CCW in MO while under 21, but over 18

OK, I've done some research, think I've got this figured out, and I want to know what you guys think -- or if I should consult a lawyer before going through with this.

Here's the facts:

- MO only offers CCW licenses to people over 23, but honors CCW from Maine.
- Maine gives CCW's via mail to non-state residents.

- MO doesn't allow you to own a handgun under 21, except for a specific statement in the statutes saying that curio or relic firearms are exempt - and, from what I understand, you can get a C&R handgun if you are under 21, but over 18, as long as it is a gift. You cannot purchase it yourself.

OK, so what is to stop me from asking for a C&R handgun as a birthday gift, getting it, then getting my CCW through Maine and carrying?

Of course, I don't expect every cop to know the law in that much detail - that's a lot of loopholes and all. I would definitely carry a copy of all legal information both in my wallet, and in my car.

.... So, what do you guys think? Am I crazy, or no?

If you get caught you will likely NEVER get a CCW in Missouri. No matter if or where you get a permit you STILL must obey Missouri's law. And the law is no CCW until age 23 no matter who's permit you have.

And you should consult a lawyer, to keep your butt out of jail if you get caught doing this.
 
Is it really 23 ..... seems so hypocritical that we allow younger individuals to die for this country and yet restrict their rights.
 
agreed, I discuss this alot, so I can Serve and Die for my damned country, but I cant walk into a bar or a pub or a club and pay for a drink with my own hard earned $$$$ Cant Purchase or obtain A license to conceal a pistol. Oh but did I mention im allowed to vote?? What kind of frickin logic is that??:banghead:

Im trusted to be mature enough to help elect the leaders of my state and country into power as I see fit, including the President of the United States of America but I can not do either of those things??:fire:

and what is to stop you is the how reciprocity or states honoring other states CCW license's works. One must always abide by the state or jursidictions laws of which your are in order to be with in the law.


contact a lawyer from both states if you go ahead and attempt to do this which I say you DO NOT attempt.

Whoa whoa, I'm not going to do it if I have to worry about getting caught first. I definitely want to make sure it's legal.

As far as the age 23 thing goes, I know a lot of people from MissouriCarry.com that are over 21 but under 23 and have permits from out-of-state and are perfectly legal.
 
You still have to follow MO's law which is 23. It'd be the same as having an out of state drivers license and thinking you don't have to obey any of MO's speed limits.
 
Actually, they do not ISSUE permits to 21 year olds. But if one already has an out of state permit, according to the law, that should be honored.

I think you're good to go.

There is a lot of information on this thread that is just plain WRONG.

You can indeed carry a concealed weapon, with a valid license from any state, at any age, in Missouri.

571.030. 1. A person commits the crime of unlawful use of weapons if he or she knowingly:

(1) Carries concealed upon or about his or her person a knife, a firearm, a blackjack or any other weapon readily capable of lethal use;

...

4. Subdivisions (1), ... of subsection 1 of this section shall not apply to any person who has a valid concealed carry endorsement issued pursuant to sections 571.101 to 571.121 or a valid permit or endorsement to carry concealed firearms issued by another state or political subdivision of another state.

No restrictions on age. However, you cannot GET a Missouri license until 23. You can still carry on any other license at any age. I carried on a Florida permit since I turned 22 (that's when the MO CCW law was passed).

2. A certificate of qualification for a concealed carry endorsement ... shall be issued by the sheriff ... if the applicant:

(1) Is at least twenty-three years of age,

To legally acquire a pistol in Missouri, you have to be 21 (to get a Permit to Acquire), unless the pistol is a C&R (under Missouri law).

571.090. 1. A permit to acquire a concealable firearm shall be issued by the sheriff of the county in which the applicant resides, if all of the statements in the application are true, and the applicant:

(1) Is at least twenty-one years of age,

571.080. 1. A person commits the crime of transfer of a concealable firearm without a permit if: ...

3. Subsection 1 of this section shall not apply to the acquisition by or transfer of concealable firearms among manufacturers, wholesalers or retailers of firearms for purposes of commerce; nor shall it apply to antique firearms or replicas thereof; nor shall it apply to curio or relic firearms as defined in section 571.010.

571.010.(1).(b) Curio or relic firearm is any firearm deriving value as a collectible weapon due to its unique design, ignition system, operation or at least fifty years old, associated with a historical event, renown personage or major war;

If the pistol is a C&R, you can buy it at 18, but not from an FFL who couldn't sell it to you unless you were 21 (federal law). You can get a gift of a pistol, or buy it, so long as it's a C&R.

There are no restrictions on firearm transfers in Missouri so long as it's not a non-C&R pistol.

Alternatively, you could buy privately or be given a modern pistol in another state where you reside, then move to Missouri, where you can legally possess the pistols you already had. The 21 year old requirement in Missouri is only to acquire not possess.

If you can get a license from any state at 18, and find a C&R either for private sale or get one as a gift, you can indeed legally carry it.
