Wal-mart being sued over suicide

Here is something to chew on...

There is a line in the following story:

http://www.cnn.com/2004/LAW/12/21/gun.lawsuit.ap/index.html

The tragedies that families face when people are killed is terrible. And frankly I wish handguns were not so available in this country," he said. "But it's not right, in our minds, to make social policy based on just a few cases."

Sounds ok…but if you read and remember the first part of the story

…should have never sold her the shotgun she used to kill herself at age 24 in 2003.

Funny how people automatically focus in on handguns even when the issue they are discussing has nothing to do with it...

When I hear cases like this, I just cannot believe the ethical standards of some attorneys. What they are going for is a settlement. You may not know this but even if the plantiffs lose, Wal-Mart might still pay off something to stop appeals.

Ruger did this on a case where a dude dropped a pre 1973 SA revolver that went off and nailed him. This was way after 1973 and all the warnings and mod programs coming out of Ruger. Ruger won in court but still gave the plantiff a hunk of dough just to shut up.

Might happen here. Another thing that will disgust us, is the wave of paid off experts that will say anything for $500 to $1000 and hour.

Would they be suing WM if she had bought drain cleaner and drank it?

Or razor blades and cut her wrists?

Or mixer for her Vodka and sleeping pills...Pills from the Walmart Pharmacy??

its not about guns or how she got it,its about making someone else responsable for this death and wally world is a rather large company with lots of $$$.that is what it boils down to,shifting the blame onto someone else.

unless she clearly was acting and talking about suicide, theres no reason anyone would have known otherwise. It would be unreasonable for a clerk or anyone else to be expected to be a psychologist and a doctor at the same time along with being a 6 dollar an hour clerk.likewise a car salesman sells johnny a car, johnny runs over a pedestrian or hits a train trying to beat it across the tracks..so now we sue the car salesman ,the manufacturer or anyone else related to the car purchase and not accept the fact that johnny was the one at fault.

when does this nonsense stop, its costing all of us money.

The truly sad part is that Wal-Mart will probably settle to avoid the negative publicity and apparent callousness of fighting grieving parents in court.

Wally's doesn't settle that often.

The interesting points:

Wal-Mart, which promotes itself as a down-home friendly business, is helping change the nature of corporate litigation by aggressively fighting many cases even when it would be cheaper for the company to settle, analysts say.

The policy runs counter to the strategy of "settle quickly and cut your losses" that companies have used for generations. But it is paying dividends for Wal-Mart, which in the past five years has seen the pace of its lawsuits stabilize as potential plaintiffs and their lawyers opt not to sue after weighing the costs of fighting the retailer.

Well good for them. If more companies stood up for what's right theses junk lawsuits would not be so common place.

If they keeping acting like that I'll have to quit badmouthing them
