Firearms legal loophole helps Victorian criminals

ANGLE grinders and a legal loophole are helping violent criminals beat
Victoria's most serious firearms charge.

A court ruling from two years ago is enabling them to stave off
charges of being a prohibited person in possession of an unregistered
firearm.


In the 2007 case, a court ruled a man charged with that offence be
cleared because the weapon's identifying numbers had been removed.


He was able to successfully argue it could not be established the
Glock semi-automatic pistol at the centre of the case was
unregistered. The charge carries a maximum sentence of 15 years.


It is designed to deter people on the prohibited list from carrying
firearms.


The Herald Sun believes other successful defences against the charge
using the same argument have been mounted since the 2007 decision.


Prosecution of a violent Melbourne criminal on the charge was
withdrawn this year because the gun could not be identified.


A spokesman for Police Minister Bob Cameron said the Government was
talking to Victoria Police.
 
But I thought it was a complete gun ban. Oh wait, that's just for law abiding citizens. Criminals get whatever they want. And that's what we are headed for if we don't vote for our RKBA in Nov 2010

As a couple of others have already mentioned, there is no ban on semi-automatic handguns in Australia. There is a magazine capacity limit (10 rounds) but beyond that, we have the same range of handguns that are available to Americans. The criminals in this story were using weapons that are legally available in Australia. It actually gives weight to the antis argument that handguns should also be added to the classes of firearms that are already banned in Australia.
 
You guys make sure AU bans all the guns.
That way a boat load of pirates can simply take over AU.

Gun control activism is no national phenomenon that just happens to coincide in several countries simultanously. Civilian disarmament is a centally administered process of supranational institutions (UN-ODA), national governments and NGOs.

The binding element of all participating state and nonstate actors is the furtherance of shared interests by means of cooperative rent-seeking behaviour. It is the establishment and fortification of the de facto monopoly in the excercise of force, from which all other political power derives. This strategem is shared by otherwise completely adversarial actors who would not cooperate on any other agenda.

We, the advocates of individual gun ownership, miss this point completely as we lament abour crime statistics, sporting use and self defense. Even as we have the facts on our side, we a sidetracked in a debate about utility and effectiveness when the counterparty could not care less. Again: Gun control is a strategem of the consolidation of of political power.
