Those who think the reciprocity bill would have made this not illegal, think again. His Florida license was expired, so he would not have been covered anyway. It's clear he knew what he was doing was illegal, and he did it anyway. I'm glad he was prosecuted, I'm sick of celebrities and athletes getting away with whatever they want. I don't think it helps our cause any to be saying he shouldn't have been prosecuted either. He broke the law, whether we like it or not. I'd prefer there not be a law against carrying, but as long as there is, we abide by it or we stay the heck out of places where it is prohibited. Nobody forced him to go to NYC.
 
In my libertarian way of thinking, Plaxico's "crime" is reckless endangerment. A negligent discharge in a crowded public place puts everyone at risk. I know a guy who got kicked out of the Army for a ND.

Yup. As far as I know, no one forced him to break the law either. He chose to, and regardless of what we think of the law, it makes him a criminal. I have no sympathy for him.

If you don't like the law, get it changed, and until then obey it. It's simple.
 
NYS honors no other states permits. And in NYC no one is allowed to carry , even if you have a valid NYS permit, without the express permission of the Commishoner of police.That includes police officers from depts outside NYC itself.
 
It should be remembered that New York City is not a fit place for any American that respects the heritage of freedom left to us by the Founding Fathers to be. It is nothing more then an infected, puss-filled pimple on this nation’s landscape.

Had this happened in Arizona, possession of the pistol would not have been an issue. Carrying in a nightclub and negligently discharging it would be. As long as no one was injured or worse, the penalty would have been one year, or less.

Burress is being made an example because of NYC government’s extreme hatred of guns, and nothing else. He must be punished to the extreme, as an example to both himself and others. For me, it is a reminder as to why I would never go near the place.

This rant about NYC not respecting freedom in this country coming from a dude who lives in AZ, a state that would not recognize MLKs birthday as a national holiday, makes me shake my head. Freedom for property owning white males was the only vision the founding fathers had. Your statement is so off the mark and only serves to discredit your statements. IMHO.

There were so many charges that Plex could have been charged with. He is lucky he only got 2 years. The max for the gun charge alone was 10. He illegally transported a FL gun into NYC. He carried it without a permit into a night club. He then discharged the weapon, reckless endangerment, and then created a criminal conspiracy to cover it up lying to the police all along the way. He had his friends lie for him. Illegally transport his illegal firearm into NJ and then cost a Dr. his hospital privileges and possibly his license to practice medicine so he could get patched up. Your right he got punished to the extreme. What a joke!

Now I am no fan of NYC gun laws but to stick up for this idiot who made a poor choice on so many levels and had so many chances to choose another course of action is sad. It gives the rest of us law abiding gun owners a bad name. We need to police ourselves. We do not need to lump our lot in with a clown like this.

This is not your avg guy. He has more money than most of us will ever see in our lifetimes. If he was concerned about his safety he could have simply hired security to cover his back or he could have gone through the process and gotten a permit. I am sure that he had the money to make that happen if he wanted to.

I think it is sad that gun owners defend people like this. It makes us all look bad.

Nobody put a gun to that doctor's head and made him keep quiet - he did that on his own. Some might argue that Mr. Burress somehow used his "star power" to get the doctor to agree to do it, and I'd agree - but that's still the fault of the doctor, allowing himself to be swayed like that.

Yes, he should have been punished for reckless endangerment. Yes, he knew he was breaking the law. And I don't much like our celebrity culture, either.

However, there are real criminals, who really hurt people, who get less than two years for it. There ought to be some sense of proportion, here.
 
Armed Bear I do not resent celebrities at all. In fact I am one of the few people you will find who think that NFL players are underpaid. I resent idiots in football and on message boards. LOL

As for MLK it matters because someone living in AZ is ranting about the another region of the country, NYC. His ignorant statements about freedom make my statement 100% relevant. There is proportion he got less than the mandatory he was looking at before the plea.
 
