but in fact it is one guy surrendering 1 gun as a result of a court order. look up his version of the story

Arizona has a lot of nut cases but quartzsite has always been an especially notorious looney bin. I don't think this is the first instance of out of control local politics there.

And nothing from world net daily should ever be posted on here because nothing from that cesspool of mendacity is ever even close to "high road"

What does it matter if it was 1 guy and 1 gun or 100 guys and 100 guns?

Why should this justice of the peace have the right to revoke his Constitutional right all of her own decision? No charges, no crime commited, no jury even.

in va you go to a magistrate for a similar order
and you know how much training it takes to be magistrate?

It isn't right there. It is basically judicial fiat, one person in a position of power deciding matters on their own. Was Roth arrested or charged with any crime? How often will a magistrate, judge, or justice of the peace order someone to turn in their firearms without charges first being issued?

you are unfamiliar then with the process by which an injunction is issued? how? and why?

roth has been arrested and convicted of at least one crime. and his failure to show up n court was "special"

This is insane, a Justice of the Peace, with no formal training or legal background other than that she won an election, and was once a Deputy, Issues a court order to surrender personal property without a formal hearing, without a medical or mental evaluation, without anything other than the whims of a city council member....

What part of the 4th amendment does she not understand? What part of Due Process does she not get? This guy seriously needs to lawyer up and go head hunting...
Ever heard of domestic restraining orders?

"I remembered my retired law-enforcement friend's warning and gave all of my guns away. Better to let a patriot have them than this thug of a chief."

Confiscating a firearm this way is a little different than a domestic injunction or other injuctions.

".......and several times I have been arrested around town, simply because I've spoken truth to power."

Methinks you could get tried and convicted there real quick. Ever heard of Judge Roy Bean?

Is the power trip associated with ANY elected position important enough to risk reprisals after pi$$ing off the public? I guess we'll see..................

Actually, I have.. I have been involved on the business end of more than one...

They however are issued by a State District Court.. Who must be licensed attorney's in many/most jurisdictions in order to run for, or be appointed to that office.

Not a J.P. who can be an auto mechanic one day, and a real live Magistrate the next... and these restraining orders, having been issued in a District Court, with both parties present, and with proper legal counsel., Unless they voluntarily sign away that right to counsel , generally against the strong admonishment of the Judge..

In J.P. Courts, the lowest level of County Court, rarely are citizens represented by counsel.. I have seen J.P.s hold court on the hood of their car... it is a very loosely regulated and run system...

Ok. I cant get any of the links to work because I'm currently overseas. What is it that this entire town is fighting over in the first place?

Maybe a quick run down of whats going on?

What does wnd stand for exactly?

"Living in a free country means never having to "risk reprisals." "

Unless you did something illegal. :)

When the mayor says something along the lines of 'sergeant, don't arrest her she's using her 1st amendment rights' and the sergeant continues, I think it's fair to say that you *risk* reprisal.

WND certainly has a conservative ideology, but it is a conspiracy theory/paranoia website. Not unlike Alex Jones and his infowars/prisonplanet BS.

Citing WND as a source is like citing the brown stain on a piece of toilet paper.

Seriously.

How about we reserve judgement for when an actual new outlet covers this?

In a free country if you do something illegal you risk prosecution and punishment, never "reprisals."
