One thing I'd like to know is whether or not their ad agency is in the US or is otherwise under the jurisdiction of the US courts. I think it is very premature to gloat about settlements. I would like them to pull the posters from circulation.

Since the US is so big on intellectual property rights, you'd think they'd back you on something on which you have a legally registered copyright.

The copyright is registered, isn't it?

No settlement is due unless there are damages or losses. I don't see where there are any in this case. They haven't defamed you, because no one is clearly identified in the picture. They haven't used the H&K logo, because you managed to keep that out of the picture. Doesn't look like they modified it much except to crop it. A pretty skillful nab.

Definitely pursue the removal of the image, though. That's completely against the use for which you took the picture. I don't think they can argue fair use, because they are using it to make a political statement. An apology would be nice, too. They could suffer a nice PR hit if someone could make a skillful stink out of it.

I've forgotten more legislation on this than I remember. I'm afraid to know how many of my images have been nabbed by foreign powers.

I can see the headlines now: "Texas legislature passes bill to extend armed defense to intellectual property."

Evidently guns aren't all that they grab...

Perhaps orders to cease and desist sent to the following:

Development House
56-64, Leonard Street
London EC2A 4JX
Ph + 44 207 065 0870
Fx + 44 207 065 0871

Call the NRA, call a copyright attorney, email Volokh, call Guns & Ammo magazine (makes for a great human interest story.)

Heck, maybe Michael Bane would do a story about it on his show...

Oleg, what does it say in the red banner on their version? It looks like they changed it, it's two longer words instead of "A Liability."

It looks like the second word is "weapons" but I can't read the first.

The damage that I can see is that they used my image in express violation of the copyright agreement as stated at http://www.a-human-right.com/faq.html

They did not get permission to use it, nor did they compensate me for the use of my property. I am investigating the options, but getting info on who actually designed that poster would be helpful. Anyone with good investigative skills here?

I love the poster.....
"Can we afford to lose some more lives to armed violence???"

NO! which is why the victims of the war should be armed so no one can kill them easily.

Whatever course of action you settle upon, I believe you should copy your elected misrepresentatives, the N.R.A., the G.O.A., your state association, et cetera. You may never collect a shiny dime, but there's a chance the theft will become a news topic outside the confines of this forum.

Among other horrors, leftism is theft.

Tell them they can use it - for a cut of the "Oil for Food" money. Make it clear you want the same cut that Kofi's son Kojo got.

Oh, and forget trying to sue the actual designer or the company s/he works for.

Do like any good lawyer would do, and sue the everliving snot out of the people with the money.

To wit:

the Governments of UK, Belgium, Sweden and Norway, as well as the Ford Foundation, Rockefeller Foundation, Compton Foundation, Ploughshares Fund, John D. and Catherine T. MacArthur Foundation, Open Society Institute, Samuel Rubin Foundation and Christian Aid.

oleg, i'm no expert, but there's a good chance that whatever program was used to edit the image left a little fingerprint of some sort in the headers of the file.

e.g. the properties of all MS documents include the username it is registered to, as well as some serial # stuff. I don't know if photoshop etc do the same, but i would expect so, as adobe has a reputation for being annoying.

a little social engineering would go a long way here too. e.g. call the UN and inquire about purchasing copies of the posters. i'm sure you can find contact info somewhere on their web site. that would:

a) get you very close to the people responsible
b) support any claims of damages, if they in fact offer to sell your work
c) be somewhat entertaining

Hahaha...the UN...stealing. Get outta here!

Hasn't your images been taken on more than one occasion? That should be flattering in an ironic way. Plagiarism is the sincerest form of flattery :)

Retelling your situation to various organizations that would back your cause would likely get you a big hike in support, and subsequently more pressure on the department of the UN in charge of advertisement and whatnot. I just wish I knew these organizations so I could rattle some off.
