The 22-year-old man had attended Monterey Peninsula College and had plans to attend Hartnell, she said.

"He was very funny," she added. "He could always make people laugh."

"He was smart, intelligent and outgoing," Christina Strain said. "He could draw very well."

Cant help but to be upset. Upset, that they try to make this sound like a tradgic event. Sure, he may have been a good kid before, but HAD HE NOT BEEN ROBBING ANOTHER PERSONS'S HOUSE, this would have never happened.

Good point jefnvk, it's "always" the "good little boy" after the fact- I'd almost guarantee the family knew what he was doing... AND they knew the road he was going down, but there was no interference/redirection. Now it's someone else's fault that the boy is dead.

:barf:

LadySmith's response about the defintion of "gangsta" made me curious, so a little web searching turned up this somewhat sad defintion with a funny ending:

A sociopathic member of the inner-city underclass, known primarily for being antisocial and uneducated. Also known for ready access to illegal drugs and weapons, and staggeringly poor marksmanship.

Salinas PD told me homeowner used a shot gun, paper said hand guns all around. Maybe PG shotgun? Interesting side note: a few months back another home invasion went sour for the BGs lead got his ass shot to death . In this case they were ripping off the white boy pot dealer. Since said WB had weed for sale he was charged for manslaughter, since he had no priors it was dropped by judge if he ENLISTED !!!! After all he obviously can shoot! This home owner will NOT be charged, was clean shoot! However I smell bottom feeding lawyers after some $$$ for the porboy's family

Realize that in this day and age I don't even beleive that is legal. I was specifically asked this when I enlisted in 1989 for the Marine Corps. This was on a standard form. Why would the military benefit from this person?

Nationally reported as being questioned for legality and what would the service do about the traces of THC in the 'recruits' hair?

Why do I have the intense desire to meticulously point out to his family that the reason he is dead is because he did incredibly stupid things, that he deserved his painful death, and that it is probably their fault for raising him poorly?

What's really a shame is that this poor homeowner, while still alive and well, is going to go through a world of dirt with scummy lawsuits and publicity for defending himself.

What we really ought to do is research and name publicly the AG and Judge who dropped those previous charges and let this 'gangsta' roam the streets-THEY'RE directly to blame for his ability to terrorize another person....

CLARISSA ALJENTERA and GEORGE B. SANCHEZ, Herald Staff Writers, might think differently of Richard Strain's ilk when same invites himself into their home.

A quick Google News search shows that their article was the most slanted of the Dec. 23 news reports on the shooting.

Peet, have some respect. There are of course philosophical problems with the law when it has become as detached as it has from common sense and plain language.

However, there are still upstanding citizens who need, and are willing to pay well, to retain good lawyers. As long as that is the case, not all lawyers will be bottom-feeders.

If you want bottom-feeders, start with Bill Lockyer and John Edwards.

We need more laws in California...

Like a Make my Day law that exculpates anyone from shooting/killing a criminal within their property from any civil liability. Tort Reform Now!

Gordon - Can you even tell the difference between "death metal" and other types of metal? Doubtful. If I let you listen to some of the music I listen to, you'd inevitably classify it as "death metal," and you'd be wrong. On the other hand, there are death metal songs that sound nothing like the generic death metal and you'd never guess they were written by the a "death metal" group. You shouldn't generalize music like that, you'll invariably be wrong.

Enlistment

Realize that in this day and age I don't even beleive that is legal. I was specifically asked this when I enlisted in 1989 for the Marine Corps. This was on a standard form. Why would the military benefit from this person?

The marine corps has very strict enlistment standards. The army has the lowest enlistment standards (for select MOS). I think the key part of the situation is that he has no priors, which means he is cleaner than some that enlist. Of course he'll have to pass a drug test when he does enlist... which for someone dealing weed might be a problem.

I was just trying to remember when articles like this one started. When I first started reading newspapers they interviewed the victim or the survivor and just gave the bare facts about the criminal. Now the journalists always want to interview the criminal's family and let them eulogize him in the same article in which the paper reports his crimes.

Maybe it's an outgrowth of their training that "there must be two sides to every story."

It seems to have started at the same time they started referring to people shot while committing crimes as "victims." That really irks me.

Christina Strain said. "He could draw very well."

Like P95 when I read that the first thing that popped into my head was this kid with some kind of fast draw setup practicing with a shot timer. Then I started to think about it and I realized they were probably meant "draw" in the artistic sort of way.

I would argue against certain types of music telling people to do things.

There is very little evidence that music causes people to actually do things. The problem here is not gangsta rap or death metal. Classical music doesn't make people smarter or cause them to pass algebra. The problem is people not willing to hurt others feelings on camera. The kid didn't rob houses because he listened to rap. He robbed houses because he wanted to. Personal responsibility is the key phrase here.

The Pb injection in center mass is the consequence for those actions. Sad that such young person had to die. Maybe his death will be a lesson to his peers.
Live and learn.
