Ran across an article about defense of property in South Dakota today in local paper.

Because he was afraid, the owner of Circle K Resort on Lake Traverse grabbed his shotgun before stepping outside his bedroom, said the county’s sheriff."

"Moen said he doesn’t encourage people to take matters of the law into their own hands. But he understands why they do it.

“I tell them, they have the right to defend their property and their life,” he said. “I’m sure I’ll get in trouble for that, but that’s the way I feel.” "





Sounds like the sheriff would be a cool one to have.
 
My favorite line in story is

Holicky probably won’t be charged, Moen said.

“(The teens) are the suspects, not the victims here,” Moen said.


We need more Sheriffs in this country like Moen.
 
The police cheif in MINNEAPOLIS said the same thing the other day!

No trouble here. I think ALL seriffs should believe in the right to self-defense ... ESPECIALLY inside your own home.

Reminder to self -- load gun before investigating things that go CRASH in the night
 
Defending yourself is not taking the law into your own hands.

Sure it is as it is defined in the law that you can defend yourself, along with the particular circumstances, conditions, etc. as defined in each state.

What it isn't is vigilantism which is the act of not following due process of the law in order to assert punishment.
