I didn't think we were discussing illegal actions at first, but I do see how the first post is a bit ambiguous.
If the friend is worried that he'll be hassled even though he's in compliance with FOPA'86, then the "no consent to searches" strategy is probably his best bet.
If he's worried because he likes to carry a loaded gun at the ready even when it isn't legal, that's another issue. He still has 4th Amendment rights, but he's at much greater risk as he can't fall back on FOPA's protections.
