I'm trying to get my first handgun, I was going to get a Taurus Tracker .357 they did the check and they said i had to wait till Aug 2nd. Aug 2nd rolls by and still no answer the shop i was going to get the gun from said they havnt heard nothing back so i have to wait. I went to another shop today and they said after 3 days and you are not denied you are automatically cleared to get the gun. My question is who is right? I'm getting a little antsy and want to pick something up.

Another question how does this apply to internet sales because the people at one shop told me if the check isnt clear when the gun comes they have to send it back to whereever it came from at my expense. I don't know if they are just trying to get me to buy something from them or if they are being straight with me. First time buyer, pretty green with this stuff

no what happened was I was gonna buy a Tracker from the store, they did a background check they said wait till aug 2nd. aug 2nd went and passed and i didn't hear anything. I decided against the tracker and want a GP-100, i havnt decided if im gonna get it through the store or get it through the net. I'll probably save money through the net but if its a hassle I'll just pay the extra money and get it through the store. I went to another shop and they told me if on the 2nd if the background people didn't give me a thumbs down or say wait longer than i'm good to go to buy what i want. I don't know whos right or wrong

This reads like you where delayed. When they call in and a computer problem is present you will be delayed. If there is any question about your identity you can be delayed. If your name is the same or similar to a convicted felon you may be delayed while they look closer or dig deeper. For similarities they are likely to deny or deny while it is delayed. Once they delay they have 3 full days to get an answer back to the shop or you can go pick it up.
Most shops do not make the BG call until the pistol has been sold. Guns are like cars. they may lose significant value when you pick it up. Others only grow in value. If you bought it now you may face a restocking fee.

^so does that mean i'm good and they just didn't push the issue because i didn't pay for a gun yet? Seems to me like they might be acting shady because I asked about a GP-100 they they do not stock and they said they can special order for 519 plus tax and i asked about doing a transfer instead to save me some cash. See I don't know if they just dont know policy or what because all they said is they havnt heard back from the background check people which you and the dude from the other shop means i'm clear. I want that GP!

When you are delayed and nothing comes back for three business days, the dealer has the option of releasing the firearm to the buyer. It is not mandatory that they do so and some dealers will not release a firearm unless they get the OK from NICS.

If this is your first time going through a check, you almost always get delayed. In fact, if you haven't bought in a long time, you usually get delayed.
If the store won't sell to you without an OK from NICS, I beleive there is a number they can call and get the go-ahead on you. If they want your business, they need to start acting like it.

You should be able to purchase a GP100 from SW, Cabela's, or even BPS today if that's what you want. Personally, I have never had to wait longer than 15 minutes to buy a gun at a retail shop.

I have also never had any wait time to purchase in AZ.
Something doesn't sound right to me.
Unless you are trying to pull something off.

Well i dont live exactly in Phoenix it was a shop in Surprize off off grand ave but i believe the B&D place i think its called in Glendale told me how the protocall on the background check goes. great bunch of guys over there at the glendale shop. I'd buy from them but they only accept cash, i plan on charging this sucker and paying later

I've never been delayed the first time I've purchased a gun.;)

If you're buying somewhere else, the FFL you are transferring to doesn't know if you've actually purchased the gun yet or not. They do the BG check and when it's ok they fax the required paperwork to the seller. None of the places I've bought from would ship until they received the ok from the FFL.

When I've bought from a store, they've always done the BG before ringing up the sale.

That's the way it's been for me. Of course, it might differ for everyone else.

That is not true on any level. I have been with many people their first time buying a gun. You might have something in your background or something in your state causing a hold up.

Umm... not at all. It may SEEM like a long wait though, because not knowing what to expect from a background check is a little nerve-wracking :D

"A good reason to have your CCW permit. No call in checks, no wait time."

Is this true in AZ - I just received my AZ CCW, I'll have to try it out with my next paycheck that will finish the last installment on the new pistol.

I have a name of "initials only", so we always have to call in the early morning while the supervisor is not at lunch.... my name always get bounced to a supervisor, adds an additional five minutes.

If delayed, they give the dealer a date - if no call before that date/time then you are clear to purchase. The dealer can always call in again.

Be safe, BSR

Another thing, the store called back about my check after 30 days. That store lost my business for good with their attitude thats for sure. Seems like they were bitter that i got a gun from someone else besides them. They were saying stuff like if i was never cleared on the check that the cops can come and take my gun away from me. Reason i was probably delayed is because i got a misdemenor DUI like a year ago. They were really condescending and rude to me about all of this. They were also saying that if i got delayed than i will never be able to get a CCW permit. I thought they were alright over there but I was wrong, they lost my business for good they can keep their overpriced guns. I wont buy a cleaning brush from these jerks after they talked to me. They also said I can only get a paperweight of a 9mm for under 500 bucks lol yeah maybe if i bought it from them which will never happen. jerks

In the state of AZ if you are not denied after your waiting period, then yes you automatically qualify. I had the same issue at cabela's in Pheonix with my wife buying a rossi .38 special, 3 days later we hadn't heared anything, so we just went and got it no problems.

Okay... Is a misdemeanor DUI grounds for denial in Arizona?

Might be?

Did you lose money? You should be able to recover.

Fast way to pass, if the system is up and running: The social security number is NOT optional. Use it. I've NEVER been delayed.

The way i see it is this particular store is sore because I found a better gun at a better price and i didn't go with them to buy a Tracker for 100 dollars more than it was worth. I ended up geting a GP from a different shop 30 bucks more than what i would have paid out the door for the taurus that was "On Sale". The store i actually bought my gun from had the tracker there too at a normal listing price of 399 60 bucks less than their sale price. The tracker is a great gun but i know it isnt worth 500 bucks out the store

They call me the other day saying my 30 days is gonna expire so i go over there to see whats up mostly because I like looking at guns and i'm in the market for another one. They start telling me because my check was delayed and a definate answer never came back and because that a cop can come to me house and confinscate my gun. Then they were saying that since my check never came back I will never qualify for a CCW. When i said that doesnt sound right this guy got real condescending with me kind of talking down to me like I'm some kind of criminal or something. At that point i left the store never to come back again.

I was also delayed when i got my gun from the other shop but after 3 days they gave it to me. IMO i think the guys at the other store were blowing smoke because i didnt buy from them. As much as i go in there i can't believe they came at me like that, i felt really insulted. Not only that but while i was talking to them about that they told me i couldnt get a good 9mm for under 500 and tried to pitch a sigma at me for 400+ tax like it was a good deal and the best thing i can afford talking to me like I'm stupid. Saying anything under 500 is a paperweight which is funny because at the store i bought my ruger from they have plenty of great guns under 500 bucks. I might just buy a Glock 19 from them in the very near future for under 5

^ you are right it isnt, this store was basically trying to get one final pot shot at me for not buying their gun from them. The way they treated me they obviously didnt want my business. I dont know if it was their intention but they burned their bridge with me big time.
