Yet another NICS delay...

I've had my eye on a Sig P239 for a while now. I've never owned
a Sig, and yesterday I decided to rectify that. I motored down
to a local dealer who features the Sig line and bit the bullet,
so to speak. I filled out the paperwork, and my dealer called it in.
I went outside for a smoke, and when I came back in I was told
I was put into delay status.

Well, this is the third time (in a row) in three months that I've been
delayed on a firearms purchase. I got ticked off enough the last time
to fork out a little cash to have my background thoroughly checked,
as well as my credit history. Everything checked out fine. I'm clean
as a whistle, but I already knew that. Anyway, I'm really starting to
resent this, enough so that I almost backed out on yesterday's purchase.
The dealer told me it's buggin' him as well, as he has noticed a substantial
uptick in delays - not denials, just delays.

I'm just real curious if any other THR's are experiencing the same headache
that I am. I'm about ready to jump through the VAF application hoops, but
I'm wondering why I should have to take it that far. This is America, right?
Last time I checked, the 2A wasn't dead and buried yet. Let me know what
ya think, if any of you would care to. Thanks for the time. Just had to vent a little.

:uhoh: Everytime I buy a firearm I'm delayed, well at least two days for a handgun as thats WI state law. I get much more pissed about having to pay them, the state, to run the background check. I ain't kidding, what other constitutionally protected rights require your cash advance to exercise?:banghead:
 
Didnt the Nazi's excerise the same diplomacy with the common people before taking everything away? I honestly do not know but thought I had read something about how the people gave up their rights as a free nation for the "good of the government".

Likely someone with the same name as you is a bad boy. Do you put your SSN on the forms?

Don't know Ohio CWP law but in several states if you get a CWP you don't need a background check. Fill out the paperwork shows your CWP and go.
 
I started getting delayed a couple years ago. Then i called the NCIS phone number,explaining that i haven't had so much as a warning ticket in almost 20 years and couldn't understand why i've been getting delayed. She punched things up on her computer and said " i see no reson here for any delay, wait 5 minutes and call your FFL ". I did,and was told i was now cleared to pick up my latest toy. Fast forward several months, i'm buying a glock 26 in Butler,Ga, an hour + drive from me,knowing i'll likely get delayed, but confidently armed with my cell phone and NCIS number. Well, after being delayed again for no apparant reason, i call in explaining from the gunstore the situation and the fact that i once resolved this by calling them,but this time am told "they weren't supposed to give you the disposition of your case, or clear you on the spot" . I told the guy "well,regardless, she DID, so you can,too" and that i obviously have no " disposition ",as he's well aware, and no infraction that would preclude me from taking my pistol home right now. He continued with his "blah,blah,blah,yeah,but,yeah,but" and i finally gave up and drove all the way back home, just to find that they'd called and said i could now drive the 2 hour round trip yet again and pick up my pistol.
Your tax dollar at work.:cuss:You know what works ???? Get your concealed carry permit.No more phone-in,end of problem. Well, till '08. :(
 
I already have a CCW permit for Ohio. Doesn't seem to make a
damned bit of difference. I've tried the SSN vs. no SSN on the
application, and that doesn't seem to make a damned bit of difference
either. Can ya tell I'm just a tad pi**ed off?

It's just a delay. It could be from an overload of requests to computer problems or any other simple problem. It's not that you were denied so why get your panties in a knot? Just go home and wait for the dealer to call about whether your purchase can go thru or not.
 
I've never once experienced a NICS delay. I don't personally know of anyone who has around here. Whenever they call it in, they clear me right there on the phone and I'm ready to go.
 
I have a ccw and have never had a delay. Both my husband and myself are military as well. We have both purchased multiple firearms without so much as a hiccup.
I have been told before that if you make several purchases in close sucession that they have a tendancy to delay your paperwork. This would cause an unsavory character to just give up and go home, he/she does not want to wait around any longer than necessary.
 
Guys, guys, shot show is this weekend out in Nev. They very well may be short staffed as they are all out there having the time of their lives on our tax dollars.> rant off

I know that is where I would be if I wasn't in college.

I feel for ya - I'd be pretty steamed, too.

I, like many, avoid this by using a CHL instead of having to submit to a Brady check. But if your state doesn't allow that, you have little choice but to stand in line and wait your turn to exercise your 'right'.
 
I to get delayed last 3 pistoles, wait 3 days than pick up my gun.:) My wife never got delayed go figure.

The NICS check for me is always ridiculously fast. I bought a rifle two weeks ago. I just stepped to the side to look at some handguns through the glass for a second and I was all clear. I always put my SSN on the 4473.

I think it's a good law. We can't just have criminals walking into the store and buying whatever they like. We need to delay them by making them call up their drug dealer. Depending on traffic it could take the drug dealer ten minutes to deliver the stolen gun to the criminal.

If it saves one child's life, it's worth it.

I've been delayed every time by NICS. A couple years ago it upset me enough to call both my U.S.Senators about the situation(both congressmen are Dems.). I don't know what happened bot I'm still delayed, however while still on the line my dealer is tranferred to an FBI agent and he signs off on the sale in about 3 minutes. The squeaky wheel gets the grease, and this is an election year.
 
Concealed carry permit doesn't mean squat where I live as far as getting out of the check, but I have never been delayed and I purchased 10 firearms in 8months last year with two more coming up this month.:D

In Montana, if you have a concealed carry permit, your name is NOT called in at all! (question # 23 on the 4473 states that no NICS check is required if the buyer has a valid permit from the state where the transfer is to take place which qualifies as an exemption to NICS) Their words, not mine! The State of Montana doesn't run the checks! As a matter of fact, our concealed carry permits have a space for a NICS# on it!
At gunshows, some dealers will charge a person less if he doesn't have to call in on a purchase! I am not sure, but I think Montana honors some other state's Concealed Carry Permits!

I have never been delayed for a firearm purchase before, yet on my latest acquisition, I came back "delayed". !?! Huh? What?

Nothing has changed in my status (except for it becoming SENIOR with this post), not even a speeding ticket. Why would I suddenly be delayed?

So I got peeved and started calling people. The only suggestion I was given was to read about the possible reasons for the delay.

So I went here: http://www.fbi.gov/hq/cjisd/nics/nicsfact.htm

It states: "If the NICS returns a match of the prospective firearm transferee's descriptive information to that of record information LOCATED IN ANY OF THE DATABASES, the FFL is advised that the transaction is delayed."

Why would they suddenly have a match of my descriptive information in any of their databases, when they never did so before?

Database? I thought the maintenance of any "database" pertaining to law abiding citizens was illegal? Isn't this de-facto gun registration?

Would a record of passing an FBI background check for a CCW be retained in a database?

I'm adding another layer to my tinfoil hat.
 
My experience has been good with NCIS checks. My name isn't all that common though if that makes a big difference I don't know.

That is one of the main reasons I got my CCW permit, not that it ever took more than a minute or two before, but if you can bypass the call, why not.
