strange FFL experience

The details are currently sketchy; I don’t fully understand what happened yet… so read this as a warning, not a request for advice.

I found a used handgun on the gunbroker website. Ended up bidding and winning it. It was being sold by a large gun shop, no issues there. Of course, I then needed to have it shipped into my state and transferred to me.

I decided that I would use the gunbroker “FFL search” feature to see if there were any local FFL’s that were a little more convenient to my location. This feature:

Entered my zip, a list came back, 2nd call seemed like a good guy and he confirmed that he could do the transfer so I went ahead and used him.

The gun shipped, and I filled out the required paperwork at my county clerks office (I’m in a state that the serial number is registered against my permit, so it’s a long process).

Anyway, a day or 2 later I get a phone call from the clerks office letting me know that the FFL listed on the transfer papers is not authorized to perform handgun transfers. They also let me know that the state police were on their way to his location. Again, I don’t know exactly why, they didn't tell me that part. Could have something to do with him personally, I don’t know.

Obviously, he had some form of an FFL license or else the selling shop presumably wouldn’t have shipped the gun in the first place, right?

Long story short, the police apparently confiscated my "future" gun along with others (because apparently I'm not the only one he was performing "transfers" for). So now, I have to go through an alternate process, re-prove purchase and ownership, and have the gun transferred to me via the local sheriff’s department directly.

Again, not really looking for advice on my situation, I think I’ve got it under control. The local folks here have been very friendly and helpful so far and I don’t think I know enough of the details to really understand what specifically happened here yet.

But I wanted to share because I guess the moral of the story is: Be careful getting FFL references on gunbroker :rolleyes:

So the sheriff dept has a FFL for you to use as a transfer?
 
Man, that sucks. I hope it gets worked out soon.

I am so luck. My FFL is a good guy, reliable and somehow he beats Cabelas prices on new guns. Everytime.

It's NY and I haven't gotten far enough yet to understand that excellent question (still waiting for judicial approval/serial number permit attachment which has to come first). Perhaps I'll have to engage another FFL who somehow gets delivery from the Sherif's department and "through" is a better word. I really don't know yet.

Again, NY process is very different then most of you have to deal with and this situation is an odd one making it even more complex.

So it's not a request for help.

Just try and be careful when you pick a transferring party!

As a broad generalization in NY:

"kitchen table" FFL = long guns only

Brick and mortar store that has the approved security protocols, insurance and local zoning approval = handgun transfers as well as long arms.

Of course, I clarified this with him before I used him and he claimed he COULD specifically do handguns. But....well.....we know what happened next ;)
 
Many states have separate restrictions on the sale/transfers of handguns, even if you have an FFL.

South Carolina is one of the. In addition to my FFL, I also must have a "Retail Pistol Permit" issued by SLED. That involves a separate application to them, an inspection of my premises, and a $10,000 bond to SLED.

With out that, I can't transfer, sell, handle, or even display a handgun on my premises (even if they are not for sale).
 
This is all very interesting. I am an FFL and I recently had a customer from another state (cant remember now, maybe Indiana) who I think stated that his FFL could not receive a handgun from me, only long guns. I thought that was weird, but I guess it happens. I know for sure that he told me that at least one other FFL he checked with charged MUCH more for a handgun transfer. I had never heard of that either. For me, a handgun transfer is actually easier cause my state requires a permit for all handgun sales, and a proper permit can replace a background check (since you had a background to get the permit), whereas some guy without a permit will require a background check for a common shotgun if he has never obtained a permit to acquire.
 
You are required to have a special state issued permit in addition to your federal FFL to sell hand guns in New York.

cskny: I'm curious, I wouldn't ask you to publically disclose who the FFL is, but what county are you in?

That's a really wise way to handle the situation. If there is a problem later that would be the time to post it, and as I recall there is a section of this forum for that purpose.

I completely agree, like I said I didn't want you to post the name of the FFL. I was just curious what part of the state you were in. Albany's all knowing hand is equally oppressive in all parts of the state, but the 2A climate varies greatly from county clerk's office to county clerk's office.
