My house was broken into..........

So I was at work for a few days and the last night(firefighter had an over time shift for 72 hours total) my wife had gone to stay at her mothers for the same amount of time and came home to find the back door smashed open and the kitchen vandalized. It was 11:30 pm so she called the police they cleared the house and then she called me while the police were still there. She tells me what happened then asked if I had any guns out of the safe. I said no and explained if the safe was still there and the key was still in the hiding place the guns were fine and I would check them to be sure. But of cores she had already given the key to an officer and put him on the phone with me.:cuss::banghead::what::mad: I explain to the officer that guns are fine and no need to check, his responce-
well I am already here might as well check any way just to be sure after all your not hiding any illegal weapons right Mr. F?
OH boy was I p.o.'ed now!!!!!

So with out permission he opens my safe first word as I am saying not to open the safe is OMG you have a tun of ammo here! He runs through my whole inventory over the phone and then says anything missing?

My responce yeah the law suit! I called the police dept from work and asked for a supervisor and got the run around too something like well for the safety of the comunity we needed to be sure. OH for the love of PETE! I can hear random gun fire on any given night in my town why not just listen to me.

Got no satisfaction from the officer all the way to my city councilman. Wife got a real blast when I got home too! Only to find out the officer had seen my safe and demanded she open it just in the interest of safety.

Totaly upset with every one and no where to go on this now!
 
Man that sucks big time. I can't beleive the cops ordered your wife to open the safe.:banghead: Jerks. Why can't you file a law suit against the police dept? They didn't need to go into your safe in the first place. What a bunch of crap. I am so sorry this happened to you.
 
If the safe was not forced open I would have refused to open it. If the officer insisted, I would have told him to place me under arrest or get a warrant, and my lawyer is going to have FUN with you.
 
Damages are nominal at best.

Ask the Watch Commander for a meeting with the Chief of Police. If you get no response, write your Councilor and the Chief asking for a ten minute meeting to explain your grievance.

But I can predict what you will hear: the officer, invited into your home to investigate a burglary complaint, asked your wife if he could search the safe, explaining that he wanted to do that and felt it was prudent, and that your wife consented. End of story.
 
I am uncertian if I can or can not file a law suit, I asked a xpolice officer I work with and he said they have the right to investigate/search for anything if they have reasonable cause to suspect a threat or the possibility of a law violation. In my case he said they were looking at a safety issue as "wrong" as it is he said they can do it. I think I am going to call the familt lawyer tomorrow and see what the deal is. I might not be able to do anything.

yeah a tun of ammo for me was only 2k pistol 50 or less shotgun and 2-3 hunderd rifle go figure.........

So what did they cite specifically as a threat or possibility of law violation? You should seriously fight this. This website http://home.comcast.net/~dsmjd/tux/dsmjd/law/lawr_list.htm shows a list of "Pro-Gun attorneys" organized by state. Not sure what the quality may be, but maybe one of these will work for you. If a pro-gun guy won't do, look for someone who works a lot of constitutional rights cases. I can't imagine the local PD would want word to get out that they break into a fireman's personal property "just to make sure he's not breaking the law".
 
I dont think his premis was "I was breaking the law" it was atleast according to the Sgt I spoke to, "just making sure the guns wernt stolen" after all stolen guns are a threat to the comunity. Even as I read here I am emailing the VCDL
 
Hind sight is 20/20, don't be to upset with your wife. She was just trying to do what she thought was right & the cops probably intimidated her.

I can't imagine how the officer had the right to open your safe after you told him NOT TO!

You will get no where in the system.

All you can do now is hide the key where only you know where it is, and put the spare key in the bank safe deposit box. That should remain sealed to death do you part, and then no one but you can open the safe.

End of one problem. The next is yer most delitefull wife who evidently likes a man in a uniform. I ain't gonna tell ya what to do with her. She's your problem.

She invited the cops to look in your bee's wax, and if i were you I would get a new lock on that safe.

Your security has been compromised.
 
Don't worrk about the Police. DO worry about the guys who now know you have a safe. Them, or thire friends, WILL BE BACK.

Get alarm, and dogs.
 
It is hard to cover every possible scenerio with your significant other.
We had some folks running new power lines starting at our property and some kid mumbled something to the wife about trimming a tree.
I came home at lunch and saw that a 60-70 year old Hickory tree had been cut down in my front yard. I was pretty peeved I can tell you.
My wife and I had a discussion about anyone on our property wanting to "do" anything. She will call now when someone drives up and wants something.

She probably decided it's best not to argue with the cop, especially seeing as how you don't have any illegal weapons.
 
IMHO, the officer did nothing wrong.

Your wife gave him permission AND a key to look inside the safe.

Once you consent, you can't take it back.

And THAT's why NOBODY else has the combo to my safe.
 
Thats why I am a stay at home mom. My husband says it's less stress on him knowing I am here. If a cop comes to my door and wants to come in and search. I will ask him where the warrant is before I would let him in.

I DON'T LIKE ANYONE PUSHING ME AROUND... Someone breaks into my house they won't leave the same way they came in.
 
Sorry to hear, hope you get the house secured quickly.

Definilly write down everything you and your wife had said to the cops including date and approx. time. The lawyers will like to see that. At the very least the dept. should change their procedures and allow YOU to check the safe and report any problems as a second report.

That's whats great about living in a small rural town. I shoot with a couple of local cops and a guy from the state patrol. I thought I had alot of ammo untill I saw what they had at their homes.:what:
 
If the safe was still locked and in place why would the officer even think that it had been broken into? Nothing was going anywhere why you were at work and it could wait until you got home to check it out. JBT doing a job they think their entitled too.
 
You should be mad at your wife. She should be mad at herself. You should both be mad at each other for not insisting on getting a security system installed. You should both take it as a lesson learned, and move on. She shouldn't have been intimidated, but she was. I bet she won't be the next time something happens.
Being burgularized sucks. I know from firsthand experience. I had a sweet 1911 picked from my bedstand, along with about $10,000.00 of stuff, but the thing I missed the most were the 0-6 months videos of my first son. The disks were in the video camera bag with the camera. Don't EVER store disks like this!
Don't misdirect your anger torwards the police, it is non-productive.
