On September 14, 2005, Rep. Myrick was joined by Rep. Mike McIntyre (D-NC), Scott Gardner's mother, Emily Moose, his cousin, Donna Lawson, and friends of the family, Will Newman and Heidi Hall, at a press conference in Washington, DC to introduce the Scott Gardner Act and the 10K Run for the Border Act.

Scott Gardner was a Social Studies teacher from Gaston County who was killed by a drunk driver in July. After the wreck, it was discovered that the driver was also an illegal alien with five prior DWI convictions.

Rep. McIntyre, from the 7th Congressional District, is an original co-sponsor of the Scott Gardner Act. Rep. McIntyre stated, “Our immigration system is in shambles, and passage of the Scott Gardner Act would be a great first step to help clean it up.

The tragedy that the Gardner family experienced personifies the need for expanding efforts to stop illegal immigration, improve our border control, and discourage illegal immigration in the United States.

I thank Congresswoman Myrick for her leadership role in this effort, and I look forward to working toward this bill’s passage”. Below are Rep. Myrick's comments at the press conference about the two immigration bills she introduced in Congress.


The Scott Gardner Act

"The Scott Gardner Act will make it mandatory to detain and deport any illegal alien convicted of DWI. DWI’s threaten the lives of everyone on the road, and it should be a deportable offense- not just a slap on the wrist. It’s just common sense.

The Scott Gardner Act will also require State and local law enforcement officers to collect immigration information during the course of their normal duties and enter this information into Federal immigration databases.

This is important because if law enforcement officials had a database they checked for each DWI pullover, the man who killed Scott Gardner would have never been on the road. They would have stripped his drivers license when they saw his DWI convictions. This bill will provide state and local law enforcement with the resources they need to accomplish this goal. And if they don’t, they will lose their State Criminal Alien Assistance Program funding…a federal funding program that most states utilize.

The Scott Gardner Act will also require that all DWI convictions be included in the FBI’s National Criminal Information Center database within 30 days from the time of the incident. To ensure that this information is entered into these databases, and actually used, the Scott Gardner Act will provide State and local law enforcement with the training and resources to get the job done.

I’m also going to push for State and local law enforcement agencies to use The Law Enforcement Support Center, run by the United States Immigration and Customs Enforcement. It serves as a national clearinghouse of immigration status and identity information for all law enforcement officials.

The Scott Gardner Act will insist Immigration and Customs market and promote the Law Enforcement Support Center to local law enforcement personnel. It will also require states to get their officers trained to deal with illegal immigrants, which will be funded by the Department of Homeland Security.

This training will allow State and local law enforcement officers to put illegal aliens who are driving drunk into mandatory detention and transport the illegal aliens so they can be quickly and efficiently deported."


The 10K Run for the Border Act

"I’m also introducing another bill today called the 10K Run for the Border Act. You often hear people say we need to seal off the border to stop the flow of illegal immigrants into our country. I wholeheartedly agree. But we also need to attack illegal immigration from the demand side.

People are coming here because they are getting jobs. Let me be frank- hiring an illegal alien is a crime. Right now across the country many legitimate business owners are struggling to compete against businesses who cheat the system and hire illegal aliens to keep their payroll low.

I was once a small business owner, so I know how hard it is to scrap by and make a living. But, I never broke the law to make a profit. The 10K Run for the Border Act will raise the penalties businesses face for knowingly hiring illegal aliens. Currently, the fine is $250 per illegal. My bill will raise the fine to $10,000.

It will also give an 80% cut of the fine to the local law enforcement agency assisting in the arrest. They can use this money to increase their efforts to curb illegal immigration. These two bills are just a start of reforming our broken Immigration System. There will be more to come from myself and my colleagues in Congress."

Rep. Myrick also stressed that these bills will help provide local and state law enforcement with the funding and tools they need to carry out the duties outlined in the bill. She also pointed out that these bills have enforcement mechanisms so that if these bills become law, they will not be idle on the books, but will be enforced.

In addition, Rep. Myrick also spoke about a new program that the Department of Homeland Security will be introducing that will allow businesses to check the immigration status of a potential employee by just a few clicks on the internet. The program is very simple and gives a yes or no answer to the employer.

On November 9, 2005, U.S. Rep. Sue Myrick introduced the TRUE ID Act in Congress. Unbelievably, North Carolina still accepts a taxpayer identification number as a valid form of identification when applying for a drivers license.

These tax numbers are nothing more than a slip of paper the IRS uses to identify workers. They do nothing to prove the person is who they say they are. They can be easily duplicated, and illegal aliens use fraudulent tax identification numbers to get a NC driver's licenses.

Many people believe that we have more than 300,000 illegal immigrants in North Carolina today because our state laws governing driver's licenses are lax, and illegal immigrants come here and take advantage of this fact. Rep. Myrick is fighting to make sure North Carolina's state leaders wake up to this problem. In order to stop this reckless practice, Rep. Myrick's bill will strip federal transportation funding from NC and any other state that continues to issue drivers licenses based on taxpayer identification numbers.

Not only does she have a proper notion of what the amount of the fine should be, she's even got a (imo) good plan on what to do with the funding earned through the proposed fines. If they can re-equip their departments SWAT team from one good bust, maybe it will become a higher priority. :)

Now. If they can only get the feds to actually allow local LEO organizations to do their job wrt illegals, things will start to happen. I am not at all convinced that the profound lack of busts of illegals has anything to do with state or city level LEO attitudes. At least around these parts.

It'll never pass. It just makes too much sense and the Corp. crooks won't allow it.

