Not sure how to deal with a neighborhood situation. Advice appreciated.

File a complaint at your police station (get it on record, document everything) and get a lawyer. If there doing damage to your property then you have every right sue for damages. The police may or may-not help but if you document everything it can used against them in the future. Remember don't try to rig your yard with nails ect...just document everything, talk to the police then get a lawyer. Remember everything is just talk till your lawyers shows the tapes in court......................:rolleyes:
 
I'll definitely be getting a lawyer if any more damage is done and I get it on tape. If I don't have video I'm not going to bother. You're right, the cops can't make them stop but when the parents have to whip out the check book and pay a professional to fix the yard, the kids probably won't have vehicles to tear it up with anymore. ;)
 
I'm on it Ze, thanks. I'm going to have a crappy Wal mart NV camera recording to the PC (probably from indoors) and a real camera (can't remember if it's NV or not) recording to VHS from a tree in the yard.

I want to thank everyone again for all of the good ideas and support in general. Gotta love this place.
 
I have a slight similar case here at my home... I live on a dead end circle road (loops back on its self, same way in and out)... Some people fly through here and i have a little girl who just turned 2.... I know which people do it and where they are comming from... Called the cops and nothing got done... Asked for speed bumps to be put in and got a NO.... So i took it into my own hands... When i hear them fire up on the other side of the circle i put my shoes on (if they arent already) and walk to the edge of the road... If they are going over 25 (guess by engine sound) ill walk out and flag them down and explain about all the people living here, elderly, kids, even the loose animals... These little pocket rocket cars and some of the bigger labs and such that run around the neighborhood wont mix too good.. Explain the possibility of crashing into houses and such... Even printed off the possible charges and consequences they would face... All but 1 stopped...
I talked with daddy and junior lost his liscense to his daddy for 6 months... Junior got pissy and walks by runnin his mouth to 1 of my daughters, my wife, but wont say nothing to me... Well since junior is almost 19 i figure he knows what he is doin... But i talk with daddy again... Daddy said whip him or scare the piss out of him... Havent had that chance yet...


Give daddy and momma a chance to use the belt...
 
Only trouble with building a fence is that I can't put it right up to the next of the road due to right of way issues. There owuld still be a little strip of yard for him to tear up. I'd love to build one myself since I have a welder and have access to a 4' auger. I could make a fence that could stop any car in its tracks but again, that's a lot of work for 2 dumb punks. Setting up the camera in a few minutes, going to pick up the other one this afternoon.

I'll be waiting out there with my handheld during the time period that they seem to use. I'm going to be contacting daddy if I can get his info today. Trouble is that I think one of the kids is just doing it b/c his friend is doing it. I only know where the "nice" one lives. I think the other one really has a mean streak so I want to bring the legal action on him if it comes to that.

I'm also going to mention to the dad of the nicer kid that I know his son is a good kid and that his friend is the trouble maker. I'll explain that I don't want to get his son in trouble but it would be a big help if I knew where his friend lived and what his name is. I'm also about to do a myspace search. I might be able to get some more info on the mean one.

For now I'll call them "dumb one" (drives the truck) and "mean one" (drives the blazer. :D
 
Good update for a change

Got my craptastic camera from wally world set up today. All it tells you is if it's a truck or car and if it's a dark or light color. I'll be getting that $80 back. I expected it. You always get what you pay for.

Anyway, after that I was outside working when I heard the ATV coming. Grabbed the camera (which I had brought out with me, aren't you proud) and taped someone else riding by on the same ATV that was racing the other day. I know it was someone else b/c they were smart enough to wear a helmet.

Well, inevitably about 10 minutes later "mean one" rode up on the ATV (as I'm taping him). He pulls up right in front of me (I'm about 10'-15' from the road so I can get a good shot) and kills the motor. The first thing he says is "You better turn that thing off". I didn't even respond to that, just kept taping. He goes on the explain "right of ways" to me and how he isn't riding in my yard, the state owns 2' from the edge of the road and if I don't stop messing with him... his dad and grandfather are cops and "I don't want to go there". I'm sure if pops saw what he was saying "mean one" would have a real bad day or three.

I taped a 2 minute conversation where I didn't say much other than "I'm not breaking any laws" and "Is that why you only tore up 2 feet of my yard yesterday?" Of course he said that he doesn't know who did that. The most hilarious part about the whole thing was that when he was done with his speech he fired the ATV back up, and spun out through the existing ditch from yesterday. On tape. So I took some pics of the tracks (his and the blazers) with a tape measure that shows it's 5 feet from the road and 45 feet long. The ATV tracks are very visible in the pics too. He's wrong about the 2' thing though. I think here it's 40 feet form the center, not 2 feet from the edge. At least that's what it was at my parents house that is 5 minutes away. Checking on that tomorrow. I don't think I can do anything about the tracks in the yard since it isn't technically mine.

