What to do if a cop pulls you over and youve got a handgun.

Per Mas Ayoob, hand over the license with your ID and say "Officer, I am licensed to carry a concealed firearm. I do have it on. Please tell me what you would like me to do." Keep both hands where they can be seen, don't make any fast moves, tell the officer what you're going to do before you do it. And if a search is requested, "I do not consent but will not resist. Am I being detained, or am I free to go?" Remember your rights, but be polite while asserting them.

Some places you don't have to tell the cop, some you do, but as a general rule (this is also derived from talking shop with some cop range-buddies of mine) the best way to go is to be polite, put all your cards on the table upfront and don't make any sudden movements.

Of course, others here will tell you Mas and I are overconservative and the proper response; threads like this usually start out with advice requested and given but very soon turn into a fuzzbashing and either locked or deleted. Let's hope everyone can stay on-topic for once...

The LEO's that I have asked just explained to me that I should say "By the way, I have a concealed firearm on me/the car(in GA you can have it anywhere in the car if you are licensed) and I am licensed. Just wanted to let you know"

Something along those lines. I literally got told by an officer one time "We don't worry about guys like you. You have your license"
So don't stress it. Some people say to put the gun on the front dash facing you, which to me is retarded. Violates the rules of safety. I would say if an officer asks for your license you might as well give him your permit to carry as well.

My CCW instructor said don't volunteer information but if asked be honest so until the officer asks do you have any weapons don't offer up information.
Oh by the way in my state you can have a concealed weapon within reach in your vehicle in a cocked and locked manner legally without any permit. Thought i would add that.

Well, in Texas, non-chl need to have, and keep it concealed; and as of the previous legislatuive session have no duty to reveal it to LE.

Present legislative session is trying to get a parallel requirement for chl holders (along with a great raft of needful legislation).

Uhm, I'm not remembering the full requirements for CHL holders, it may be that there is a duty to reveal on presentation of the CHL, which may be required when asked for ID while driving. (I'm positive one of our read-in members with a CHL can chime in here to correct me.)

Yep. If people think it's just a nice thing to do to inform a cop then they are wrong. Some cops are very elitist about who should be able to carry and you'll be harassed. It happened to a friend of mine.

Here in CA we are not required to tell the officer.. Just to comply with their request if they ask.. they know if you have a CCW permit as soon as they run your name.. I just keep my hands on the wheel.. When I was asked I just toldhim "Yes I am carrying" and they never asked anything else..

Baylor = Texas, right?

If you have a CHL you have a duty to inform about the CHL at the earliest opportunity IF you are carrying (and, from those I've talked to, when a cop runs your license plate it will come up flagged but the flag doesn't tell them if you are a CHL holder, you have a warrant, or whatever...so if you don't notify expect the 5th degree). If you don't have a CHL but are (legally) carrying in your car you need to keep it concealed and if the officer asks tell the truth (which can include saying nothing but not an outright lie).

When registering a handgun yesterday the police gave me a info sheet that says you should tell the officer you have a gun in the vehicle, but there are no statutes (state, county, or municipal) that says you have to inform them.

Personally, I wouldn't tell the cops around here simply because most cops (any state, county, or city employee actually) are veeeerrryyy ignorant when it comes to the constitution and firearm laws. You aren't doing yourself any favors by volunteering info or giving the cop what HE wants (instead of what he legally needs).

Is there a sticker that you can pur on your car to just tell the cop you have a gun, I want him to ask rather than chime in:

"im carrying a weapon"

"I have a gun"

"etc"

I just cant see this going very well.

I ALWAYS HAVE MY TRUNK GUN!!!!

So do you have a CHL? If yes, just hand it over first thing.

If you don't have a CHL don't worry about it. If they ask "any weapons in the car" you can say "yes, in the <wherever>" if you like or you can play the "no information" game, your call.

cops in GA don't care. None that I have ran into. They know where they work. This is GA, not NY, or wherever else.

Is there any case law backing the assertion that having a gun in your car in a state where guns in your car is legal (e.g. Texas) constitutes probable cause? Sounds like BS to me.

