Traveling by car through the SW

Question? Over supper last night with friends, one of the guys said he and his family will be traveling from Phoenix, Az to New Orleans, La by way of a number of states. He said he intends to take a loaded pistol with him in his luggage to have in the motels/hotels he will be staying at, and one loaded in the car for actual road time. I am afraid for him if he tries that.

This is the order of states he will be in or through. Az, NM, Tx, Ok, Ar, Tn, Ms, La and then back through TX, NM to Az to home.

Can any of you tell me what the laws are in each state as to travel and lodging when it comes to carrying hand guns. Don't want to hear he is in jail in Ms or thereabouts.
 
In Oklahoma he will be illegal. The gun must be visible and be unloaded in the vehicle. Open carry is also illegal in Oklahoma.

The standard Federal law states gun must unloaded, gun and ammo must be locked in an exterior compartment such as trunk or, in the absence of exterior compartment, ammo and gun must be in a locked case inside the passenger compartment. The glovebox or center console is not considered a locked case. The object is to seperate the gun and the ammo from the occupants, the ammo may be with the gun, but not loaded into the gun. This Federal Law knows as Firearms Owners Protection Act supercedes all state and local laws as long as he can legally possess the firearms at his origin and his destination.

Other state laws will allow loaded transport in vehicles. I have travelled from Oklahoma to Washington State and loaded carry in vehicle is allowed in Kansas, Colorado, Wyoming and Idaho. Not in Washington State and not in Oklahoma.

SO... loaded carry varies by state, but the federal law is good no matter what. Once in the motel, he is considered in his place of residence and in all but a very few states, there would be no restrictions inside the motel room.
 
Arizona is an open carry state, both in statute and in practice. Have him keep the firearm on him--If I recall, there are some places in the car where, if he puts the firearm, he or his passengers may be considered to be carrying concealed and not openly (some of this is by case law and not by statute, so you won't find it all in the Arizona Revised Statute).

Do not go into any establishment licensed to serve alcohol on the premises while carrying in Arizona. Grocery stores are alright, since they're only licensed to sell it to you, not licensed for you to drink it there.

Many Arizona roads pass through one or more Native American reservations. Their firearm laws are not the same as Arizona state law. Do not leave the road while carrying while passing through a reservation.

No CCL for my friend. Actually I am surprised his wife will even get in the car with him if she knows there is a gun in there with them. By the way the both think the Clinton's were the best Presidents we have ever had.
 
Open carry is legal in NM, and your vehicle is considered your private property as much as your house, so one can carry, slide it between seats, glove box, etc. Same issue as AZ though regarding Reservations.
