Saiga or SKS - legal in NYS?

Hi guys,

does anybody know if Saiga rifles are still legal in NY, or prohibited as "derived" from AK? What about SKS?
I know both are illegal here in NYC, but what about Upstate? We are looking to buy a house/cabin around Catskills for weekends/vacations, so I am wondering if I can keep a toy or two there, of a kind I can't have in the city...

I got a buddy I chat with who lives in upstate, a little north of Catskills. I believe he has an SAR-1. I'll have to double check with him.
 
To the best of my knowledge they are. I think some things might be banned by name, but not the SAR-1, and well, I live in upstate NY and I have a yugo SKS among other things. Just don't flash it around your city folk neighbors.

By the way, buy the house/property upstate!
 
Sounds good... So, have you actually seen any Saigas sold in any Upstate gun shops? I will most likely get one if I can (got to buy a house first though).

They are legal, with possibly the exception of a couple of municipal bans which may cover them , like the one in Rochester.
 
So, normal AKs (with pistol grip) are legal, too?! And 30 rd mags? I thought they were covered by NY assault weapons legislation, and hoped for Saiga at best!

I am an ex-New Yorker,welcome to the high road.
You could try asking local NRA members if you're a member and they're
members councils upstate,or call around gun shops up there.
Last year (or the year before) a black bear attacked and killed an infant
in the Catskills somewhere, of course no one had a gun because "guns are bad"
you should look into getting a CCW as well
 
An AK clone should be legal with the pistol grip so long as it has no bayonet lug, flash hider, or folding/collapsing stock, and is semi-automatic only.

30 round pre-ban mags are legal too.

The NY state AW ban is essentially a mirror of the Federal one, minus the sunset clause :mad:
 
Yup, my buddy confirmed on SAR-1 and basically said rifles such as referenced here are legal.

Years ago, my family had a second house on 10 acres in Palenville, NY. Loved that place and upstate NY in general.

We built it. Enjoy.
