U.S. HOUSE BANS GUN POSSESSION BY SEX OFFENDERS

Dear Violence Policy Center Action Network Member:

Today members of the U.S. House approved on a voice vote an amendment
offered by Representative Jerrold Nadler (D-NY) to prohibit gun
possession by individuals convicted of misdemeanor sex offenses against minors.
The Nadler amendment is necessary to keep guns out of the hands of
dangerous, known sex offenders. Although current federal law prohibits the
transfer to, or possession by, a person convicted of a felony sex
offense, it is legal under federal law for persons convicted of misdemeanor
sex crimes to buy, sell, and possess firearms. The VPC worked with
House members to ensure passage of this important public safety measure.
The amendment was added to H.R. 3132, the "Children's Safety Act of
2005," a bill intended to make improvements to the national sex offender
registration program.

The Nadler amendment is modeled on the highly successful Domestic
Violence Offender Gun Ban, a provision the VPC worked hard to add to federal
law in 1996 that prohibits gun possession by persons convicted of
misdemeanor domestic violence offenses. In 2002 alone, misdemeanor domestic
violence convictions accounted for more than 12 percent of rejections
of firearm purchases by the FBI's National Instant Criminal Background
Check System (NICS).

Current federal law allows gun possession by persons convicted of
misdemeanor sex offenses against minors despite the fact that many states
require sex offenders convicted of such misdemeanor crimes to register.
For example-

--New York requires registration by sex offenders convicted of
misdemeanor crimes including sexual abuse in the third degree, forcible
touching, and sexual misconduct.

--Illinois requires registration by sex offenders convicted of the
misdemeanor crimes of indecent solicitation of a child, sexual exploitation
of a child, criminal sexual abuse, and any attempt to commit any of
these offenses.

--Utah requires registration as a sex offender by persons convicted of
misdemeanor crimes of lewdness involving a child and enticing a minor
over the Internet.


The Violence Policy Center will now work hard in the U.S. Senate to
ensure that this important measure to protect children from armed sex
offenders becomes law.

Yup - successful in costing people jobs, expensive guns, etc.

I supposed it stopped some DV, too, but....

It's also ex-post-facto, which maybe the courts will finally acknowledge now that the bastions of Political Correctness may be forced into the background.

I'm not defending Sexual Offenders. They probably belong in the greybar until they're too old to care. But I object to throwing restrictions on people "later" because they plead to a misdemeanor. It is, simply, too easy to become a felon these days. People plea to misdemeanors to avoid that in all kinds of cases. Next thing you know, these politidiots will try to take away somebody's guns because their car has loud mufflers.... :fire:

So the two football players doing a drive by mooning of cheerleading practice get disarmed for life by an overzealous DA?

I even have a problem with disarming released felons (nonviolent anyway). If they are that much of a danger, keep them in jail. But a MISDEMEANOR?!?! ***?
 
My view is simple. If they can't be trusted with a firearm, they can't be trusted with a knife, bat, fists, feet, etc.

They don't belong on the street, but in jail.
 
Divide and conquer.

The government is trying to turn us against ourselves so that we agree to give up more of our rights.

Step 1: Identify a pariah. "Sex offenders" are the latest label of a minority that is publically acceptable to vent all our anger on. Past examples include homosexuals, Blacks, Jews, the Irish, Chinese, etc.

Step 2: Make the most innocuous crimes "sex crimes" to ensnare more people. Mooning cheerleaders is a classic example.

Step 3: Repeat with another target group. How about outlawing the possession of firearms by anyone with a DUI? Or anyone with a minor drug conviction? (oops, too late). Perhaps ban possession of anyone on the new government "Terrorist Watch List". If you can't fly on an airplane you can't own a gun.

After a short while, no one can actually own a gun.

Another example of incrementalism. How long will it be before anybody who has been convicted of a traffic offense will be disarmed as all lawbreakers should be?
 
Sounds like more of a Witch Hunt to me.
And this is misdemeanor your talikning about.
People are wrongly convicted everyday, easier to do on a misdemeanor.
18 yr old goes out with 16-17 yr old and looses his rights for life = BS.
The whole thing has been blown out of proportion by media because it's PC that both political parties can jump on.

