For the legal schollars out there, what would be the potential worst case timeline for a must purchse by date for grandfathered guns if there were another AWB repeat? This assumes existing guns were grandfathered in. I assume it would not go into effect the day the bill was signed (there are practical problems on that one), but when, end of the month, 6 months after signing, Jan 1 next year, etc?

The day the president signs it in to law, generally.

Worst case scenario if they vote first thing in January?

A few weeks from now.

No possible way to know, considering that Biden and his cronies haven't even wrote the AWB (but first Biden has to learn how to write so that might take awhile.) ;)

This is NOT the 103rd Congress that passed AWB 1.0 in 1994. Even the 110th Congress was Dem majority and a AWB 2.0 sponsored by 4 Republicans didn't make it out of committee. The 111th super majority Congress that Obama brought in didn't do anything, either.

If the 112th/113th Republican Congress is willing to fall on their swords to protect tax rates for millionaires, many of whom don't support the Republicans -- I don't know how far they'll go to undermine the 2nd Amendment. I don't think they will go too far. Maybe mental health checks, a tax deduction for gun safes, Federal school safety standards. The question is if the 114th will see the return of Nancy Pelosi as Speaker (God forbid!) and that may be what this is all about.

True, Obama can do something with an executive order, but there are limits on what he can do that the courts won't void, and the next Republican president can just void the executive order.

My guess is that the disaster of Obamanomics will continue unabated and that he won't be awfully popular in 2014 -- but that's just my guess, and I remain amazed by what happened in November.

My honest opinion is most of them, dem or GOP want to talk about gun control a lot more than they want to do anything about it. If nothing happens, well that is what congress does. Do something and you are painting a target on your back. So they will make speeches in public and play for time until its no longer in the news so much. That fiscal cliff is coming up as well, its going to take over the headlines very very soon.

Tax Man Cometh

Everybody is hoping to be grandfathered in. But like healthcare it may be a tax strategy you need to fear. In 1934 machine guns were not banned, they were taxed. In 1986 class 3 weapons were grandfathered in for private ownership.

I'm thinking you can keep your AR15, I mean if you can pay the annual tax of whatever number they come up with most people can't afford. Anyone here see the prices on a class 3?

Oh yea, you need written permission to take a class 3 out of state. I understand that purchase is taking 4-6 months for ATF to process paperwork.

And if you state bans machine guns based upon a class 3 rating the ATF just got you.

Congress could do nothing. But is ATF puts it on a class 3 list in an administrative move you're toast.

Guess who's ready to move "Forward" comrade.

This was discussed elsewhere and the USSC has already decided that Presidents can't make law.

I agree with you. However, the bigger question (IMO) is whether our population would be willing to fight when one of them tries to.