Or is this under the "officer safety warrantless search" issue the supreme court recently addressed?

When the cop pulls you over do you also just pony up sorry officer I didn't notice i was going 12 miles over the speed limit or do you wait for him to ask "sir do you know why i pulled you over" and you reply maybe i was going a liitle too fast. Seriously this should be a no brainer don't volunteer information,do not mark your vehicle unles required by your state law. I bet if you put a sticker on your car saying i have a gun some thug will break your window while you are away looking for your gun. I mean seriously guns are valuable you might as well count your money all flashy and in front of everyone when you are at an ATM. If a cop asks you do you have any weapons that is when you can reply yessir.

Per Mas Ayoob, hand over the license with your ID and say "Officer, I am licensed to carry a concealed firearm. I do have it on. Please tell me what you would like me to do.

Why do people insist on making speeches to cops?

If you have no legal duty to inform don't say anything unless he asks.

Since (we assume) you're in Texas just hand him you CHL with your other papers, cops are smart he'll figure it out.

Under no circumstance do you say anything that even sounds like "I have a gun"

First of all. Never admit to having a weapon in the vehicle in the first place.

Don't take legal advice from anonymous people on the internet!

I repeat: Don't take legal advice from anonymous people on the internet!

Telling a cop that you did something illegal because "this guy on the internet told me it was ok" is a crappy situation to be in. Handing him a laminated copy of the applicable statutes that you keep in your glove box and telling him to call them in is much nicer.

To the OP, you seem to have an irrational fear of the police. What you need to do is gain an understanding of your rights. This is a huge confidence builder. You should also gain the best understanding of all applicable laws that you can. Next step, FOLLOW IT. Or don't! That's up to you. I don't give legal advice on the internet! I will, however, suggest that you figure it out for yourself via CREDIBLE sources.

Once you understand your rights, what an officer CAN and CAN'T do during a traffic stop, and all applicable laws, YOU are in control of any encounter with the police. You're then simply helping them to realize that they're not interested in dealing with you.

When pulled over I used to keep my hands on 10 and 2 and tell the officer that I had a firearm in the vehicle. This method worked fine 95% of the time. Most of the officers simply asked that I had them the weapon, they would check it over and hand it back unloaded, no problems.

Then I met the one cop that gives the rest of them a bad name. This SOB pulled me out of my truck, cuffed me, searched the truck and gave me so much sh*t that I needed a shovel to dig my way back to the truck when he was done with me 45 minutes later.

After that I wouldn't tell an officer even if asked. I havent been pulled over in years and now with a CCW I don't think the officer will give me any flack. But my plan is to hand the officer both licenses if pulled over.

You are allowed to call police on other police ya know. That illegal search he conducted was pretty illegal. Especially if you are a licensed gun carrier. If you are arrested for no reason thats plenty of reason to get that guy fired. And yea, don't take legal advice from the internet, but be aware of your rights.
You can say "I do not consent to any searches" and it doesn't hurt you in any way, unless you have illegal crap in your car. If you have a license to carry chances are you don't.
I know that if I had a hard time with someone being unreasonable just because I had a CCW, I would just call the authorities above them. Like I said, illegal searches are illegal.

They will know when they pull you over if they run your tags, which they do.

Be polite and comply. Pull to the right, turn your vehicle off, turn on the dome(if it's dark), and place your hands on the top of the steering wheel.

This will make the officer feel more comfortable imo.

ok what if youve broken no law?
do you give the perpetrator an extra step because hes in uniform?

ok i know this wont be a popular response but hey thats how we became a country kinna

Admitting to having a weapon warrants a now Legal search.

There are way too many flaws in that logic. Having a illegal firearm in the vehicle and stating such can result in a search. Having a legal firearm does not attach PC in any way. There is so much misinformation in the responses I wouldn't know where to begin. Once again what is standard in one town, one country or one state does not mean it is the norm anywhere else. Running a DL or reg does not produce firearms ownership or any permit status universally. Spreading such misinformation benefits no one.