Nadler looks like the model for Peter on Family Guy. Peter seems to be apolitical though. Got a great campaign slogan for Nadler.

It has come up here quite a few times recently, but I'll say it again: the "sex offender" thing is way out of control, especially misdemeanor sex offenders. I've done many things that would get me a misdemeanor sex offender convictions, and I intend to do more of them! Things like pissing outdoors, making out with my girlfriend in a secluded place outdoors, etc. And yes these things could involve minors: if I'm making out in the woods with my girlfriend and we're making out after a nice romantic picknick (or maybe before the picknick or before and after!) and a minor just happens to come by... that's a sex offense against a minor. And it's also part of life. People have been having sex outdoors since the dawn of humanity and will continue to do so until the outdoors is too polluted for human survival, and minors have been "accidentally" seeing adults having sex since the dawn of time, and learning about sex, including perhaps "accidentally" seeing sex, is a part of growing up, despite what the American Taliban might think of it. And that's just an example of one of the many offenses that can get someone a misdemeanor sex conviction.

This is all part of the larger problem of how easy it is to get involved in the criminal justice system these. The word "felony" used to mean "murder, rape, arson, mayhem, or serious assault". Now the word means "filling out some paperwork wrong, having the wrong 'intent', saying the wrong thing, using the wrong medicine, having a gun with the wrong part on it, or just being in the wrong place at the wrong time".

I'm hoping that the newly-freed Martha Stewart will use her resources and connections to start a national organization in the US that specifically lobbies us to be "smart on crime" instead of "tough and stupid on crime". "Smart on crime" means think about what is and is not a crime.
 
Me, I'm against it myself. If you think they might cause harm with a gun, what the holy @#$% are you doing letting them out of jail before you consider them safe. Otherwise this is just a lame attempt by some libs to equate gun ownership with sex offenders.

That's funny :D , got to be careful though, this line of thought pattern could get you diagnosed, and labeled, and misdemeanered , and...... :eek:
 
No Republican will fight this or veto it because then the Dems and the MSM (thats redundant) would cry "See that evil Republican wants to arm child molesters!"

Best way for it to die is in committee or attach something that liberals just could never vote for (like repeal the NFA).


Still, write your Senators anyway ... if we put up enough of a stink maybe someone will do something about it (better chance then if we just clam up)

Then how can they pass a law preventing someone from bearing arms?
 
This is a very dangerous law if we let it pass. There are a ton of states that make all sorts of stuff sexual misdemeanors that are completely legal (under various SCOTUS decisions like Lawrence v Texas, etc).

For example, if I have a girlfriend and she lives with me without being my wife, that is considered a serious misdemeanor under Florida state law. Now, I know better than to plead something like that and would challenge it with a lawyer, but there are many who might easily be caught off guard when charged with such crimes. Few would see any harm in pleading no contest to a no-jail misedemeanor. Then surprise when a few years later congress passes a law turning them into second class citizens.

Ever have oral sex or anal sex with your girlfriend or wife?
Ever have sex with anyone under the age of 18 when you were in HS?
Ever engage in sexual activity in the back of an automobile in a secluded but technically public place?
Ever get into a loud fight with a spouse or girlfriend?
Ever moon someone?
Ever streak?
Ever pull over and take a pee behind your car door or behind a tree? Dont let the cops catch you.
Ever spank your child?
Ever go skinny dipping in your backyard pool?

All of these are become grounds to deny firearms ownership for life. The snare is tightening.

If they thought it would "save just one child", you bet they would. We already register them and restrict where they can or cannot live, irregardless of the fact that they have completed their sentance. We sould probably sew yellow stars on their jackets if it werent for the distastefull connotations (we will use RFID tags instead).

Not that im about to shed a tear for these people as individuals, but you have to realize that they are the harbingers of what awaits the rest of us.
 
Well, they're trying to spread into misdemeanors now. On the list above, I scored 5 out of nine.

But make no mistake, they're after you with the felonies too. If they make everyone a felon, then no one can own guns under CURRENT law.

Isn't rape a sex offense? Do those who get raped get assaulted 9 times out of 10?

Is there such a thing as a misdemeanor sex crime? Please explain.
