NJ: Prosecutor delays Shaneen Allen Trial

I came up with the idea while on the radio. The idea is to turn up and keep up the public attention and the pressure. I primed the pump with a donation, then listeners added to it. Alan Gottlieb at SAF then *MATCHED* the donations. NJ2AS is running the effort. So . . . today (Monday) we put up four (4!) billboards. We had some money left over, and we donated that directly to Shaneen Allen, who has lost her job over this and is in a bad financial situation.
 
^Fine work,Tom. That is very unsettling that she has now lost her job and is under severe financial stress. A terrible personal situation.

The prosecutor is looking for wiggle room now that his home address is all over the internet. He's looking for a way out without having to admit that he is scared.
 
Could one of the lawyers comment on the defense of "competing harms"?

A few years ago while driving through North Carolina to Tennessee I took the wrong exit and ended up on highway going to Virginia. There were no places to turn around as the entire highway had concrete barriers in the middle. I had to drive into Virginia before I could legally get off that highway and onto another highway taking me to Tennessee. If Virginia had some firearm law that I would have broke by merely crossing state boundaries I had no way to avoid breaking the law. I could not turn around, certainly could not back up or drive the wrong way for miles back into N.C. looking for a exit and mere possession such as N.J.'s was crime. I suppose I could throw the firearm and ammo out the window along the highway somewhere but that would be even more trouble if caught.

So the young lady gets on the wrong road in her state and drives across the bridge into N.J. She realizes she is on the wrong road so as soon as it is possible she turns around to go back the way she came. So what was she suppose to do once she started driving into N.J. On the bridge? Turn around...impossible. Back-up...forget it. Throw her gun and ammo into the river? Even stopping on the bridge to do that is probably illegal.
 
^^ Stop, call 911, explain to the responding officer your dilemma, and refuse to cross the state line would be the only way to get past this scenario. I suspect that very few people would do this.

Our Marine who took the wrong exit in April and ended up in a Mexican jail and still sits there, ,encountered BSA's scenario and made the wrong move. He kept going to the Mexican border checkpoint with a car filled with several weapons and ammo.

I watched his Mom crying for help on Fox News Channel last week. It's pitiful.

The Willie Sutton move would have saved him all this grief. See that story here.

CNN just ran a story on this on Anderson Cooper's show, with Mark Geragos and Sunny Hostin both agreeing that this woman is getting railroaded while Ray Rice got a pass. Those two can't even agree on what day of the week it is, yet they agree on this, and Anderson Cooper promised to follow the story.

I hope all works out for this woman. I'm going to send a few dollars to her defense fund tonight.

Park illegally on PA. side, be ticketed and have your vehicle impounded?

And any of this would be worse than rotting in a New Jersey cell? Or in the Marines case, a traffic ticket from Cali LEO's instead of a Mexican jail?

No, because that doesn't describe this scenario. Ms. Allen was arrested in Atlantic County, NJ; which is about 60 miles from the PA/NJ line. Ms. Allen intentionally took her firearm into NJ, mistakenly or ignorantly thinking her PA carry permit allowed her to do so legally.

Shaneen Allen to be admitted into pretrial intervention

I saw this first on the NJ Gun Forums, this has become a National Story. The Attorney General of NJ contacted the State's County prosecutors and released a clarification with respect to out of state visitors. As a result, Shaneen gets a pretrial diversion program also known as PTI (Pre Trial Intervention).

"In most of these cases, imprisonment is neither necessary nor appropriate to serve the interests of justice and protect public safety," acting Attorney General John Hoffman wrote.

"In applying the factors set out in the clarification, I determined that the defendant in this case should be offered the opportunity to be admitted into the Atlantic County PTI Program," McClain said. "I have communicated that determination to the court and defense counsel."



But the news gets better, this opens the door for other cases too in such situations like Shaneen. Her lawyer, famous pro-gun NJ attorney Even Nappen is pleased with the outcome. This is big news.

"McClain indicated he will spend the next few weeks reviewing similar pending cases that may now be eligible for PTI under the clarification."

And this...

"Schreiber will also move to have the courts look at similar cases for his other clients that have already gone through the system."

Word from the insider track within NJ politics is that Christie gave an earful to the AG who passed that on... for those who aren't Christie fans, you'll need to start watching current actions rather than hanging onto your old "thing". This is great news and the message came from the top. Well done NJ.
