NFA Paperwork Question :^)

Well, I was just curious if anyone out there in the NFA/Title II owning community has used something like," The Second Ammendment", or " To fullfill my obligations to Congress as part of the "unorganized" militia", or anything like that, for the "reason" they were getting an NFA weapon :) ? Disscussion? Are there any cons to doing this? As I stated my last thread, as soon as we recover from that stupid hurricane, I'm sbr-ing something :) . I thought that might be quite interesting to have on the paperwork.

Still 2 Many Choices!?
 
Filing paperwork isn't to be of interest, I mean you could put "because I can" if you wanted.

"All lawful purposes" and be done with it.
 
nope. "all lawful purposes" or "collectors item" are all i've used.

don't learn the hard way that federal paperwork isn't the place to smart-off
 
Don't be a smart-ass on official forms. What if you had to use the weapon in self-defense and the court pulled your NFA paperwork (to prove the weapon was legal) and you had something on there that made you seem a little "different"? Anything "militia" related would instantly paint you as a nut. Just put "all lawful purposes" and that will cover whatever you can conjure up.
 
There was a pic of a Form 1 that was approved for the reason stated being "zombies". Totally unprofessional.
 
"Investment" sounds even better if it ever ended up in court.

Depends on the entity making or acquiring the device IMO.

My LLC invests in a limited number of short-barrelled rifles. It exists to hold property and invest in same. ;0

My trust, well, it's "all lawful purposes" since it's not an investment entity.

If I wanted to go through the hoops for Sheriff Mommy to sign off for me, I *might* go zombies. But realistically, the non-individual route works better for me in my situation.
 
I'd recommend not using that form as a political statement.

Just put "lawful purpose" or "collection" and move on.
 
As long as the reason doesn't imply an illegal use (or potentiality for illegal use) or insanity, you should be good to go. Now keep in mind, your local CLEO has complete discretion as to whether to sign or not, so don't go too far astray if you think it may impair your ability to get a signoff at the local level. I would avoid such reasons as: "because the voices in my head told me to" or "because I hate my neighbor's cat" or "to prepare for the zombie invasion".

OTOH, I've had F4's approved simply for "the pursuit of happiness". I've seen approved F4's for nothing more than "EXCITEMENT!" (it was for a 20mm Lahti). I've heard (but not seen a stamped & approved form to confirm) that "because chicks dig it" will also suffice. Usually I'll just stick to "collection & investment" though - and I recommend you do the same.

While I think the "zombie" reason is pretty funny ... here's a sobering thought.

I had a (pro-gun) U.S. Attorney just take a look at the aforementioned Form I.

He soberly (and dead seriously) informed me that entering "Zombies" as a reason for building an SBR on an ATF Form I is a prosecutable offense under 18 U.S.C. 1001.

Please don't to anything flip on these forms. Imagine what would have happened under a less 2A friendly DoJ administration!

Stick to "For All Lawful Purposes" or "For My Collection."

Any half decent lawyer could get you clear of charges for that offense. It's not a crime to think that a zombie apocalypse could occur. If you can keep a straight face and say that you honestly want to be prepared for zombie occurrences and get approved then you are good to go. The government isn't quite to the point of telling you what you can and can't believe in yet.
 
Okay I must admit, I was just curious as to what some of the more odd form 1s and 4s might have for the "reason". I figure if they're asking, might as well be honost :confused:... I wouldn't use "zombies" or something as detached from CURRENT reality( you just never know with zombies:)) as that, but I think putting " the Second Ammendment, all lawful purposes, and collection", would seem like a person being more patriotic than a rabble rousing!? I could of sworn it was a FEDERAL FELONY to knowingly lie on official Federal paperwork, like taxes,or BATFE forms? So if the Second Ammendment really is about more than just hunting, like self-defense, protection of innocents, and being able to assist my country if ever called upon, then why would using Federal Law as justification on a Federal form be wrong:confused: ?

That should be fine, though I would suggest "all lawful purposes in the excercise of the right to keep & bear arms, including collection"
 
Hey MGshaggy... You wouldn't happen to be the same "shaggy" from TFL that posts on the NFA board would you? I do like your rewrite of my above idea. Some people seem to think it is a bad idea, but none have really given a good reason as to why t would be a bad idea:confused: . That's where the "discussion" part of my initial post comes in LOL. Please give justification to your position that leaving any Second Ammendment reference off the form 1 I will file, is preferable. Thnx.
