Alabama legal question

I have been unsuccessful in my attempt to find the law that states you cannot Conceal Carry in a place that serves alcohol. I know it (whatever 'it' is) is there but I can't seem to find it. Don't know if I'm reading the wrong section or what.

I have been told you can carry in a "restaurant" that serves alcohol others say not so, I also know some counties have it on the back of the CCL "Your pistol license does not allow you to carry a pistol in any place that serves alcohol or while you are drinking or using any illegal drug."

I have been told Sheriffs sometimes add restrictions to CCL's in their county so "laws" vary from county to county, but there is not a state statute that prohibits it. So the restrictions written on the back of CCL's might not carry the weight of law in every county.


All this is getting confusing so I'm just wanting to find the law, and read it.


If you have the link off hand I would be very grateful.
 
I have traveled to Alabama and have a TN handgun carry permit. There is no state law against carrying in a restaurant or bar in Alabama or drinking for that matter. The only law I know of, state law wise, is being drunk and carrying a handgun. I have heard that the county sheriffs may add restrictions to some licensees, but that has no bearing to me when I travel there because I follow state law...their restrictions apply to the licenses they issue. I hope that helps....It sounds like some sheriffs issue licenses with no restrictions some a few....some quite a few.
 
Thanks for the info, I would really like to know how a sheriff can put restrictions on a licence but not have it in a written legal document, at least not one I can find. What would they charge you with? Do the restrictions only apply to that county or anywhere you go?

BamaBob, I read through that and while I did learn a lot I simply didn't see anything about carrying while in a place that served alcohol, it might be there and I possibly just overlooked it, guess I need to reread it.

It seems to me that restrictions would apply to the licence holder, which would mean a person from another county (without such restrictions) could legally come to this county and carry in a place that serves alcohol, but I couldn't.
 
Alabama law Section 13A-11-75 states

"The sheriff of a county, upon the application of any person residing in that county, may issue a qualified or unlimited license to such person to carry a pistol in a vehicle or concealed on or about his person "

Sheriffs have long interpreted the qualified statement as authority to put limits on a permit.

There is no law against carrying in a place that servers alcohol in Alabama.
 
And that is the rub. Someone from out of State has more freedom in Alabama than most of the residents here. If your sheriff puts restrictions on your permit they will apply anywhere you go within the State, and maybe elsewhere. Our system needs to be fixed.

The non-resident being better off than the resident isn't new. My home town is in Michigan. I used to live in Iowa and had an Iowa carry permit. Good in my home town, but if I had moved back there my chances of getting a permit were about equal to the chances of the proverbial snowball in you know where.

More recently Michigan has put shall issue into effect, but for many years the above held true.