He also said "I'm not breaking any laws either. I mean, I'm riding a 4 wheeler on the roads but I've lived here for 20 years". :rolleyes: What's that called, something like, admission of guilt? Now he can't say he didn't know it was illegal at least. :)

So I call to report it and get a very helpful lady on the phone. Like I mentioned, they usually aren't very helpful but I guess this time was different since I have video. I tell her the story and she complimented me for getting the video and giving them something to work with. She also arranged for a report to be filed by phone so that he wouldn't see a deputy's car in the drive. I told her I was afraid that could escalate the situation and I was truly afraid for my pets, house and girlfriend. ;)

The deputy that had to file the report calls a few minutes later and after running through the story again (as close to word-for-word as the first time as possible) he says, "Is he tall?"
I said "No why?"
He says, "I know every cop that lives out there and none of them have kids this old except for one and his kid is tall and lanky".
My guy is medium height and husky. The deputy was unexpectedly helpful and said that since there's a pattern to the times that he'd be out here around that time so he could "just so happen" to bust him without my involvement. His words were "If this kid thinks that he gets a free ticket just because his dad's a cop, I'll show him otherwise." I was giddy like a schoolgirl. Still am.

So yeah, great news. I couldn't believe how dumb this kid was. My g/f and buddy didn't believe me until I showed them the footage. They were open mouthed through the whole thing.

Oh, and he also threatened to sue me for harassment... :neener: I can video anything I want from my own yard aside from peeping tom kinds of stuff right?
 
Take it from me, I live in NC and had a mailbox bashing case (twice) with what amounted to a recorded admission of guilt...and it is a HELL of a lot of trouble to take this stuff through the courts.

Your best bet is to get the cops on your side, scare the kid out of it, and as a last resort scare his dad with the evidence.

I mean, you can take it through the courts as a last last resort but it will be a huge time-sink and you will get very little, if anything, in return for it. Especially if he's a local first-time offender. If all else failed I'd probably do the court thing too but it won't net much in the way of returns for you or penalties for him.

I can video anything I want from my own yard aside from peeping tom kinds of stuff right?

I'm pretty sure if you aren't involved you could even record that for evidence purposes...hopefully this issue won't transmogrify into a "peeping tom kind of thing." :p
 
haha, don't worry about that. If you could see my neighbors, you'd understand. :uhoh:

I don't really plan on going to court with this.
 
johndoe - I'm a WNC native as well, wish I had some sage advice to offer, but looks like others have done a pretty good job. Liked your latest update! :D

If the idiots are still racing, especially using the wrong side of the road, you might consider doing something like leaving them a printout of some news stories involving the more "unlucky" idiots doing that over in Johnson City TN that killed one high school senior and maimed another one a few years ago...:mad:
 
I got news for the mean one;the state owns > 2' from the edge.See how far back utility poles are from the road,and then some.Even if the poles are right near the edge(given some oddity that requires that),the state still keeps enough ROW to add at least another lane to either side,+ relief for utilities.That's based on federal hwy stds,best I remember.

Tallpine, they aren't tearing up my yard. They know that and so do I. But they are tearing up the yard that I mow and the yard in front of my house.

So should I go tear up what isn't there yard and take MY small block (that is louder and meaner sounding than theirs) and terrorize their neighborhood? If you answer yes, then that isn't the high road friends. I'm a member here for a reason. I used to be just like them in a way. The kind and wise folks here have helped me become a more responsible citizen. Plus, making life tough for their parents isn't fair, that's why I plan on talking to the parents as soon as I can.

Now, I could just stop keeping up that little piece of yard and let a field develop in the only small space in front of my house where grass will grow. I don't think that will help the appraisal but I might still do it anyway. What good is an appraisal in this market anyway right? 30% or so of the houses here are for sale anyway.

Funny thing is now that I have one address (dumb one's) there are no tax records for that exact address. Why would someone mis-mark their house?

Again, I'm not worried about some muddy ditches in the yard as much as I'm worried about innocent people getting hurt or killed all in the name of redneck fun.
There is a real dangerous mountain gravel road just up the street (at the corner they first confronted me at actually) that they could race on. Then they could be the ones at risk.

I'm with you bama, I'm going to let him keep thinking that he can't get more than 2' in even though it's more like 20'. That's why I think he's lying about LE relatives. He also mentioned DOT relatives and maybe that's true and he was just embellishing.

The only other really dangerous possibility is the gas main that's less than 20' from the road. I don't think it could blow up my house if he side swiped it but it would be a rather abrupt and ugly end to the problem. I don't want to see that any more than him kicking down my door and me having to make a different kind of call to the cops....He's an annoyance yes, but a young annoyance.
 
