslaughter?" That's what just happened. Is it the conviction or the sentence that is outrageous?

The difference is that those ways do not include broken jaws and bruises head to toe.

One would certainly hope not. Of course, a DA would require a pattern of such to substantiate an in situ murder conviction without a witness...

And I am certainly not looking for one. I know that I am overtly emotional, and all I have done is read, but there is usually much more involved then face value.

There is a reason a plea was offered and accepted, and "no time or $$$" is not a public relations risk any county DA would take if they believed in a potential conviction. (Further, as reciprocal, there are HUGE ad hoc rewards for actually convicting murderers.) If they thought they could get him for murder, they would.

Matthew Cotton found an opportunity to get away with murder...and he took it.

Possibly. But, if such is true, it is not the DA's fault.

I agree with you , and for this reason I drove to Raleigh a few weeks ago to meet with our legislative delegation to request an additional $5million for our courts. Please be sure to write the Raleigh reps as well (Clodfelter, Carney, Gulley, Rhodes, Earle, Saunders, Pittenger, Dannelly) to remind them of this urgent need. We have put several million dollars of County money into our budget next year, supporting DWI court, drug court, the DA's office, domestic violence services, and the expense of operating a new courthouse, but this will still not be enough to meet the needs. We also need more state money.

Words are inadequate to express the how I am pained for you. As a father I can't even cope with the thought of what you are going through.

I am truly sorry to know that such horrible acts happen. I pray that you and your family heal from this tragic loss.

Justice will be done. Perhaps in this life, perhaps not...but it will be done. It always is.
 
The text file I originally attached to post #1 contained names, emails, and phone numbers. I posted for both County commission and city council. At the very end of the document I posted info on the Big DA and a little DA.

A plea bargain is not Constitutional. That is why this fiend will go free

I am so sorry about your loss, and so sorry for our nation, that an evil animal like this killer lives on, while your prescious Grandson is no longer with you on this earth.

Chil Killers and other dangerous criminals are allowed such ridiculously lenient punishments due to our so called "justice system" fabricating non-existent rights.

After thinking a long time on this, I realized something about our "justice system" and the way it has twisted our Bill of Rights' VI Amendment.

The Bill of Rights' VI Amendment says:

"In all criminal prosecutions, THE ACCUSED SHALL ENJOY THE RIGHT TO A SPEEDY AND PUBLIC TRIAL, BY AN IMPARTIAL JURY of the State and district wherin the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defence."

While it guarantees a speedy and public trial, it also dictates that it be IN PUBLIC, and BY JURY. Nowhere does it imply, nor do I believe it ever was intended to imply that an "in chambers plea bargain" reached by government employees (a D.A. or a Judge) be allowed to decide if the accused gets away with a murder.

It doesn't say: "The Accused has the choice to be judged only by a single government employee" who happens to be either an elected District Attorney offering a plea bargain.

It does say that a JURY TRIAL, IN PUBLIC was to be held. The Accused has rights, but also does our society in such an issues. The Founders intended that a Jury not only was to be finders of fact, but in addition, (when or if a jury suspected a Judge to be partial or impartial) they intended the Jury to be able to over-ride a Judge's decision if they thought a law was unjust, or the Judge partial in any way.

Wwe are supposed to be a "Government of the People, By the People, and For the People. We have ceded our most important rights to a small collection of "professional jurists" by allowing our VI Amendment to be made into something by them that was never intended. The plea bargain, or "in chambers" decision, is in direct opposition to the entire idea of checks and balances in Government.

It is sinful that our nation has arrived at such a new low, that an innocent child's life can be taken without punishment, due to sole decisions made by government employees acting mainly for the benefit of their offices.

It is so very very sad you lost your Grandson. May God comfort and be with you, during this time of tremendous and terrible loss.
 
Lack of evidence my ..... You don't charge capitol murder and extradite from the opposite coast if you have no evidence :fire: .Someone, probably the PD and/or sheriff's dept has a lot of money tied up in the case already. I can't believe that the judge signed off on this.

Waitone you and Caleb's Mommy and your extended family have my deepest sympathy.

I have posted about our underfunded courts many times before. But I have never heard of a miscarriage of justice like this one. I am angered almost beyond words.

Viewed this thread last night and could not decide what to write. The criminal justice system across the whole country is close to or already a shambles. I noticed a newspaper article yesterday which highlighted the sale of public assets to raise funds etc for local authorities. It can only get worse I fear.

Along with sincere sympathy, I can only offer this; that justice is always done - one way or another. Sooner or later.

My deepest sympathy. I've seen miscarriages of justice as bad except for the age of the victim. The fact that it's happened before and in other places doesn't make it better. It makes it worse.
 
Those of you thumping your chests might consider that you're doing Waitone and Caleb's Mommy no favors. If anything happens to the murderer, all that talk will do is cast suspicion on these two whether there's any evidence that they did anything to him or not. I understand that this fills the eyes with tears and the heart with murder, but do you want to help Waitone's family or hurt? Just think twice and post once--and remember that PM's and email are still written records of everything you say.

He still has to get through two years in prison. Have the patience to wait and see what develops. If he gets out of prison and wants his "second chance," then we can talk about how terrible it is that he gets to be alive.

Of course, the people who refuse to pay to try the murderers of children are NOT going to prison and no patience need be exercised in shaming them. That local bureaucrat's message makes sense, though--if NC funds these things through the state legislature, then we should be outing and spotlighting state legislators too. They're the ones with the purse strings.

I have to admit that I'm curious too. Is there anything you could do in that county that would result in guaranteed trial? Is there any crime they won't plead out? Hard to imagine what it might be right now.
