Mid summer 2009. Shotguns like the Saiga 12, can be effectively banned by the whim of a new AG. Any imported firearm can also be banned at the whim of a new AG, who would determine if they have a "sporting purpose". The current administration did enough, as you may recall, including a barrel once a part of a "machine gun" as aprohibited part. There was also, I hope you haven't forgotten, the proposed regulations by OSHA, that would have made it very difficult to store or stockpile ammunition or reloading supplies.
What do you think will happen? The administration before last, did every thing they could to restrict the sale of firearms, even banning imports from at least two major countries. Laws were passed, but much was banned without any new law at all. In fact, an entire federal agency joined a lawsuit against gun manufacturers, and used the promise of a lawsuit dismissal, and a threat to continue as a club to beat and intimidate gun manufacturers from revealing gun purchase information, which is supposed to be confidential with the very people trying to ban as many guns as possible.
So, nothing has to pass Congress for guns to be banned.
