I just wanted to alert everyone, do not do business with the following individual.

Mark Nimmons
He is posting air guns for sale on "American Air Guns" site. He is a straight up rip off artist. He just got my Son for about $2500 on a trade for a Daystate PCP. They both apparently shipped at the same time, the FedX tracking number was validated when my Son shipped the Daystate, and then once the Daystate was confirmed as shipped, the other guy, Mark cancelled the shipment. Now he doesn't answer phone calls and has reposted the same air rifles he was trading to my son as for sale again.

He is located in Michigan. His e-mail is [email protected]

Turn him in to the website and then the police. The heads up is nice, but something that puts an end to his shenanigans is even better.

Ya, we're working the process at this point in time, and those rifles he has posted right now are the one's that were supposed to be shipped to my boy. He reported it to the web site, but I don't know what going on with that right now, as I just heard about it tonight.

What he doesn't know, is I have family that live close enough to him to get the ball rolling, so too speak.

This cat was rather slick. He posted live video of the rifles being boxed and shipped, got a tracking number to my boy, then at the same time my boy was doing the same with the Daystate. Then when my Son checked on the tracking number / shipping status, the tracking number / shipment had been cancelled.

Thanks for the heads up as a friend of mine is really into air rifles and does a lot buying/selling/trading online. Will pass this info on to him.
 
I'll keep ya all updated on this, as this man did respond to an e-mail from me, stating that he will provide a valid tracking number on Tuesday. Being that this is a holiday weekend, I allowed for that, and instructed him to get them shipped by Tuesday to avoid further actions.

For all I know something may have happened on his end that created an unavoidable delay, don't know, but we'll see.

It sounds like he wanted to try out your sons gun before he makes the trade .
 
That sounds like a reasonable assumption, but he could have at least been a little more up front about things. Like I said though, we'll see, this thing still isn't officially over yet.

Good luck gs. Don't do anything to get yourself in trouble. Unfortunately in any transaction, you can get screwed. Some people have no scruples. It is a risk of doing busines anywhere. I try not to order off of the internet. Some times I can't resist.
 
I am not savvy in the way of online trading. I would imagine the website has no responsibility in a case like this one is described.

Hope if and when the return items are received that they meet expectations.

I agree and would not to business with him . I hope everything works out for your son .
 
Scam?
At one o'clock in the morning, it was "scam, scam" - no communication.
At eight o'clock in the evening the guy is answering email and promising a valid tracking number.
So......was the scam alert a rush to judgement? Basically, you called the guy a crook - which he yet might be - so far though he is guilty only of a failure to communicate.

Well Pete, considering the tracking numbers had been cancelled, yes, I would say things were looking pretty obvious. As for my posting, I didn't learn of this until Friday evening, and started trying to sort out the details, as well inform others that the guns were back up on the site again, thus he was apparently trying to hook another sucker.

The facts are, he cancelled the shipment, failed to communicate why, and re-posted the same firearms, so I don't feel like it was a rush to judgement, not at all.

This wasn't my deal, it was my son who made the transaction, and he isn't very accomplished when it concerns addressing such matters or individuals.

He cancelled the shipment and relisted the merchandise. He's a crook. If he delivers now it's only because he was called out.
 
Which likely the reason why he went with Fedx, rather than the US postal service.

I'll know more by tomorrow.

Too bad it was FedEx, otherwise it would be postal fraud.

It doesn't matter if the item is sent via the Post Office or private carrier:

18 U.S.C. § 1341 provides:

Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, or to sell, dispose of, loan, exchange, alter, give away, distribute, supply, or furnish or procure for unlawful use any counterfeit or spurious coin, obligation, security, or other article, or anything represented to be or intimated or held out to be such counterfeit or spurious article, for the purpose of executing such scheme or artifice or attempting so to do, places in any post office or authorized depository for mail matter, any matter or thing whatever to be sent or delivered by the Postal Service, or deposits or causes to be deposited any matter or thing whatever to be sent or delivered by any private or commercial interstate carrier, or takes or receives therefrom, any such matter or thing, or knowingly causes to be delivered by mail or such carrier according to the direction thereon, or at the place at which it is directed to be delivered by the person to whom it is addressed, any such matter or thing, shall be fined under this title or imprisoned not more than 20 years, or both. If the violation occurs in relation to, or involving any benefit authorized, transported, transmitted, transferred, disbursed, or paid in connection with, a Presidential declared major disaster or emergency (as those terms are defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122)), or affects a financial institution, such person shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both.[1]"

Also the US Postal Service won't lift a finger to try to recover your money or prosecute a small time scammer. Been there myself. From the Postal Inspectors website:

"If evidence of a postal violation exists, Postal Inspectors may seek prosecutive or administrative action against the violator. However, if money is lost through a fraudulent scheme conducted via the mail, Postal Inspectors lack the authority to ensure you receive a refund and can't require that products, services, or advertisements--on the Internet or elsewhere--be altered. "

Thanks JSH1, I kind of thought it would fall under the same law. That's kind of adds some additional leverage to use, if need be.

No tracking numbers yet. It is going to get official now. Enough is enough, this guy needs to learn a lesson, although I would bet he already has a criminal history being that he is 48 yrs. old.

Next step, start contacting the authorities, FedX, and the folks at the "American Air Gun" site.

I wouldn't imagine this is going to be a very short and sweet process, but if thing happen quicker than I think, I'll get back to ya all. Other wise, the mods are welcome to shut this one down in a few days.

Good news, he finally came through. I guess he just didn't want to comply with the notification dead line, cause he just sent the tracking numbers yesterday, but they were shipped on Tuesday.

So glad my boy didn't lose on this deal.

Don't loosen up on him until the stuff is in your son's hands and he confirms they are what they're supposed to be. You may still have to send the gendarme squad after him if he didn't send the original stuff and just empty boxes or boxes of rocks. I've seen that sort of scam happen before. Stay wary.