Just wondering why so many of you are only telling him to watch these delinquints. The more laws that we just ignore, and allow people to break, the more they will break them. We all need to turn people in for breaking the law. Sign sworn statements, get witnesses and take them to task. If it is a stupid law, then try to get it off the books. If it isn't a stupid law, then uphold it. We all need to take back control of our own parts of the country, and to do that the laws must be enforced. Too many people just turn thier heads and say oh they are just young, dumb, kids. Then we all wonder where they went wrong when they hit a kid or a grandma. The truth is we went wrong by letting them get away with all the other minor infractions that lead up to the big one.

If you feel like the local sheriff's department is not adequately responding to the situation, it might not hurt to file a complaint with the state DOJ. The "good ol' boy" network is still very much a reality in the rural parts of the state. I also agree complaining to the parents won't do you any good, because I think this kid's behavior is a pretty clear indicator of the upbringing they provided.

Fortunately nature has ways of removing people like him from the gene pool at a pretty young age. One day he'll probably wind up on the front of the local small town newspaper after they sponge him off the highway.
 
If all else fails get a buddy with 40" or bigger Boggers on his trucks to tear up the allotted lane width of their yard.. If he has enough juice they will have to haul in truck loads of dirt to put back what your friend could dig out

Halo, the Deputy I last spoke with is taking this on as his personal responsibility. The statement about the LE dad really p'ed the deputy off. He said he knew every cop that lives out here and none of their kids fit this description so he's probably lying about that anyway. The people at the SO really didn't seem to care that his dad was LE. In fact I think it made both of them mad.

Got a license plate number for "dumb one" today. Every little bit helps I suppose. Got a better look at the blazer on the way by (at 3:00) but was too far away to get the plate number. There's always tomorrow.

Dad's are not always helpful and you can't always tell by looking at the house either. Where I lived in Texas last (on a street with a couple of other ARF members) we had a very similar situation. There was a kid that lived down at the end of the road (about a mile) who liked to drive 65-70 MPH on the road where the speed limit was 30MPH and kids would play on the side of the road in their yards.

The kid was racing up and down the road and I had three conversations one with the kid, one with the mom and one with the dad after three seperate incidents. Totally ineffectual all three times. The dad eventually plowed into one of the neighbor's mailbox and almost ran over some kids coming home from work at near twice the posted speed limit himself. He then sped away from the scene.

We got no help from the police, who said despite numerous eye witnesses said they could not prove he was driving? Could not stop the kid (despite video tapes) and did nothing to help.

Anyway these problems have a way of solving themselves sometimes. Eventually the parents felt that the kid needed a high speed motorcycle (probably due to the great responsibilty he had displayed as a driver). Less than three weeks later the kid was in the hospital with a broken arm and leg and missing quite a bit of skin on one side of his body. (he liked to ride without protective gear you see). I imagine the same thing will likely happen to this kid, and while satisfying, is also sad and impatient to wait for Darwin to work it out.
 
JohnDoe, Just a thought but in GA where I used to live and here in FL, althought the state or county or whatever technically can do what ever they want with the first two feet of the yard, the homeowner is still legally responsible for it. In other words unless the state mows it and takes care of it, its still your property. Now they can enact eminent domain or whatever its called and take it , but you technically own it until they do that. Therefore the kids are tearing up your yard. Good luck, I've always found that if you can get one cop to keep an eye out for your street as you seem to have begun to do, it always solves the issue at hand.

1. Right of way has nothing to do with who owns the property. YOU own the property. The state/county/city or whomever simply has the right to go on YOUR property for matters of public concern.

You need to get your head around the fact that it IS your property. Now is this "kid" a teenager or a 20-something??? If he is a minor, why on earth would you NOT talk to his parents???

If you go to his parents and introduce yourself as a friendly neighbor and show them some documentation of how their offspring is acting, I cannot imagine that they would defend it because it will affect THEM. It will cost them money, time and a lot of trouble.

If he really has lived there 20 years and is an adult, don't file a police report, file a criminal complaint. This guy is coming on your property and harrassing you and now you have video proof of it!

When one man won't stand up to punks like that, the punks have already won. I personally would have no problem hanging out down there, videoing the whole mess and when he stops again to confront you, beat the living **** out of him! He is making you a victim... only you can fight back. He is a punk... hand his ass to him. What is he going to do? Call the cops???

Come on doooooown! "Officer, I found this guy trespassing on my property and he refused to leave... when I went to talk to him he threw a punch... I simply defended myself. Would you please arrest him for trespassing and assault and I will follow you to the station to file charges.

F&%$K this *****... hand him his ass in a bag and tell him to f&^%$k off and go play somewhere else.

Jeeze... believe me I have family and understand you must be thinking about them... G/F, kids, pets, property, all of it. But when you DON'T Stand up, they will NEVER stop.