All these measures are quite limited in scope, but they are a start. Once there is enough momentum, more measures can be pushed through, much like an avalanche.

That’s not a bad figure when you consider a “minor” OSHA violation is $95,000.

This has to be the biggest NON-COVERED story of our time. Intentionally, of course. Some of it may be sheer ignorance--the bowtie boyz just not getting down to the seamier spots--but most of it is ignorance by design. I spoke a year ago with the former managing editor of a major Eastern newspaper (yeah, one of the opinion-makers) and asked him why his paper wasn't covering border trouble. He had no idea what I was talking about. The Media Axis thinks going after illegals is like McCarthy hunting down Communists, a major no-no.

Well I guess you have to start somewhere, all I know is 300,000 plus illegal immigrants in North Carolina is 300,000 plus illegal immigrants too many. I’ll be sure to thank those who made this possible on Election Day, as for employers I’ll take my business elsewhere- I don’t do business with criminals.

So from "reporters" they have become "makers" of reality, policy, etc.? That just shows how screwed up the system is.
They can have their corrupt system and as they build it on the backs of the people the people will come to despise them. What goes around comes around and in the end it all comes out in the wash.
 
The major "legacy" media are in the process of losing their audience. That will only increase as technology engenders even more choices, even more democratization of information.

It's getting harder to not do business with commercial operations that aid and abet illegal immigration. Take the acceptance of the matricula consular, the "Hey, I'm an illegal alien" card. More and more major banks (including mine) have no problem accepting it and encouraging more business with people whose status here is questionable. My bank has made a point of letting people know they are cutting their fees on money transfers back to the "home country." So it goes. We are not yet at the point where people are willing to boycott.
 
Little of a backgrounder on Myrick is in order.

--Sue is a conservative , bootlicking republican from the heart of Charlotte "Certified Agenda 21" NC. Her previous claim to fame was a comment made during the run up to the Patriot Act which basically said, "Hey, if you haven't done anything wrong you shouldn't have anything to hide." A republican in the heart of Democrat blissninny utopia.
--Her Scott Gardner Act was a response to popular outrage over illegal immigrant's kid glove treatment by LE at all levels.
--True ID Act targets six states which use taxpayer ID's as valid identification to obtain driver's licenses. Only six states do so. The act will withhold highway funds from states which refuse to fix the problem. One of those states is her own NC.
--Myrick is more than likely going to run for governor.
--What she is doing with illegal immigration is a solid split from Bush's agenda. She can not run on Bush's agenda in NC.

So here we have a situation where an elected representative from NC is writing and sponsoring legislation which will deny funds to her state because of its policies toward illegal immigration. This same politician will shortly announce a bid to run for governor.

That should give outside observers a hint of the popular outrage of NCians toward illegal immigration and state government's response. And NC ain't exceptional (except for its level of taxation).

Tell me about it, fortunately I live in a small town where I do most of my business with locally owned and operated merchants. We still have a local bank, a few stores, farmers, textiles/hosiery mills and even a furniture factory or two. Most people around here are fast to point out which companies are importing cheap labor/ outsourcing jobs and which ones assemble imported goods.

Most people don’t realize the damage that unregulated immigration can cause until it’s too late. . .

I’m confused here, I always thought that you had to be a US citizen in order to obtain a drivers license, which is also where you get registered to vote, that is when you attain your drivers license. So if he was caught DUI as an illegal with no dirvers license why wasn’t he jailed and deported!

You gotta start somewhere. Bush ain't gonna make it happen without a "comprehensive" solution. If he thinks the Great Fed Up is gonna accept amnesty (regardless of the word used) he is ingesting prime Tejas Loco Weed. Bush's political capital ends at immigration reform.

The problem with illegal imigration is that so many immigrants are freeloaders who want to live off of welfare. But those who are willing to earn their keep should be rewarded, not punished.

If you want to fine someone for illegal immigration, fine the welfare agencies who give my tax dollars away to illegals.

We live in a free society, right? Why on earth should it be illegal to hire a worker? This new bill sounds like a shakedown - an opportunity for the government to steal more money from people who's only "crime" is signing a paycheck.

This is what "liberty minded" people stand for?

I think the problem is not that they're working...the problem is that they're being paid under the table. That may not be the way it is in 100% of the cases, but in my neck of the woods that's how it works.

It's also very common to see 'jornaleros' around here. Guys waiting on street corners...then picked up to do 'day jobs' for cash. There was a huge flap up in Fairfax, VA recently where the city wanted to build a multi-million dollar center for them using tax payer money...so they would'nt have to stand out in the rain/snow/sun.
 
I think the problem is not that they're working...the problem is that they're being paid under the table.
Besides the normal spill about: low wages, under the table pay, job loss, loss of benefits, temporary job agencies, day workers, refusing assimilation, changing road/business signs and other means of communications to a foreign language, welfare and other tax dollar benefits, over crowed schools, sweatshops, prostitution, dowry, incest, fraud, increased violent crimes, drug trafficking, gang activity, slums, increased taxes, fleeing justice, increased cost of living, increased insurance rates, depreciation of restate value, health/safety and child protective issues. Heck the list goes on and on, I can write book on what I have observed.

I’m sorry anyone who believes that you can bring 300,000 + illegal undocumented immigrants into a state that has already outsourced 150,000 + jobs and thinks all will be good in the universe needs to have their head checked.

Signing a paycheck!!! You mean selling out their family, neighbors and community. If people want to hire illegal immigrants why not export the business?
