(Hardeeville-AP) Aug. 24, 2004 - Prosecutors are reviewing whether a 28-year-old Hardeeville man was justified for shooting someone who appeared to be breaking into his home.

Jasper County Sheriff's Deputies say the man shot the intruder early Monday morning shortly after his security alarm sounded and someone kicked in the door.

Authorities say 32-year-old Michael Jenkins was shot in the leg and face and died about four hours later.

Legal experts doubt the man will face any charges in the shooting because South Carolina's self-defense laws are more lenient than other states.

Isn't that what's called curtiledge (sp?)? Our CCW class went into depth (this was a few years back and I need to revisit that section). I think it was determined by whether business can be conducted (door to door stuff or visitors coming going- basically front porch thing...) on this portion of your property. Then it was more public than other portions like say, your back porch. Still seemed a little "legally vague" to me when I studied that portion. Is that what we were talking about?

Yeah. The confusion is understandable. I mean, people kick my door in for completely mundane purposes all the time. I don't see why the guy had to get all uppity and shoot somebody. I mean, the other gentleman was probably just gonna try and sell some girlscout cookies or take a donation for the "I'm more important than you are and your life is worthless to me" foundation.

If there were no guns, we could all be victimized equally. That's what this is all about. Gun owners just don't want to be victims like the rest of us. You people just don't want to be part of the village!

I'm not sure what the rule is called, nor do I remember the exact details... I think the distance was 15 feet from any door or window. Of course there have to be more details, as that law as written would allow you to shoot anyone you don't know coming up to ring your doorbell, and that simply can't be the case...