Yes, he should go to jail for discharging a weapon in a public place. We have a constitutional right to keep and bear arms. We also have a right to free speech, assembly, and religious choice. But, each one of those freedoms comes with responsibility. Personally, I think NYC's gun laws are just plain wrong, but so is acting like a stupid, gangsta poser. The anti's will use this incident to lobby for even tighter gun control laws. The only positive thing to come out of this whole, sorry affair is the no one else was hurt. Rant mode off.:cuss:
 
Whether you agree with NYC's gun laws or not, he was obviously violating them. To say that he therefore wasn't guilty is asinine.

Unfortunately the way our court system works is that even for unjust or unconstitutional laws to be reviewed a guilty person must usually plead not guilty and fight the case. Then during appeals the case can potentially work its way up the ladder.
People that plead guilty usually don't appeal, and people that do not appeal will never even make it to higher state level courts never mind be chosen by the SCOTUS to be heard.

To have standing to challenge an unjust law people usually are charged for being in violation of it first (or otherwise directly impacted by its application, like being denied a permit.)
So only "criminals" can even challenge unconstitutional laws.
Oh another thing is NYC is known for just ignoring many requests for certain permits, thus making it much more difficult to establish standing for being denied. Just ignoring a permit does not let someone move forward with legal action the same way an actual denial does.

NYC is one of the few places in the nation where mere possession, even in your own home of an unregistered and unpermitted handgun is a major crime. And most people have no possible hope of obtaining such a permit. In fact filing for one and trying to register a gun (especially as a NYC resident) red flags someone as possibly being in violation of the law and has resulted in a visit from the anti-firearm special firearms branch of the NYC police on many occasions.

His deliberate actions could have lead to the injury or death of others.

He used his status to attempt to flee the scene of a crime as well as he also brought the law down on

The night club owners
The night club security
His friend who took the weapon illegally back to NJ
The doctor and nurses who treated him without reporting the incident

Damn right he deserved to go to jail.

Which should be an obvious observation, and that government is in place because they were elected by a majority of NYC voters who I must presume support the government's views concerning guns and gun control.

Given some of your statements I can understand why you might find the NYC legal environment to be attractive. I will offer no objection if you choose to go there, but for myself...... NO!

P.S. I have visited NYc many times. There are a lot of positives about it and a lot of negatives. Kind of like most places.

I am not sure how Rev. King got into this, but in Arizona objections arose when it was decided that Washington and Lincoln days would be rolled into one to make room for a projected MLK day, and the proposal didn't fly at first. On the other hand some business objected to having a seperate, additional holiday under circumstances where it would be a paid holiday.

If it will make you feel any better I can report that today MLK day is observed in Arizona by most schools, government agencies, and businesses.

That's the same twisted honky logic that would lead you to believing that people in New York might be entitled to some gun rights.

I vehemently disagree with the following NY gun laws:
1) Practically impossible to conceal carry
2) Practically impossible to own a handgun
3) No carry in bars

If it were only that, I would support him.

However, as we all know, he did a lot of other stupid and illegal things such as
1) Carry a loaded Glock with Glocks design without a holster in his sweatpants (and I love Glocks, and know you don't do this).
2) Grabbed for it and fired it in public.
3) Tried to cover it up with his body guard and doctors.

Bad bad bad PB.
 
I can't help but wonder if Bloomberg had ordered the court to make an example out of this n* so if Burress hadn't pleaded guilty he would have gotten life.

Sadly, I must admit that while the great debate over a MLK holiday was going on I hardly paid any attention, because I was too wrapped up in…… guns.

Guns are evil you know… that’s why they won’t allow them in New York City…

Unless of course you have money and influence, or know the right people, or are an approved celebrity, or a politician…. :rolleyes:

That said, I have noticed that people-of-color have no problem getting permits in the Big Apple, while in Arizona where there is a “shall issue” system they don’t stand a chance. :scrutiny:
