Silencer Shop is running a 'guarantee' that if you get your paperwork to them by July 8 they will process your application before 41F goes into affect.

They must be submitting your form 4 first and then when it's approved do a form 3 to your local dealer? I didn't think you could do that?

Nope, they're submitting a form 3 from them to the dealer and then immediately turning around and submitting the form 4 from the dealer to you on the same day. It's based on the (very valid) assumption that the form 3 will be completed before the form 4 is reviewed.

From what I've heard that the ATF doesn't really like this method as a dealer isn't supposed to submit a form 4 for an item they don't actually have possession of, but t seems to happen anyway.

The same way they did in your initial example ;)

They could do it several ways. If you look at one of your form 4s, the only information that can't typically be input by someone else is the signature, but there are ways around that. For instance part of the requirements for becoming a networked dealer *could* (I'm not sure if it is) be contractual content to allow Silencer Shop to add the dealer's signature to a form 4. Something similar to an esignature possibly.

Another possibility is that Silencer Shop fills out everything and sends it to the dealer to have them actually sign and submit the form 4 (probably with a timeline requirement in their network dealer agreement).

Interesting.

I wouldn't think filing on behalf of another dealer would be legal. Not that I'm complaining. If they found a way to make it easier for us, then GREAT!

Yeah Silencer Shop runs a pretty good operation. Paying an extra $5 for the tax stamp and going through a Powered by Silencer Shop dealer is well worth it. My trust was too large to upload on their site so I had to email it to them. They replied in five minutes saying they had received it.

I think being a powered by silencer shop dealer requires giving them your ATF login credentials so that they can automatically submit everything electronically on your behalf. Maybee an FFL can chime in on this.

Nope. SS submits the Form 3 first, then will submit the form 4.

True for other dealers, but not with Silencer Shop. They have a variance from ATF on how they submit forms. No one in the country submits more Form 3's and 4's than Silencer Shop.

Ryanxia How could they file the form 4 on behalf of your local dealer?
They only can do this if the dealer has authorized them to do so........that's what the "Powered By" program is. SS handles all form submissions to ATF on behalf of the Powered By dealer.

It is when the dealer authorizes SS to do so. ;)

.
What login credentials?:D The Eforms for Form 3's and Forms 4's went belly up many, many, many moons ago. Silencer Shop (and every other FFL/SOT) submits 3's and 4's on paper.

The reason I was confused is because they didn't say anything about only if you go through specific dealers. So if your dealer isn't on their Powered by Silencershop I don't see how they could make this guarantee. Probably somewhere in the fine print.

Thanks guys for the answers.
