Stupid question...ccw okay in TX movie theaters?

Assuming not posted either 30.06 or 51%(Alamo draft house does serve alcohol but I highly doubt it's 51% of income) can you do this? I know they aren't specially forbidden in the penal code but I don't know if maybe they fit in a different category that's broad like place of amusement or something.

Yes it is ok, but I believe some locations of the Alamo draft house are posted with 30.06. I remember a big stink about it and a few angry letters to the Austin location. I don't know if they took it down or not.

Handily there are no "broad" locations in the Texas Penal code as it applies to CHLs and where they can lawfully carry. Each place and term is specifically defined at some point in the code.

For instance:

Texas Penal Code Sec 46.035 said:
(f) In this section:

(1) "Amusement park" means a permanent indoor or outdoor facility or park where amusement rides are available for use by the public that is located in a county with a population of more than one million, encompasses at least 75 acres in surface area, is enclosed with access only through controlled entries, is open for operation more than 120 days in each calendar year, and has security guards on the premises at all times. The term does not include any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area.

So, no, the Alamo Draft House doesn't fall into this category.
 
OP, did you pay attention in your CHL class at all? They go over in detail where you may or may not carry.
 
If it's an AMC theater, then you're most likely out of luck. No lawfully concealed handguns on their premises. You might want to check out this site for 30.06s in your area:

you can carry in the theater so long as it isn't a 51% establishment, there is no 30.06 sign posted, and owner, or the agent of the owner, has not specifically told you to leave with the weapon.

the last part is the catch-all your CHL instructor should have addressed. it doesn't matter if it is sign posted legally or otherwise. if the owner or an agent of the property owner tells you that they don't allow guns and you must leave and you fail to depart then you are guilty of Criminal Trespass which is a Class B Misdemeanor.

that will get your CHL suspended upon arrest.
