Yea, a "State Jail Felony" just means, if I understand correctly, that incarceration must be served in state jail rather than a prison. Most jail sentences over 1 year are normally served in prison. The person would still forever be a felon and barred from owning firearms. I never understood why nonviolent felons would lose their "Right" to own a gun for life.

Styx, a state prison sentence does not necessary preclude a person from losing their gun rights, voting privileges and the ability to serve on a jury, among other restrictions.

All 50 states, TMK, have parole boards, upon which a released felon can appeal to have these rights restored. States vary greatly in the process. I understand Arkansas is quite lenient and I know Florida is fairly harsh.

However, if it is a Federal Felony conviction, then the restoration of rights is almost hopeless. Only a Presidential pardon can make the restoration possible.

Others on board may wish to comment if I am in error on this matter. :scrutiny:

Description: Firearm transfers; penalties. Creates a Class 2 misdemeanor for a person who is not a licensed dealer to sell, rent, trade, or transfer a firearm to any other person who is not a licensed dealer. The bill also creates a Class 2 misdemeanor for a person who is not a licensed dealer to buy, rent, trade, or transfer a firearm from any other person who is not a licensed dealer. The bill exempts certain transfers, such as between immediate family members, by operation of law, and when the transfer is temporary and is necessary to prevent imminent death or great bodily harm or occurs while in the continuous presence of the owner of the firearm.

A00214 is an extremely 'sneaky' attempt to force gun owners to keep all firearms locked up. The way this bill is trying to do it is by removing the line "who resides with an individual who such person knows or has reason to know is prohibited from possessing a firearm pursuant to 18 U.S.C. S 922(g) (1), (4), (8) or (9)" from S 265.45. With the current law you only need to keep them locked up if you live with a convicted felon, by removing that line all firearms must be locked up.

A00284 would make promotion or sale of a weapon on public property, this bill has some extremely dangerous language in it

A00373 doesn't have text yet but the summary reads 'Relates to the mandatory suspension and revocation of firearms licenses upon the issuance of orders of protection.'

A00316 also has no text but the summary reads 'Relates to the criminal possession of a firearm or magazine digitally made; classifies such possession as a class D felony.'

A00381 also has no text but it looks like another 'ghost gun' bill as the summary states 'Establishes certain crimes relating to the criminal manufacture or possession of an undetectable firearm, rifle, or shotgun.'

S00511 also has no text and we aren't 100% sure if it is pro gun or anti gun, the summary states 'Repeals certain provisions of chapter 1 of the laws of 2013, amending the criminal procedure law and other laws relating to suspension and revocation of firearms licenses.' ... would like to think it is pro gun but you will need to keep an eye on it to see the actual text.

It looks like McAuliffe’s agenda is being introduced as bills in the Virginia House of Delegates and State Senate. Please write your state representatives; I just did. You can use the link below from "virginiageneralassembly.gov" to look up your representatives' contact info.

Notice that the Virginia proposed bills listed on this thread are of two different types. Some are State Senate bills (e.g. SB 768) and others are House of Delegates bills (e.g. HB768). State Senate representatives do not consider HB bills and vice-versa.

So we don't hijack dc dalton's thread, I suggest that we create a new thread for proposed law's related to McAuliffe’s agenda rather than "back and forth" postings here. I suspect only a small percentage of viewers here have VA interest(s).

Nullification laws have been discussed at length here. Essentially, they are a feel good measure and can't over rule federal law.

Its hard to tell if new york s01004 is pro or con. Sounds like a good thing to research each and every gun taken via an amnesty buy program and notify the owner...before it is destroyed. Hopefully the intent is to provide an opportunity to claim and regain possession of the stolen item. If so, way to go NY. But since it is NY, it will probably go like this, Hello, we found your stolen gun and properly destroyed the evil thing for you. There will be a minor recovery and disposal fee along with a misdemeanor charge for reckless ownership.
