Hey, I want to know if I can pass the nics background check for firearms. I'm planning to buy a gun for sports shooting.

I'm nearly 22 now, however when I was in California at 16, I got in trouble in high school for just talking about guns to a friend. I wasn't talking about killing, just gun specs and parts. I got called in by principal, sent to a counselor for talking about guns. I was then referred to a psychologist because I knew too much about guns and my fascination about them. I had to see the psychologist once per week, I believed I wasn't diagnose with anything. Eventually, I got expelled just because of my interest in firearms. I was also threatened to be called the police on for my interest in firearms. Now I don't talk about it randomly, but other anti gunners overheard my conversation with my friends and report me.

Also, I'm not sure if this will deny me but I did made a non serious threat to someone who made me mad in high school. I did get in trouble for this.

I've never been in trouble with the police in my life. I had not set foot in court before nor have I been at a mental hospital.

Will school expulsion and being asked to see a psychologist a disqualifier on the nics?

Also, I forgot the reason I asked is because I see on the nics thats saying anyone being involuntary commited to a mental institution is denied, I'm not sure about my situation. I'm living in Virginia BTW. Also, I want to know if its possible for me to have something in my background if I never had trouble with law. I was threatened with being cops called on before but I don't see police coming to me. All because of firearms interest and saying names of rifles.

I don't want to end up being arrested for a felony after filling form 4473, only to find out I failed with something I don't know of.

While your situation does sound "weird" you have not been convicted of a crime nor have you been involuntarily committed to a mental institution. The ATF doesnt care if you got kicked out of high school. Don't worry about it. Just do like the rest of us and forget you were ever in high school.

If you fill out the 4473 truthfully, you cannot be charged with anything. Stop worrying about it and buy a firearm if you want one.

Seeing a psychiatrist is not the same as being committed to a mental institution. That part of the law is very carefully written so that only someone who has been convicted of a crime or who has been committed by a court will be denied his/her rights. That is why many of us oppose expanding prohibited persons to include the "no-fly" list; just about any federal official can add someone or anyone or everyone to the "no-fly" list for any reason, without that person's knowledge and without any opportunity to offer any defense or explanation for the alleged action or thought.

You have the option to submit fingerprints to the FBI in order to find out if you have a record or not. https://www.fbi.gov/about-us/cjis/identity-history-summary-checks

Also, many states have a program where you can do the same thing. In WA for instance, the state police have an online system named WATCH where for $10 anyone can retrieve their criminal history, if one exists.

From what I've heard the feds have a dismal record investigating and prosecuting denied firearm transfers, I imagine they don't get too excited about the matter unless the transferee is on their most wanted list.
